The changes are complex and the terms used to describe them often obscure the reality. In Freer Markets, More Rules, Steven K. Vogel dispenses with euphemisms and makes sense of this recent transformation. In defiance of conventional wisdom, Vogel contends that the deregulation revolution of the 1980s and 1990s never happened. The advanced industrial countries moved toward liberalization or freer markets at the same time that they imposed reregulation or more rules. Moreover, the countries involved did not converge in regulatory practice but combined liberalization and reregulation in markedly different ways. The state itself, far more than private interest groups, drove the process of regulatory reform. Thus, the story of deregulation is one rich in paradox: a movement aimed at reducing regulation increased it; a movement propelled by global forces reinforced national differences; and a movement that purported to reduce state power was led by the state itself. Vogel's astute and far-reaching analysis compares deregulation in Britain and Japan, with special attention to the telecommunication and financial services industries. He also considers such important sectors as broadcasting, transportation, and utilities in the United States, France, and Germany.

Book excerpt: Pursuant to a congressional request, GAO provided information on the major rules submitted to Congress during the first 2 years that the congressional review provisions in the Small Business Regulatory Enforcement Fairness Act (SBREFA) were in effect, focusing on: (1) how many major rules were issued during this period; (2) which agencies issued the rules; (3) how many of the rules had notices of proposed rulemaking; and (4) which regulatory statutes and executive orders the agencies commonly cite in the reports that SBREFA requires the agencies to submit. GAO noted that: (1) federal agencies sent GAO 122 rules that they and the Office of Information and Regulatory Affairs said were major during the first 2 years that SBREFA's congressional review provisions were in effect; (2) most of these rules were issued by four executive departments and agencies and two independent regulatory agencies; (3) the rules varied substantially in terms of whether they had notices of proposed rulemaking and the time elapsed between final rulemaking an any proposed rules; (4) the agencies indicated that the rules also varied regarding the applicability of certain statutory and executive order rule-making requirements; and (5) on several occasions, federal agencies did not delay the effective dates of their major rules for the required 60 days to allow time for congressional review.

In Regulatory Politics in Transition, Marc Eisner argues that to understand fully the importance of regulatory policy we need to survey the critical policy shifts brought about during the Progressive period, the New Deal, and the contemporary period. Eisner adopts a regulatory regime framework to address the combination of policy change and institutional innovation in each period. The Progressive period, Eisner explains, saw the creation of a market regime in which new policies were created to preserve markets or create marketlike results. The New Deal brought an associational regime, one in which power was vested in economic associations that were integrated into a regulatory system designed to promote stability. The late 1960s and early 1970s brought a new societal regime, in which policies addressed the social consequences of economic activities in the areas of environmental protection and occupational health. But it was displaced by the efficiency regime, a response to the poor economic performance of the 1970s and the growing faith in the market as an alternative to regulatory policies. For each of these periods Eisner examines economic-structural changes and the prevailing political-economic and administrative theories that conditioned the design of new policies and institutions. Throughout, Eisner adds a valuable historical dimension to the discussion of regulation by showing how policies and institutions were shaped by particular historical and political circumstances.

Providing the first major alternative to conventional arguments grounded in public choice theory, it demonstrates that regulatory government can, and on important occasions does, advance general interests. Unlike previous accounts, Regulation and Public Interests takes agencies' decision-making rules rather than legislative incentives as a central determinant of regulatory outcomes. Drawing from both political science and law, Steven Croley argues that such rules, together with agencies' larger decision-making environments, enhance agency autonomy.
