Book excerpt: Consent has enjoyed a prominent position in the American privacy system since at least 1970, though historically, consent emerged from traditional notions of tort and contract. Largely because consent has an almost deferential power as a proxy for consumer choice, organizations increasingly use consent as a de facto standard for demonstrating privacy commitments. The Department of Health and Human Services and the Federal Trade Commission have integrated the concept of consent into health care, research, and general commercial activities. Despite consent's prominence in U.S. law, this article seeks to understand, more fully, consent's origins and development, then applies a philosophical-legal lens to clearly identify problems with consent in its current use. Jürgen Habermas' theory of communicative action as it applies to private and public spheres and Helen Nissenbaum's model for contextual inquiry provide useful lenses for understanding the impact of consent on human autonomy. This article suggests five resulting problems for human autonomy, the “consent myth,” and four principles for addressing these problems in contemporary health technologies, such as Internet of Health Things (IoHT) and artificial intelligence (AI) applications.

It posits that legal capacity for consent is not an “on/off” switch. It questions the notion that capacity - our rough filter for the ability to consent - flips on at some relatively arbitrary time that one might, as a matter of tradition, call “the age of consent,” and off again with early onset dementia or Alzheimer's disease. A more nuanced view of consumer capacities rests, in part, on the understanding neuroscience and psychosocial evidence provide. This perspective suggests that we should match our rules and jurisprudential approaches to the variable capacities that we all show in different contexts and stages of life. By highlighting that most negotiating parties, in a given moment or context, may possess rather less than legally presumed capacity to consent, this Essay emphasizes the need for legal reform.

Internal and external consent play a role in understanding sexual assault because sexual assault is defined as "nonconsensual sexual activity obtained through force, threats, intoxication, or intimidation." Factors related to understanding consent may include attitudes regarding sexual assault and rape, known as rape myths, which are defined as attitudes and false statements concerning rape that are widely known and accepted, mainly served to justify male sexual aggression towards women. The southeastern United States is known for being religiously and politically conservative, where gender roles are intertwined with a more traditional sexual script. Gaining additional understanding from the use of Bronfenbrenner's Human Ecological Theory, the purpose of this study was to recognize the association between rape myth acceptance and the use of internal and external consent measures in 831 college students in the southeastern region of the United States. Men were found to have higher rape myth acceptance, and also reported using more specific external consent cues related to direct nonverbal behavior and borderline pressure compared to women. Women who reported lower acceptance of rape myths also reported using more external explicit consent cues such as communication/initiator behaviors. Future research should continue to examine consent because of the importance in sexual assault discussions. This study showed that rape myth acceptance does play a role in consent behaviors, and if attitudes regarding sexual assault change, the occurrence of sexual assault can potentially change as well.
