It addresses all the skills that are integral to the modern lawyer's practice. The text introduces students to the theory underpinning these skills and is supported by reflective exercises and examples from practice. Importantly, the methodology employed allows students to continue their learning beyond the law school. Each chapter contains a clear statement of learning outcomes and the text is interspersed with questions and exercises designed to encourage and facilitate learning. Chapter summaries, tables, flowcharts, and practical examples are also used extensively throughout. The text places skills in the context of the general ethical and client care principles which govern modern legal practice. This guide is essential reading for all students and a useful reference for practitioners.

Available in PDF, EPUB and Kindle. Book excerpt: Law students rarely have experience answering problem questions before university, and lecturers concentrate on teaching content rather than the exam skills needed. This book bridges the gap on how to transpose knowledge and research into structured and coherent answers to problem questions while earning a law degree. Aimed at undergraduates, international students, and foundation and SQE candidates, the book gives a step-by-step study guide on how to navigate what a problem question is asking you to do. It deconstructs the process using examples from a range of different fields of law, providing essential guidance from research and critical thinking to style and tone. Including a range of examples to test yourself against, this is an indispensable resource for any law student who wants to tackle problem questions with confidence.

Book excerpt: The European Convention on Human Rights has evolved into a sophisticated legal system, whose formal reach into the domestic law and politics of the Contracting States is limited only by the ever-widening scope of the Convention itself, as determined by a transnational court. In this book, a team of distinguished scholars trace and evaluate, comparatively, the impact of the ECHR and the European Court of Human Rights on law and politics in eighteen national systems: Ireland-UK; France-Germany, Italy-Spain, Belgium-Netherlands, Norway-Sweden, Greece-Turkey, Russia-Ukraine, Poland-Slovakia, and Austria-Switzerland. Although the Court's jurisprudence has provoked significant structural, procedural, and policy innovation in every State examined, its impact varies widely across States and legal domains. The book charts this variation and seeks to explain it. Across Europe, national officials - in governments, legislatures, and judiciaries - have chosen to incorporate the ECHR into domestic law, and they have developed a host of mechanisms designed to adapt the national legal system to the ECHR as it evolves. But how and why State actors have done so varies in important ways, and these differences heavily determine the relative status and effectiveness of Convention rights in national systems. Although problems persist, the book shows that national officials are, gradually but inexorably, being socialized into a Europe of rights, a unique transnational legal space now developing its own logics of political and juridical legitimacy.

Available in PDF, EPUB and Kindle. Book excerpt: As a critical, in-depth analysis of the law-making process, this book has no equal. It deals with all the stages and forms of law-making: - the preparation of legislation; - its passage through Parliament; - statutory interpretation; - the operation of the rules of precedent in judicial decision-making; - the many facets of judicial law-making; - the machinery of law reform. The new eighth edition covers the operation of EU law in the UK after Brexit. It also covers pre-Brexit events such as the unprecedented legislation by backbench MPs to stop a No Deal Exit from the EU and the two great Supreme Court decisions over the triggering of Brexit and the prorogation of Parliament. The books draws on a wide range of sources including important new empirical research such as Lord Sumption's 2019 Reith lectures (Trials of the State – Law and the Decline of Politics) and the work of Sir Geoffrey Palmer, former Prime Minister and Justice Minister of New Zealand on The Law Reform Enterprise. There are new sections on the attempt to control the size of the House of Lords, on whether Parliament should have a role in the selection of senior judges and on the topical question whether decisions of the courts on constitutional questions are 'legal' or 'political'.
