The investigation focuses on the relationship between international decision-making procedures, in particular compulsory third party dispute settlement, and legitimacy and integrity as perceived by states and other international actors. It starts with a description of recent developments with regard to dispute settlement in the law of the sea, GATT/WTO, Antarctica, and global environmental protection. Compulsory third-party dispute settlement has been accepted in treaty regimes in these fields as it is indispensable in safeguarding the legitimacy and integrity of such regimes. The focus then shifts to an extensive analysis of changes in the international community in general, and their consequences for the international legal system. By focusing on legitimacy and integrity, and by providing a theoretical framework in which these concepts can be applied, this book contributes significantly to the discussion of the theoretical foundations of international law. The author is winner of the 1995 Award of the Foundation Praemium Erasmianum, Amsterdam.

Book excerpt: This book turns conventional global-historical analysis on its head, demonstrating, first, that local events cannot be derived — logically or historically — from large-scale, global-historical structures and processes and, second, that it is these structures and processes that, in fact, emerge from our analysis of local events. This is made evident via an analysis of three disparate events: the New York City Draft Riots, AIDS in Mozambique, and a 2007 flood in central Uruguay. In each case, Baronov chronicles how expressions of human agency at the level of those caught up in each event give form and substance to various abstract global-historical concepts — such as slavery in the Americas, global capitalist production, and colonial/postcolonial Africa. Underlying this repositioning of the local and the ephemeral is an immanent, phenomenological analysis that illustrates how mere transient events are the progenitors of otherwise abstract, global-historical concepts. Traversing the intersections of human agency and structural determinism, Baronov deftly retains the nuance and serendipity of everyday life, while deploying this nuance and serendipity to further embellish our understanding of those enduring global-historical structures and processes that shape large-scale, long-term, historical accounts of social and cultural change across the historical social sciences.

It provides an overview of Ireland's social and economic policy from independence to the present day but also employs a comparative context in order to identify the nature of Irish economy and society. It concludes that Ireland has not benefited from economic growth to the same degree as other small open economies in Europe. The book assesses a number of possible explanations for this situation, including colonialism, neo-colonialism and under development. The author contends, however, that none of these models offer a satisfactory explanation of the reality of modern Ireland. The majority of the work focuses on the industrialized countries, which are at the center of the international trading system, determining which are very active importers and which are not. Controls for wealth, size, and membership in customs areas are included. Countries importing at levels below predicted ones are the countries likely to be most effective at protecting domestic industries from foreign competition. For example, the results permit an evaluation of the arguments that Japan has consistently imported less than would be expected due to the presence of barriers protecting the domestic market.
