Book excerpt: The Government has laid a draft Order in Council to extend the powers under sections 21 to 23 of the Anti-terrorism, Crime and Security Act 2001, to detain indefinitely without trial certain foreign nationals who are reasonably suspected to have links to international terrorism and who can not be removed from the UK for legal or practical reasons. The Committee has examined the human rights implications of this extension and reports that it considers the safeguards to be sufficiently reliable to warrant the Government's decision to seek Parliament's approval for the extension of the powers. The Committee draws attention to certain improvements that are needed in the operation of this power.

Available in PDF, EPUB and Kindle. Book excerpt: In recent years, sunset clauses have mostly been associated with emergency legislation introduced in the wake of terrorist attacks. However, as this book demonstrates, they have a long history and a substantial constitutional impact on the separation of powers and the rule of law. In addition, the constitutional value of such clauses is examined from certain neglected normative aspects pertaining to concepts such as deliberative and consensus democracy, parliamentary sovereignty and constitutional dialogue. The work is an amalgam of three perspectives: the historical, the positive and the normative. All three are intertwined and each subsequent part builds upon the findings of the previous one. The historical perspective investigates the historical development of sunset clauses since the first Parliaments in England. The positive perspective examines the legal effect and the contemporary utility of sunset clauses. Finally, the normative perspective analyses their interaction with several models of separation of powers, and their influence on the dialogue between various institutions as it values their impact on the rule of law, formal and substantive. The detailed examination of this topical subject will be a valuable resource for academics, researchers and policy makers.

Available in PDF, EPUB and Kindle. Book excerpt: This book focuses on a specific component of the normative dimension of law, namely, the normative claim of law. By 'normative claim' we mean the claim that inherent in the law is an ability to guide action by generating practical reasons having a special status. The thesis that law lays the normative claim has become a subject of controversy: it has its defenders, as well as many scholars of different orientations who have acknowledged the normative claim of law without making a point of defending it head-on. It has also come under attack from other contemporary legal theorists, and around the normative claim a lively debate has sprung up. This debate makes up the main subject of this book, which is in essence an attempt to account for the normative claim and see how its recognition moulds our understanding of the law itself. This involves (a) specifying the exact content, boundaries, quality, and essential traits of the normative claim, (b) explaining how the law can make a claim so specified, and (c) justifying why this should happen in the first place. The argument is set out in two stages, corresponding to the two parts in which the book is divided. In the first part, the author introduces and discusses the meaning, status, and fundamental traits of the normative claim of law; in the second he explores some foundational questions and determines the grounds of the normative claim of law by framing an account that elaborates on some contemporary discussions of Kant's conception of humanity as the source of the normativity of practical reason.

This book was released on 2003-12-18 with total page 121 pages. Available in PDF, EPUB and Kindle. Book excerpt: This independent report by the Privy Counsellor Review Committee reviews the Anti-terrorism, Crime and Security Act 2001 (December 2001, c. 24; ISBN 0105424013), emergency legislation passed in response to the international terrorist threat highlighted by the events of 11 September 2001. The Committee's conclusions are based on two key principles of an individual's right to liberty and privacy; and the need for public protection from terrorism. Conclusions drawn include that special counter-terrorism legislation should be kept distinct from general crime and security laws, and the provisions of the Act which are not specifically targeted at terrorism should be reconsidered. In particular, the powers allowing foreign nationals to be detained potentially indefinitely should be replaced as a matter of urgency. Measures related to tackling the financing of terrorism and targeting those who withhold information about terrorist offences are welcomed, but there is a need for better safeguards in some cases. Security arrangements regarding weapons of mass destruction need to be enhanced. The provisions relating to identify theft are inadequate, and powers to amend any provision without primary legislation should be repealed.

Book excerpt: The Joint Committee's report considers the human rights implications of Part 4 of the Anti-terrorism, Crime and Security Act 2001, which required a UK derogation from the right to personal liberty under the European Convention on Human Rights (ECHR) regarding exceptional powers to allow the indefinite detention without charge of suspected international terrorists who are not UK nationals and cannot be removed from the country. Conclusions drawn include: i) there are serious weaknesses in human rights protection under the detention provisions of Part 4 of the Act and a more satisfactory legal framework is urgently required which fully complies with the ECHR; ii) there is a significant risk that the powers under Part 4 violate the right to be free of discrimination under ECHR Article 14 because they have a particular impact on only one part of the resident community of the UK on grounds of nationality; and iii) the Committee continues to doubt whether the derogation is justified on grounds of national emergency, and is not persuaded that it is appropriate to renew Part 4 when there is no time limit specified.

Available in PDF, EPUB and Kindle. Book excerpt: Now more than ever, policy evaluation is an important component in addressing the world's economic crisis. Before it can do so, the discipline must adapt to changing economic and political environments. The contributors address a basic question: What impact do crises have on evaluation and how can evaluation contribute in times of turbulence? Examining the state of evaluation today, the volume's editors cover a broad range of topics, including post-hoc evaluation; shifting economic paradigms; the World Bank Group's response to the global economic crisis; challenges in evaluating financial literacy; evaluating counter-terrorism programs; evaluation in the context of humanitarian crises; and why civil society organizations in sub-Saharan Africa matter in evaluating poverty interventions. The contributors explore the role of evaluation in the search for solutions to global instability. They recognize, however, that in order to address unprecedented crises, evaluation itself needs to be evaluated and updated as part of the process of change and reform. This volume is the latest in Transaction's well-respected Comparative Policy Evaluation series.
