This book was released on 1990 with total page 224 pages. Available in PDF, EPUB and Kindle. Book excerpt: While political thinkers on the left are undisputably concerned with justice, they dismiss those legal institutions which, in liberal capitalist societies, have insured some minimum measure of justice in citizen's lives. Here, Sypnowich argues against this doctrine by showing that however ideal a society socialists envisage, legal institutions would be necessary to fairly adjudicate conflict between private and public interests. Each chapter addresses an issue in liberal jurisprudence to see how it would fare in a socialist theory that takes a constructive approach to law. Among the subjects covered are the rule of law, natural and legal rights, obligation, and the sources of law.

Book Synopsis Socialism and Legal History by : Ville Erkkilä
Download or read book Socialism and Legal History written by Ville Erkkilä and published by Routledge. This book was released on 2020-11-26 with total page 265 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book focuses on the way in which legal historians and legal scientists used the past to legitimize, challenge, explain and familiarize the socialist legal orders, which were backed by dictatorial governments. The volume studies legal historians and legal histories written in Eastern European countries during the socialist era after the Second World War. The book investigates whether there was a unified form of socialist legal historiography, and if so, what can be said of its common features. The individual chapters of this volume concentrate on the regimes that situate between the Russian, and later Soviet, legal culture and the area covered by the German Civil Code. Hence, the geographical focus of the book is on East Germany, Russia, the Baltic states, Poland and Hungary. The approach is transnational, focusing on the interaction and intertwinement of the then hegemonic communist ideology and the ideas of law and justice, as they appeared in the writings of legal historians of the socialist legal orders. Such an angle enables concentration on the dynamics between politics and law as well as identities and legal history. Studying the socialist interpretations of legal history reveals the ways in which the 20th century legal scholars, situated between legal renewal and political guidance gave legitimacy to, struggled to come to terms with, and sketched the future of the socialist legal orders. The book will be a valuable resource for academics and researchers working in the areas of Legal History, Jurisprudence and Philosophy of Law and European Studies. Book Synopsis Asian Socialism & Legal Change by : John Gillespie
Download or read book Asian Socialism & Legal Change written by John Gillespie and published by ANU E Press. This book was released on 2005-08-01 with total page 354 pages. Available in PDF, EPUB and Kindle. Book excerpt: The immense process of economic and social transformation currently underway in China and Vietnam is well known and extensively documented. However, less attention has been devoted to the process of Chinese and Vietnamese legal change which is nonetheless critical for the future politics, society and economy of these two countries. In a unique comparative approach that brings together indigenous and international experts, Asian Socialism and Legal Change analyzes recent developments in the legal sphere in China and Vietnam. This book presents the diversity and dynamism of this process in China and Vietnam-the impact of socialism, constitutionalism and Confucianism on legal development; responses to change among enterprises and educational and legal institutions; conflicts between change led centrally and locally; and international influences on domestic legal institutions. Core socialist ideas continue to shape society, but have been adapted to local contexts and needs, in some areas more radically than in others. This book is the first systematic analysis of legal change in transitional economies.

Available in PDF, EPUB and Kindle. Book excerpt: Since China's reform and opening up started in 1978 and Vietnam's Doi Moi reforms were initiated in 1986, these two East Asian economies have adopted capitalistic models of development while retaining and reforming their socialist legal systems along the way. Tracking the trajectory of socialist laws and their legacy, this book offers a unique comparison of laws and institutional designs in China and Vietnam. Leading scholars from China, Vietnam, Australia and the United States analyze the history, development and impact of socialist law reforms in these two continuing socialist states. Readers are offered a varied insight into the complex quality and unique features of socialist law and why it should be taken seriously. This is a fresh theoretical approach to, and internal critique of, socialist laws which demonstrates how socialist law in China and Vietnam may shape the future of global legal development among developing countries.
Book Synopsis China's Socialist Rule of Law Reforms Under Xi Jinping by : John Garrick
Download or read book China's Socialist Rule of Law Reforms Under Xi Jinping written by John Garrick and published by Routledge. This book was released on 2016-01-29 with total page 418 pages. Available in PDF, EPUB and Kindle. Book excerpt: Under the direction of the Communist Party of China (CPC), key legal challenges have been identified which will shape the modernization of China’s legal and administrative institutions. An increasingly complex set of legal actors now seek to influence this development, including securities regulators, bankers, accountants, lawyers, local-level mediators and some of China’s newly rich. Whilst the rising middle class wants to voice its interests and concerns, the CPC strives to maintain its leading role. This book provides a critical appraisal of China’s deepening socialist rule of law and looks ahead to the implications of the domestic reforms for the international legal domain. With contributions from leading Chinese law specialists, it draws on specific illustrations from judicial reform, constitutional law, procedural law, anti-corruption, property law and urban development, socio-economic dispute resolution and Chinese macro-economics. The book questions how China’s domestic law reforms will impact international legal systems, and how international law can be used in managing key regional and bilateral relationships and in dispute resolution, such as in the South China Sea and international trade. Assessing the state and direction of domestic law reform and including debates around the legal implications of some of China’s most pressing foreign policy challenges today, this volume will be of huge interest to students, scholars and practitioners with an interest in Asia law, Chinese law, international law, comparative law and law reform.

Book Synopsis National Socialist Family Law by : Mariken Lenaerts
Download or read book National Socialist Family Law written by Mariken Lenaerts and published by Martinus Nijhoff Publishers. This book was released on 2014-11-06 with total page 347 pages. Available in PDF, EPUB and Kindle. Book excerpt: In National Socialist Family Law, Mariken Lenaerts analyses the possible influence of National Socialism on marriage and divorce law in Germany and the Netherlands. As the family was regarded the germ-cell of the nation, the Nazis made many changes in German and Dutch marriage and divorce law to suit their purpose of a thousand-year Aryan Reich. By making extensive use of archival resources, Mariken Lenaerts gives an overview of the most important changes adopted in marriage and divorce law by the Nazis and proves that although daily marital life in both countries was highly influenced by National Socialism, marriage and divorce law did not become National Socialist. Book Synopsis The Collapse of State Socialism by : Bartolomiej Kaminski
Download or read book The Collapse of State Socialism written by Bartolomiej Kaminski and published by Princeton University Press. This book was released on 2014-07-14 with total page 279 pages. Available in PDF, EPUB and Kindle. Book excerpt: Does the abrupt collapse of communist regimes in Eastern Europe arise only from errors in implementing the policy of state socialism, leaving the concept itself still a potentially valid one? Bartlomiej Kaminski argues to the contrary: state socialism is a fundamentally defective idea that was well carried out, enabling it to exist until its accumulated shortcomings made its survival extremely difficult. How did the flawed state-socialist system endure for so long? Why is it failing now? In answering these questions, Kaminski, who is both an economist and a political analyst, proposes a general theory and then applies it to the case of Poland. Contending that the breakdown of state socialism results from symbiosis of the state and the economy, the book describes how communist governments searched for tools that would replace the market mechanism and the rule of law. Doomed in advance by the absence of autonomy and competition, this search generated new crises by undermining the state's capacity to suppress individual interests and to direct the economy.
