Book excerpt: In the lead essay for this volume, Joshua Foa Dienstag engages in a critical encounter with the work of Stanley Cavell on cinema, focusing skeptical attention on the claims made for the contribution of cinema to the ethical character of democratic life. In this debate, Dienstag mirrors the celebrated dialogue between Rousseau and Jean D'Alembert on theatre, casting Cavell as D'Alembert in his view that we can learn to become better citizens and better people by observing a staged representation of human life, with Dienstag arguing, with Rousseau, that this misunderstands the relationship between original and copy, even more so in the medium of film than in the medium of theatre. Dienstag's provocative and stylish essay is debated by an exceptional group of interlocutors comprising Clare Woodford, Tracy B. Strong, Margaret Kohn, Davide Panagia and Thomas Dumm. The volume closes with a robust response from Dienstag to his critics.

Available in PDF, EPUB and Kindle. Book excerpt: This is a book on the interrelationship of the EU legal order and the Cyprus issue. The book addresses a question which is of great significance for the legal order of the EU (as well as for Cypriots, Turks and Greeks), namely how the Union deals with the de facto division of the island. Despite the partial normalisation of relations between the two ethno-religious groups on the island, Cyprus' accession to the EU has not led to its reunification, nor to the restoration of human rights, nor a complete end to the political and economic isolation of the Turkish Cypriot community. Ironically enough, the accession of the island to the EU actually added a new dimension to the division of the island. According to Protocol 10 on Cyprus to the Act of Accession 2003, the Republic of Cyprus joined the Union with its entire territory. However, due to the fact that its Government cannot exercise effective control over the whole island, pending a settlement, the application of the acquis is 'suspended in those areas of the Republic of Cyprus in which the Government of the Republic of Cyprus does not have effective control.' Given this unprecedented (for an EU Member State) situation of not controlling part of its territory, the book analyses the limits of the suspension of the Union acquis in the areas north of the Green Line. In other words, the telos of this particularly challenging research is to map the partial application of Union law in an area where there are two competing claims of authority.

He discusses the competing legal arguments concerning the application of the Republic of Cyprus to join the European Union, the controversial decisions of the European Court & Commission of Human Rights & the debates regarding the status of the occupied northern part of Cyprus. His conclusion is that the Republic of Cyprus has had a continuous existence as a State--and as the only State on the island of Cyprus-since 1960, notwithstanding all of the violations of international law to which it has been subjected.' Book excerpt: The Europeanisation of Contested Statehood: The EU in northern Cyprus acts as a case study of the impact of the EU on institutions, political parties and civil society in 'contested states’, self-declared states which remain unrecognised in world politics. Research drawn from qualitative analysis of official documents, public discourse and interviews with various officials and political and social elites within the EU and at a local level provides new insights as to the impact of the EU on northern Cyprus as well as a fresh understanding of the relevance of the EU to contested states in general. By doing so, the book reflects on what contested statehood means for Europeanisation and lays out a conceptual template for the study of contested states of the wider European periphery.

Available in PDF, EPUB and Kindle. Book excerpt: Since Britain's occupation of Cyprus in 1878 and the fall of the Ottoman Empire after the First World War, ethnic rivalry has dominated the island's divided history. This comprehensive collection of documentary evidence and archival sources offers an enlightening insight into the troubled political conflict of the island and seeks to illuminate the contested debate. "The Cyprus Issue" brings together material which scrutinises relations between Cyprus and Europe over the last twenty years, exploring the impact of international and constitutional law on the dispute. Paying particular attention to judgements delivered by the European Court of Justice and the European Court of Human Rights, this volume sets out the legal and political documents which inform the discourse on the subject. Arguing that a wide range of interest groups will need greater access to legal and political documentation if Cyprus is to integrate itself fully into an ever broadening European Union, this book above all provides an essential resource for scholars and researchers seeking primary source data on contemporary Cyprus.

Available in PDF, EPUB and Kindle. Book excerpt: The volume explores the marked differences between the complex and rapidly changing legal organization of EU external relations and the EU's 'internal' constitutional order. The European Union is unique as a polity organized along federal lines but with fully fledged States as its component political entities. The tension between the self-conscious Member States and their constitutional relationship within the EU is especially pronounced in the foreign policy field, where they remain determined to assert their status as full subjects of the international order. This book explores how foreign policy fits within the constitutional structure of the EU, characterized by the division of external relations competences between the EU and the Member States ('the vertical axis'), and between the 'pillars' of which the Union is composed, in particular the division between the Community competences of the first pillar and the common foreign and security competences of the second pillar ('the horizontal axis'). This is a study of the extent to which foreign policy is legally sui generis within the sui generis constitutional order of the EU, and of how the common foreign and security policy is in turn sui generis within the foreign policy structure of the Union. It provides both an exploration of the constitutional reality of EU foreign policy and theoretical analysis which suggests possibilities for reform.

Available in PDF, EPUB and Kindle. Book excerpt: The harmonization of the different European legal systems has reached the field of asylum and immigration policy. The Maastricht Treaty has established the legal basis for a common migration policy. Numerous resolutions, recommendations, joint positions and actions were adopted by the EU Council based on the `third pillar' in the Maastricht Treaty. Within the `first pillar' the European Community has enacted regulations on visa policy based on Art. 100c EC - Treaty. Additionally, several agreements with third countries on immigration issues were set into force. Immigration and Asylum Law and Policy of the European Union comprehensively describes the present state of the harmonization process concerning migration policy in the European Union. Particular emphasis is laid on the legal status of third-country nationals with regard to entry and residence. Furthermore, the gaps within EU regulations are evaluated in an attempt to search for a homogenous European migration policy.

This Handbook provides a comprehensive and advanced analysis of EU criminal law as a structurally and constitutionally unique policy area and field of research. With contributions from leading experts, focusing on their respective fields of research, the book is preoccupied with defining cross-border or ‘Euro-crimes’, while allowing Member States to sanction criminal behaviour through mutual cooperation. It contains a web of institutions, agencies and external liaisons, which ensure the protection of EU citizens from serious crime, while protecting the fundamental rights of suspects and criminals. Students and scholars of EU criminal law will benefit from the comprehensive research present in this Handbook. National and EU policy-makers, as well as judges, defence lawyers and human rights lawyers will find the analysis of current legal action, combined with proposed solutions, useful to their work
