Available in PDF, EPUB and Kindle. Book excerpt: William Blackstone's Commentaries on the Laws of England (1765-69) is perhaps the most elegant and influential legal text in the history of the common law. By one estimate, Blackstone has been cited well over 10,000 times in American judicial opinions alone. Prominent in recent reassessment of Blackstone and his works, Wilfrid Prest also convened the Adelaide symposia which have now generated two collections of essays: Blackstone and his Commentaries: Biography, Law, History (2009), and Re-Interpreting Blackstone's Commentaries: A Seminal Text in National and International Contexts (2014). This third collection focuses on Blackstone's critics and detractors. Leading scholars examine the initial reception of the Commentaries in the context of debates over law, religion and politics in eighteenth-century Britain and Ireland. Having shown Blackstone's volumes to be a contested work of the Enlightenment, the remaining chapters assess critical responses to Blackstone on family law, the status of women and legal education in Britain and America. While Blackstone and his Commentaries have been widely lauded and memorialised in marble, this volume highlights the extent to which they have also attracted censure, controversy and disparagement.

Book excerpt: Charlotte Bronte meets Agatha Christie in this wonderful historical adventure novel set in the 18th century about a penniless but clever young teacher who becomes embroiled in a plot involving spies, smugglers, a pair of identical watches, puzzles, codes, an inheritance, and a very real danger to not only the heroine, but to England. It is 1795, and Mary Finch sets off to meet her wealthy uncle, hoping to heal a bitter family estrangement and perhaps to avoid a dismal career teaching at Mrs. Bunbury's school for young ladies. Eager for an adventure, she is soon embroiled in one of frightening proportions, for war is raging across Europe, England faces the threat of invasion, and some secrets are more valuable than gold. As she uncovers a complex and deadly plot involving ruthless smugglers, secret codes, and a dangerous network of spies and traitors, Mary must learn quickly whom she can trust. The apparently stalwart Captain Holland? The dangerous yet attractive Mr. Déprez? Perhaps the mysterious Hicks or even Mrs. Tipton, who knows what is best for everyone, especially Mary? The price of failure may be her life and the safety of all England.

Available in PDF, EPUB and Kindle. Book excerpt: Throughout the world, divisive monuments, ceremonies, and processions assert and reinforce claims to territory, legitimacy, and dominance. These contested symbols and rituals strengthen and lend meaning to communal boundaries; confer and renew identities; and inflame tensions between groups, polarizing communities and, at times, triggering violence. In Contentious Rituals, Jonathan S. Blake focuses on one such controversial tradition: Protestant parades in the streets of Northern Ireland. Marchers say they are celebrating their culture and commemorating their history, as they have done for two centuries. Catholics see the parades as carnivals of bigotry and strident assertions of power. The result is heightened inter-communal friction and occasional violence. Drawing on over 80 interviews, an original survey, and ethnographic observations, Blake investigates why participants choose to march in parades that are known to be a primary source of sectarian conflict today. His analysis reveals their reasons for acting, the meanings supplied to them, and how they make sense of the contention that surrounds them. Ultimately, he discovers, many paraders are not interested in the politics of their actions at all, but rather in the allure of the action itself: the satisfactions of joining with others to express a collective identity and carry on a cherished tradition. An insightful exploration of the characteristics and dynamics of nationalism in action, Contentious Rituals offers an innovative approach to the contested politics of culture in divided societies and a new explanation for an old source of conflict in Northern Ireland.

Book excerpt: The Esoteric Order of The Golden Dawn was a school of magic, founded during the late nineteenth century, one vowing to reveal all manner of occult knowledge to its members. Celebrated among these were Florence Farr, W.B Yeats, Charles Williams, A.E. Waite and Pamela Colman-Smith. Its figurehead, the autocratic Samuel MacGregor Mathers, inaugurated ceremonies that melded Christian Mysticism, the Qabalah and Hermeticism. Such a potent brew would eventually ensure that the Golden Dawn would burst asunder in an esoteric apocalypse.

Book excerpt: A fascinating account of how the law determines or dismantles identity and personhood Abused dogs, prisoners tortured in Guantánamo and supermax facilities, or slaves killed by the state—all are deprived of personhood through legal acts. Such deprivations have recurred throughout history, and the law sustains these terrors and banishments even as it upholds the civil order. Examining such troubling cases, The Law Is a White Dog tackles key societal questions: How does the law construct our identities? How do its rules and sanctions make or unmake persons? And how do the supposedly rational claims of the law define marginal entities, both natural and supernatural, including ghosts, dogs, slaves, terrorist suspects, and felons? Reading the language, allusions, and symbols of legal discourse, and bridging distinctions between the human and nonhuman, Colin Dayan looks at how the law disfigures individuals and animals, and how slavery, punishment, and torture create unforeseen effects in our daily lives. Moving seamlessly across genres and disciplines, Dayan considers legal practices and spiritual beliefs from medieval England, the North American colonies, and the Caribbean that have survived in our legal discourse, and she explores the civil deaths of felons and slaves through lawful repression. Tracing the legacy of slavery in the United States in the structures of the contemporary American prison system and in the administrative detention of ghostly supermax facilities, she also demonstrates how contemporary jurisprudence regarding cruel and unusual punishment prepared the way for abuses in Abu Ghraib and Guantánamo. Using conventional historical and legal sources to answer unconventional questions, The Law Is a White Dog illuminates stark truths about civil society's ability to marginalize, exclude, and dehumanize.

With Notes of Reference to the Constitution and Laws, of the Federal Government of the United States, and of the Commonwealth of Virginia. In Five Volumes, with an Appendix to Each volume, Containing Short Tracts upon Such Subjects As Appeared Necessary to Form a Connected View of the Laws of Virginia As a Member of the Federal Union. Philadelphia: William Young Birch and Abraham Small, 1803. Five volumes. Reprinted 1996 by The Lawbook Exchange, Ltd. With a New Critical Introduction by Paul Finkelman and David Cobin. LCCN 96-12566. ISBN 1-886363-15-3. Cloth. $450. * The first extended treatment of the subject, Tucker's Blackstone is a key resource for understanding how Americans viewed English common law in the years following the adoption of the Constitution and the Bill of Rights. Based on his lectures at the College of William and Mary, Tucker interprets Blackstone's often antidemocratic viewpoint in the American context. A strong proponent of the First Amendment, he elaborates a theory of freedom of speech and press that is more expansive than in the English tradition. "Tucker's Blackstone became a standard reference work for many American lawyers unable to consult a law library, especially those on the frontier. It is impossible to measure its impact on American law, but it is clear that sales were strongest in Virginia, as could be expected; it was also widely used in Pennsylvania and South Carolina." Bryson, The Virginia Law Reporter Before 1800 102. Tucker's Blackstone has been cited in numerous cases by the U.S. Supreme Court in an attempt to discern the original intent of the Constitution. Eller, The William Blackstone Collection in the Yale Law Library 87. Sabin, A Dictionary of Books relating to America 5696. Cohen, Bibliography of Early American Law 5318. A monumental work of continuing relevance, this reprint edition is prefaced by a new critical introduction by Professors Paul Finkelman and David Cobin.

Book excerpt: Colin Ruthven grew up in Vancouver’s lively West End in the years during and following World War II. He shares stories that are humorously light and others that are stirringly dark, including what it was like growing up with a father who spent the war battling his own demons. His Aunt Helen, who served as a dietician in the Royal Canadian Army, would tell him how she nursed concentration camp survivors back to health after liberation. The author deftly ties in stories highlighting his boyhood comradery with fellow “enders” with more serious moments from adolescence, leading up to his dramatic departure from Canada at age nineteen. Ruthven, a dual citizen of Canada and the United States of America, would go on to spend several decades in America, serving as a Marine fighter pilot in the Vietnam War and retiring as a lieutenant colonel before enjoying a second career as an award-winning illustrator.

Book excerpt: "Oscar G. Chase studies the American legal system in the manner of an anthropologist. By comparing American 'dispute ways' with those of other systems, including some commonly believed to be more 'primitive, ' he finds interesting similarities that challenge the premise that we live in a society regulated by a rational and just 'rule of law.'" --New York Law Journal"A witty and engaging endeavor. . . . A good contribution to our professional knowledge, and it is a must reading." --Law and Politics Book Review"After reading Law, Culture, and Ritual, no one could ever again think that our legal proceedings are nothing more than an efficient method of discovering truth and applying law. Oscar Chase effectively uses a comparative approach to help us to step back from our legal practices and see just how steeped in myths, rituals and traditions they are. Scholars will want to read this book for its contribution to comparative law, but everyone interested in American culture should read this book. Chase shows us that there is no separating law from culture: each informs and maintains the other. Law, Culture, and Ritual is a major step forward in the rapidly expanding field of the cultural study of law." --Paul Kahn, author of The Cultural Study of Law: Reconstructing Legal Scholarship"Having allowed ourselves to be convinced (wrongly) that we are the most litigious people in the world, Americans have become obsessed with finding (quick) cures. Oscar Chase's book sounds a salutary warning. By presenting striking comparative examples that shatter our parochialism, he forces us to examine the cultural roots of dispute processes." --Richard Abel, Connell Professor of Law, UCLA LawSchoolDisputing systems are products of the societies in which they operate - they originate and mutate in respons
