Available in PDF, EPUB and Kindle. Book excerpt: Although likely a small percentage of all people screened, the thousands of persons misidentified to the Terrorist Watch List can experience additional questioning, delays, and other effects. Most misidentifications occur because of similarities to names on the Terrorist Watch List; agencies are attempting to reduce the incidence of misidentifications or otherwise facilitate individuals through the screening process. The Terrorist Screening Center and Frontline-screening Agencies are addressing concerns related to Watch List Screening, and an Interagency Agreement is being developed to further ensure an effective means for seeking redress.

Book excerpt: Terrorism, sadly, seems here to stay and to stay with a vengeance. It turns out that the United States was not prepared for it and now must play catch-up. In doing so, even agreement on how to define terrorism is in doubt and what to do about it seems beyond comprehension at the moment. This volume presents a broad cross section of analyses of weaknesses and actions in the ongoing battle including cyberterrorism, international terrorism, and societal implications of terrorism.

Available in PDF, EPUB and Kindle. Book excerpt: For over sixty million Americans, possessing a criminal record overshadows everything else about their public identity. A rap sheet, or even a court appearance or background report that reveals a run-in with the law, can have fateful consequences for a person’s interactions with just about everyone else. The Eternal Criminal Record makes transparent a pervasive system of police databases and identity screening that has become a routine feature of American life. The United States is unique in making criminal information easy to obtain by employers, landlords, neighbors, even cyberstalkers. Its nationally integrated rap-sheet system is second to none as an effective law enforcement tool, but it has also facilitated the transfer of ever more sensitive information into the public domain. While there are good reasons for a person’s criminal past to be public knowledge, records of arrests that fail to result in convictions are of questionable benefit. Simply by placing someone under arrest, a police officer has the power to tag a person with a legal history that effectively incriminates him or her for life. In James Jacobs’s view, law-abiding citizens have a right to know when individuals in their community or workplace represent a potential threat. But convicted persons have rights, too. Jacobs closely examines the problems created by erroneous record keeping, critiques the way the records of individuals who go years without a new conviction are expunged, and proposes strategies for eliminating discrimination based on criminal history, such as certifying the records of those who have demonstrated their rehabilitation.

Book excerpt: Digital Culture & Society is a refereed, international journal, fostering discussion about the ways in which digital technologies, platforms and applications reconfigure daily lives and practices. It offers a forum for inquiries into digital media theory, methodologies, and socio-technological developments. This issue presents empirical studies as well as theoretical and methodological reflections on inequalities and divides in digital cultures. From various (inter-)disciplinary perspectives, the authors examine three main themes - inequality of access, inequality by design and discursive divides, and inequality by algorithms - while suggesting ways for research to move beyond these.

Available in PDF, EPUB and Kindle. Book excerpt: Since the entry into force of the Lisbon Treaty, data protection has been elevated to the status of a fundamental right in the European Union and is now enshrined in the EU Charter of Fundamental Rights alongside the right to privacy. This timely book investigates the normative significance of data protection as a fundamental right in the EU. The first part of the book examines the scope, the content and the capabilities of data protection as a fundamental right to resolve problems and to provide for an effective protection. It discusses the current approaches to this right in the legal scholarship and the case-law and identifies the limitations that prevent it from having an added value of its own. It suggests a theory of data protection that reconstructs the understanding of this right and could guide courts and legislators on data protection issues. The second part of the book goes on to empirically test the reconstructed right to data protection in four case-studies of counter-terrorism surveillance: communications metadata, travel data, financial data and Internet data surveillance. The book will be of interest to academics, students, policy-makers and practitioners in EU law, privacy, data protection, counter-terrorism and human rights law.

Different laws regulate each type of professional, but boundaries have blurred. This report examines current business practices and investor understanding of each type.

Book excerpt: One of the questions in the fight against terrorism is whether the United States needs a counterterrorism domestic intelligence agency separate from law enforcement. Drawing on an analysis of current counterterrorism efforts, an examination the domestic intelligence agencies in six other democracies, and interviews with intelligence and law enforcement experts, this volume lays out the relevant considerations for creating such an agency.
