A ainda majoritária teoria segundo a qual cabe ao direito penal a proteção de bens jurídicos dá mostras de que seu potencial se esgotou. A rigor, como busca demonstrar este trabalho, a função de exclusiva proteção a bens jurídicos assinalada ao direito penal apresenta mais inconveniências do que vantagens: a tendência ao recrudescimento da intervenção penal, calcada no dever de maximização ou eficientização da tutela decorrente desta finalidade; a discricionariedade política do legislador; a seletividade da proteção; a dependência de constante comprovação empírica; a vagueza e obscuridade dos conceitos e a falta de um fundamento essencial. O presente estudo apresenta as principais contribuições acerca da teoria do bem jurídico e da recusa aos problemas acima identificados, reservando ao bem jurídico apenas a tarefa de ser objeto do delito e soma da lesividade, por meio de uma nova conceituação que não o confunde com um dado, um interesse ou valor, mas como uma categoria ligada à noção do sujeito dotado de autonomia. Para isto, o estudo procura o fundamento para o Direito Penal na consciência intencional husserliana e na filosofia dos valores, em grande parte de Scheler, à luz do valor absoluto da pessoa e de sua teoria sobre as formas e essência da simpatia. Neste sentido, em síntese, o Direito Penal se fundamenta no estado inescapável de coexistência entre sujeitos conscientes, dotados de autonomia e falíveis, competindo a este ramo do direito uma função declarativa (declarar as esferas do proibido e do permitido) e uma função atributiva de responsabilidade, mas não uma função protetiva de bens jurídicos. O bem jurídico, por seu turno, é definido como a possibilidade de o sujeito estabelecer uma relação com um objeto que lhe é de valor no mundo da vida.
