Book excerpt: Excerpt from The Civil Code of Brazil There were four unsuccessful attempts at codification of the Brazilian civil law made before the final e ort was crowned with brilliant success. By Decree of De cember 22, 1858, it was ordered that the Minister of J us tice should contract with a jurist of his choice for the preparation of a project for a Civil Code. On January 11, 1859, the work was entrusted to the eminent jurist Teixeira de Freitas, to whom the Imperial Government, on February 15, 1855, had already entrusted the arduous task of consolidation of the civil laws preparatory to the intended codification. The result of the long protracted labors of this jurist was what he himself submitted, not as a project but as a Sketch, consisting of Articles, and even then unfinished, as it left untouched the entire Book III, the very important subject Of Obligations. The excessive work contributed to unset tle the mind of this, the greatest civilist of South Amer ica, and thus the first attempt came to a sad end. In 1872 the work was entrusted to the Councillor Na buco de Araujo, the same who, as Minister of Justice in 1859, had contracted it with Dr. De Freitas. The new codifier died shortly afterwards, having drafted but 182 Articles, with no plan outlined for the distribution of the matters to comprise the work. The work carried him unhappily to his grave. This book is in two parts. The first part charters capitalism’s historical progression to globalism through the lens of the act of taking. Taking has risen to institutional prominence as a core concept in the legal lexicon of foreign investment protection to denote deprivation of private property. Post-Colonial Globalisation advances a broader notion of taking as a tool of social criticism. From enclosures, to colonial settlement to an empire of unequal exchanges, to contemporary land grabs, private property, now so vigorously protected against taking, was itself born out of taking. The second part focuses on the ecological dimension of neoliberal globalisation and its hallmarks of unlimited growth and excessive extraction. It has negatively impacted the climate, the earth and its human and non-human inhabitants to the point of putting their continued existence at risk. Central to this is the deification of property. Our understanding of proprietary relations and the rights they confer must be revisited if our interface with the planet is to be reconfigured. The emerging doctrine of rights of nature offers one route which may lead us in this direction. The two parts complement each other. One looks at taking by members of the human species from each other. The other looks at taking by the human species from nature. This book is aimed at anyone who wishes to gain insight into the current crisis, including students, academics, NGOs and policymakers.

This book examines the insurgence of democratic citizenship in the urban peripheries of São Paulo, Brazil, its entanglement with entrenched systems of inequality, and its contradiction in violence. James Holston argues that for two centuries Brazilians have practiced a type of citizenship all too common among nation-states--one that is universally inclusive in national membership and massively inegalitarian in distributing rights and in its legalization of social differences. But since the 1970s, he shows, residents of Brazil's urban peripheries have formulated a new citizenship that is destabilizing the old. Their mobilizations have developed not primarily through struggles of labor but through those of the city--particularly illegal residence, house building, and land conflict. Yet precisely as Brazilians democratized urban space and achieved political democracy, violence, injustice, and impunity increased dramatically. Based on comparative, ethnographic, and historical research, Insurgent Citizenship reveals why the insurgent and the entrenched remain dangerously conjoined as new kinds of citizens expand democracy even as new forms of violence and exclusion erode it. Rather than view this paradox as evidence of democratic failure and urban chaos, Insurgent Citizenship argues that contradictory realizations of citizenship characterize all democracies--emerging and established. The daily struggles arising from political agendas within different societies confirm this. This perspective can be summarised using the Hegelian expression “struggle for recognition”, and it is this expression that underpins the current position of minorities members and their defenders. This means that misrecognition, disrespect, and humiliation form the base of (cultural) injustices and must be avoided. Minorities are a fundamental part of democratic societies, but their rights have not always been respected. Inmigrants are currently the object of xenophobic campaigns. Rome people, the European minority, face additional difficulties, which results in them being key players in cases of indiret discrimination. The distribution of territorial power and the situation of national minorities have been causes of different political problems.“Who am I? Where do I belong?” are questions asking for indentity. Some people argue these should be relevant issues when applying the criminal law, circle of moral incumbency to cover animals -non humans-, arguing that they of life that involves their survival as a whole.
