Book excerpt: Excerpt from The Constitution Law of the Church in the First Two Centuries The volume from which this translation is made was published at Leipzig early in the present year, under the title Entstehung und Entwickelung der Kirchenverfassung und des Kirchenrechts in den zwei ersten Jahrhunderten, nebst einer Kritik der Abhandlung R. Sohm's: "Wesen und Ursprung des Katholizismus" und Untersuchungen uber "Evangelium," "Wort Gottes," und das trinitarische Bekenntnis, von Adolf Harnack (Leipzig, J. C. Hinrichs, 1910). This volume may be said to consist of five essays, all treating of subjects closely connected in primitive Christianity. The first essay, "The Origin and Development of the Constitution and Law of the Church in the First Two Centuries," constitutes the book proper; the second, third, and fourth essays, on "Primitive Christianity and Catholicism," "The Fundamental Confession of the Church," and "Gospel," form the appendices; while the fifth essay, on "Word of God," appears as a supplementary note. This translation differs in some details from the form of the original volume. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Available in PDF, EPUB and Kindle. Book excerpt: This is an account of the ideas about and public policies relating to the relationship between government and religion from the settlement of Virginia in 1607 to the presidency of Andrew Jackson, 1829–37. This book describes the impact and the relationship of various events, legislative, and judicial actions, including the English Toleration Act of 1689, the First and Second Great Awakenings, the Constitution of the United States, the Bill of Rights, and Jefferson's Letter to the Danbury Baptists. Four principles were paramount in the American approach to government's relation to religion: the importance of religion to public welfare; the resulting desirability of government support of religion (within the limitations of political culture); liberty of conscience and voluntaryism; the requirement that religion be supported by free will offerings, not taxation. Hutson analyzes and describes the development and interplay of these principles, and considers the relevance of the concept of the separation of church and state during this period.

Book excerpt: Excerpt from The Book of Church Law As for the endowments by which the clergy of the Church are maintained, and its divine service provided for, they have not been bestowed by the State out of the public exchequer, but have mostly been derived from money or land offered for the purpose by sovereigns, noble men, and other persons, in their private capacity, and out of their private possessions.1 A very large amount of the property thus given was alienated from religious to secular uses in the time of the Tudors, and this alienation was confirmed by Act of Parliament; but no corresponding endowment of the clergy by Act of Parliament is to be found. Available in PDF, EPUB and Kindle. Book excerpt: Spanning both the history of the modern West and his own five-decade journey as a historian, Gerald Stourzh’s sweeping new essay collection covers the same breadth of topics that has characterized his career—from Benjamin Franklin to Gustav Mahler, from Alexis de Tocqueville to Charles Beard, from the notion of constitution in seventeenth-century England to the concept of neutrality in twentieth-century Austria. This storied career brought him in the 1950s from the University of Vienna to the University of Chicago—of which he draws a brilliant picture—and later took him to Berlin and eventually back to Austria. One of the few prominent scholars equally at home with U.S. history and the history of central Europe, Stourzh has informed these geographically diverse experiences and subjects with the overarching themes of his scholarly achievement: the comparative study of liberal constitutionalism and the struggle for equal rights at the core of Western notions of free government. Composed between 1953 and 2005 and including a new autobiographical essay written especially for this volume, From Vienna to Chicago and Back will delight Stourzh fans, attract new admirers, and make an important contribution to transatlantic history.

Book excerpt: Excerpt from The Law and Custom of the Constitution, Vol. 1: Parliament I have sometimes found it difficult to write on the topics to which the remaining and larger part of the books is devoted, with sufficient fullness to convey a definite im pression of their place in the general scheme of Government, yet not 'on such a scale as would destroy the proportions of my plan or would suggest that I am giving information which is more properly sought for in special treatises. Hence perhaps the reader may ask why, on some of these subjects, I have said so much; or why, having said so much, I have said no more. If I have induced him to seek for fuller knowledge I shall not have written in vain. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Instead of exercising forbearance towards frail churchmen, he visits every peccadillo, as if it were a heinous offence. Above all, he prosecutes those with the utmost rigour of the spiritual court, who wrapping themselves up in their innocence, appeal to the Canons for their justification, in bar of his despotic authority." - Gil Blas. As God is the Author of life, so is He the Author of law By Me kings reign, and lawgivers decree just things (prov. Viii. This general truth is particularly seen in that Divine society, the mystical Body of Jesus Christ, which is quickened by the ever abiding presence-oi the Holy Ghost, Himself the Lord and Life-giver. From the earliest days of the Church, law has existed as essential to her existence. The keys of the kingdom, symbols of power, were of Old given to one who was hidden to confirm his brethren and to feed the flock. This charge to Blessed Peter was not only to teach infallibly, but also to govern with Divine authority the Church over which he was set as head. Thus, we see him, after the Ascension, standing up in the midst of the disciples and pre siding over the election of Matthias, who was numbered with the eleven. The Prince of the Apostles exercised jurisdiction by that first sermon on the Day of Pentecost when he preached Jesus of Nazareth, a Man approved of God as both Lord and Christ; and he opened the Church by baptism on that same day to 'about three thousand souls.' Book excerpt: Excerpt from The Ecclesiastical Law of the Church of England, Vol. 1 of 2 The last edition of Dr. Burn's Ecclesiastical Law was edited by me in 1842. Since that period many and important alterations have been made in that law. The present Treatise incorporates considerable portions of Dr. Burn's Work, but it is framed upon a totally different model, and, while it contains a very large portion of entirely new matter, omits those subjects over which the Ecclesiastical Courts have ceased to exercise jurisdiction. The dictionary form adopted by Dr. Burn, how ever superficially convenient, appears to me fatal to any attempt to produce the law in the form of a system arranged according to the principles of science. Book excerpt: Excerpt from Two Centuries' Growth of American Law, 1701-1901 There were also two missionary societies chartered in Eng land for operations in America, which were much before the public eye. One was the President and Society for Props gating the Gospel iu New England and Parts adjacent incorporated in 1659 under the Commonwealth, and rechar tored soon after the Restoration. This was in the hands of the dissenters.' The other, the Society for the propagation, of the Gospel in Foreign Parts, was chartered in 1701, in the interest of the Church of England, by the procurement of an American clergyman, the Rev. Dr. Thomas Bray, Commissary of the Bishop of London for Maryland.' This soon sent its missionaries over all the colonies. Grants of land were occasionally made to it, and it not infrequently stood behind the parish clergy, when they were setting up the claims of the church to property which had been devoted to pious uses.' It has been already said that the large business enterprises of the earlier colonists had been managed through the form of voluntary association in a joint-stock company. Such organizations were good at common law, and when the Act of Parliament by which they were prohibited in the colonies after 1741 fell with the Revolution, the old practice was naturally resumed.
