Excerpt: ...with that class of goods, so that he might buy the competitor's article under the suppoposition that he was buying the patented article. Chapter V. PATENTING A NEW PRODUCT. THERE are three forms of direct patent protection which it is possible to use to obtain a monopoly of a product and one form of indirect protection. The first and best protection would be that of a patent on the product itself. In order to obtain a patent on the product the product must be new. If the product is one which is covered by a patent, but for which the patent is about to expire, it would not be sufficient merely to make a slight improvement, because the patent would cover only jthe improvement. The form of the product covered by the original patent would be public property and anyone could make or use or sell it. It is quite often supposed that by getting a new patent, not only is the improvement covered, but the elements of the product which were the subject of the first patent are also protected. I have shown in the fourth chapter, under the heading "Avoiding Infringement by Omitting an Element of the Claim," that to omit an element of a claim without substituting any equivalent is to avoid the claim. Thus, if the improved product had five elements, A, B, C, D, and E, and the product as covered by the original patent had only four of these elements, A, B, C, and D, the patent on the improvement would cover the use of only the elements, A, B, C, and D, without the element E; and, moreover, the second patent, if it had the effect of covering the product of the first patent, would be void because it covered what must become public property at the expiration of the first patent. For instance, in the first planer, the return of the table was no...

Analysis of Section 101 cases has been expanded and highlighted in a separate chapter. Author Joseph Root presents a unique approach to mastering the art of patent drafting by distilling Federal Circuit jurisprudence into a set of rules, each embodying the essence of requirements for patent validity in a given area. One cannot employ these rules by rote, but understanding and applying their underlying principles will lead to bulletproof patents. Earlier editions gained widespread praise from reviewers and bloggers.

Available in PDF, EPUB and Kindle. Book excerpt: A WIRED 2020 Book of the Year Object Lessons is a series of short, beautifully designed books about the hidden lives of ordinary things. "Nothing's bulletproof," the salesman said. "The thing's only bullet resistant." The New York Times journalist Kenneth R. Rosen had just purchased his first bulletproof vest and was headed off on assignment. He was travelling into Mosul, Iraq, when he realized that the idea of a bulletproof vest is more effective than the vest itself. From its very inception, poly-paraphenylene terephthalamide, or Kevlar, was meant for tires. Its humble roots and mundane applications are often lost, as it is now synonymous with body armor, war zones, and domestic terrorism. What Rosen learned through intimate use of his vest was that it acts as a metaphor for all the precautions we take toward digital, physical, and social security. Bulletproof Vest is at once an introspective journey into the properties and precisions of a bulletproof vest on a molecular level and on the world stage. It's also an ode to living precariously, an open letter that defends the notion that life is worth the risk. A portion of the author's proceeds will be donated to RISC, a nonprofit that provides emergency medical training to freelance conflict journalists. For more information, go to www.risctraining.org. Object Lessons is published in partnership with an essay series in The Atlantic.

Available in PDF, EPUB and Kindle. Book excerpt: While there are many books on "how to patent" and patent law, Essentials of Patents delivers practical advice on how to leverage patents as a powerful competitive corporate tool. This is not your "ordinary patent book". It's emphasis is directed to patent management with the express emphasis of increasing shareholder value, and it's audience, each with its own chapter, includes the CEO / ICO, CFO, CTO, and cross functional managers of HR, Engineering, Manufacturing and IT. Essentials of Patents is arguably one of the first works on intellectual property that drives home the importance of patent creation, protection and exploitation throughout the enterprise. Gibbs and DeMatteis show how patents can enhance competitive intelligence, product development cost reduction, product line expansion, and revenue streams, making this guide a must-have for the savvy manager. In it, the authors introduce a new management methodology: Patent Quality Management, or "PQM". With public company market values more than 90% attributable to the value of intangible assets and patents, the time has come for all corporate managers, not just R&D and legal counsel, to master intellectual property management in this competitive global market (and shareholders are demanding it).
