Book excerpt: Through an analysis of the career of the eminent courtier Sir Thomas Overbury, Epistolary Courtiership and Dramatic Letters re-examines what is meant by courtiership in the Jacobean period. With a particular focus on the years between 1609 and 1613, the book brings together many of the letters surrounding the scandal leading to Overbury's murder and provides an examination of epistolarity in the context of humanist and legal learning. Defining key themes of social mobility, homosociality and the legal power of James VI and I, it exposes the mechanisms by which men rose at his court and provides a context for a new reading of contemporary dramatic texts by Shakespeare, Webster and Chapman. The book argues that the changing performance of courtiership at James's court, the wider knowledge of that reflected in contemporary letters and consequently shifting attitudes, all alter the performance of courtiership in the playhouse.

Book excerpt: Alexander Hamilton is commonly seen as the standard-bearer of an ideology-turned-political party, the Federalists, engaged in a struggle for the soul of the young United States against the Anti-Federalists, and later, the Jeffersonian Republicans. Alexander Hamilton and the Development of American Law counters such conventional wisdom with a new, more nuanced view of Hamilton as a true federalist, rather than a one-dimensional nationalist, whose most important influence on the American founding is his legal legacy. In this analytical biography, Kate Elizabeth Brown recasts our understanding of Hamilton's political career, his policy achievements, and his significant role in the American founding by considering him first and foremost as a preeminent lawyer who applied law and legal arguments to accomplish his statecraft. In particular, Brown shows how Hamilton used inherited English legal principles to accomplish his policy goals, and how state and federal jurists adapted these Hamiltonian principles into a distinct, republican jurisprudence throughout the nineteenth century. When writing his authoritative commentary on the nature of federal constitutional power in The Federalist, Hamilton juxtaposed the British constitution with the new American one he helped to create; when proposing commercial, monetary, banking, administrative, or foreign policy in Washington's cabinet, he used legal arguments to justify his desired course of action. In short, lawyering, legal innovation, and common law permeated Alexander Hamilton's professional career. Re-examining Hamilton's post-war accomplishments through the lens of law, Brown demonstrates that Hamilton's much-studied political career, as well as his contributions to republican political science, cannot be fully understood without recognizing and investigating how Hamilton used Anglo-American legal principles to achieve these ends. A critical re-evaluation of Hamilton's legacy, as well as his place in the founding era, Brown’s work also enhances and refines our understanding of the nature and history of American jurisprudence.

Book excerpt: The criminal legal system defines and authoritatively enacts the boundaries of permissible and impermissible behaviour, with a focus on that which is prohibited or transgressive. Wickedness and Crime: Laws of Homicide and Malice seeks to expose the ways in which criminal law communicates and sanctions particular models of wickedness. This book illuminates the intimate relationship of crime and definitions of wrongdoing. A central contention of the book is that if a criminal legal system empty of normative content is undesirable and implausible, then we must think critically about the types of models of wickedness that are communicated by criminal legal doctrine. Through historical and contemporary analysis of the legal concept of malice, Penny Crofts examines the types of models of wickedness that are established through criminal legal doctrine. The book draws upon literature, philosophy and jurisprudence to place wickedness at the centre of an account of criminal law. Arguing that the current dominant idea of wickedness communicated in criminal law lacks nuance and clarity, this book examines the implications in terms of the legal subject, social responsibility and the jurisdiction of the legal system. Through historical accounts of malice the book provides resources to enrich a contemporary jurisprudence of blaming. A fascinating contribution to the study of law, this book will interest criminal legal scholars who seek a deeper understanding of the complexity of the relationship between law and morality. The book also provides a resource for legal theorists and philosophers of wickedness, supplying a sustained example and analysis of the implications of types of models of culpability.

Available in PDF, EPUB and Kindle. Book excerpt: The Origins of Free Peoples posits demonstrates that free peoples are always being liberated and are never already free. Free peoples make freedom paramount over justice, equality, or other value values. The history of such peoples is different from their origins, which are always underway as free people must construct both their history and their Others. It is not simply that they become threatened; they must face the correct kind of threat. The book examines how freedom is discussed in classic and contemporary Anglo-American texts which argue the notion that freedom is natural and needs only to be guaranteed by limited government. Using a Continental and postmodernist approach, the book offers an alternative conceptualization of the discourses and practices of freedom represented in the writings of theorists such as Locke, Rawls, Benn, and Swanton. With its distinctive position in the discussion of freedom, The Origins of Free Peoples will appeal to social political theorists, political philosophers as well as to those looking to understand the main factors needed to genuinely liberate a people.
