Book excerpt: The Ministry of Defence needs the capability to transport personnel, equipment and stores from the UK to operational theatres across the globe. This capability, known as Strategic Lift, can by delivered by sea, land or air, and its annual cost to the MoD is almost £800 million a year. The Committee's report examines the progress of the MoD in delivering the Strategic Lift requirements set out in the Strategic Defence Review and whether these requirements need to be revisited given the experience of the operations in Afghanistan and Iraq. Findings include that good progress has been made in improving strategic sea-lift, particularly in relation to Ro-Ro ships and the acquisition of Landing Platform Dock (Auxiliary) vessels. However, strategic air-lift is a particular concern given the age of many of the aircraft, and the report looks at the progress of two major equipment programmes designed to deliver new transport aircraft (the A400M transport aircraft) and new tanker aircraft (the Future Strategic Tanker Aircraft).

Available in PDF, EPUB and Kindle. Book excerpt: Marianne Wade and Almir Maljevi? Although the worries about terrorism paled in comparison to the economic crisis as a topic during the last US election, one can find plenty of grounds to assume that they remain issue number one in the minds of politicians in Europe. As the German houses of Parliament prepare to call in the mediation committee in the discussion of legislation which would provide the Federal Police – thus far mandated purely with the post-facto investigation of crime – with powers to act to prevent acts of terrorism, Spain’s struggle with ETA and the British Government licks its wounds after a resounding defeat of its latest anti-terrorist proposals by the House of Lords, one cannot but wonder whether post 9/11, the Europeans are not even more concerned with terrorism than their US counterparts. A look at media reports, legislative and judicial activities in either Britain or Germany clearly underlines that those two countries are deeply embroiled in anti-terrorist activity. Can it be that Europe is embroiled in the “War on Terror”; constantly providing for new arms in this conflict? Or is it a refusal to participate in the “War on Terror” that fuels a constant need for Parliaments to grapple with the subject; begrudgingly conceding one increasingly draconian measure after the other? The question as to where Europe stands in the “War on Terror” is a fascinating one, but one, which is difficult to answer.

Book excerpt: The ability of the Defence Equipment and Support organisation within the Ministry of Defence (MoD) to deliver the equipment programme is overshadowed by the existence of a funding gap which the NAO estimates could be as much as £36 billion over the next ten years. Both the National Audit Office "Major Projects Report 2009" (HC 85-I, session 2009-10, ISBN 9780102963342) and Bernard Gray's "Review of Acquisition" for the MoD have confirmed that the MoD's ten year equipment programme is unaffordable. Furthermore the MoD's practice of delaying projects so as to reduce costs in the early years of a programme is adding to overall procurement costs and so further increases the funding gap. The MoD has apparently made no attempt to calculate the full extent of the costs of delays and it has taken decisions to delay projects without understanding the full implications of those decisions. The report examines: progress on the many key programmes; defence research spending (declining from £540 million in 2007-08 to £471 million in 2009-10 and will decrease further in 2010-11 to £439 million); the response to and implementation of the Gray report; balancing the equipment programme and the use of regular Strategic Defence Reviews to maintain an up-to-date strategic context for the equipment programme; clarifying roles and accountabilities, including better leadership and decision-making; injecting key skills and tools into DE&S.

Book excerpt: On 28 June 2007, the Prime Minister announced changes to the machinery of Government that had an impact upon the select committee system within the House of Commons. As a result, the Science and Technology Select Committee will be dissolved and replaced by a new Innovation, Universities and Skills Select Committee at the beginning of the next session of Parliament. This Report explains the role that the Science and Technology Committee has played within Parliament and the science community. It outlines the Committee's innovations, its impact and concerns regarding future science scrutiny in the House of Commons. It concludes that, in the long term, a separate Science and Technology Committee is the only way to guarantee a permanent focus on science across Government within the select committee system and recommends that the House be given an opportunity to revisit this issue.

Book excerpt: On 23 March 2007 15 Royal Navy personnel from HMS Cornwall were captured by the Iranian Revolutionary Guard while conducting a boarding operation on a merchant vessel in shallow waters near the mouth of the Shatt al-Arab waterway, between Iraq and Iran. They were taken to Iran, paraded before the international media and detained until their release and return home on 5 April. On their return, the Royal Navy staged a press conference for some of the detainees: two of them subsequently sold their stories to the media. Lt General Sir Rob Fulton was appointed to inquire into the operational circumstances and factors leading to the capture of the Royal Navy personnel. His report was confidential and not published but the Defence Committee was allowed to see it to ensure Parliamentary scrutiny. The Committee reports that Fulton robustly identified serious weaknesses in intelligence, communications, doctrine and training. Whilst there were insufficient grounds for courts martial, formal administrative action has been taken against a number of Service personnel. The Government has made good progress towards implementing Fulton's recommendations. The Committee also considered the findings of the Hall report into media access to Service personnel (available at www.mod.uk). The decision to allow the Service personnel to sell their stories was a serious mistake and deeply damaging to the reputation of the Royal Navy. The Secretary of State for Defence has accepted responsibility and apologised. This should not absolve others from blame.

Book excerpt: In addition to the scrutiny of Bills and policy documents the Committee also examines other areas where there are concerns about human rights. In this report it looks at how the principles of human rights can be applied to older people in hospitals and care homes to ensure they are treated with greater dignity and respect. It looks first at the current position before covering: the leadership of the Department of Health; the implementation of the Human Rights Act by service providers; health and social care inspectorates and NICE; the role of staff in protecting human rights; and empowering older people. It finds that, although there are examples of excellent care, there are concerns about poor treatment, neglect, abuse, discrimination and ill-considered discharge. There is a significant difference between the "duty to provide" under care standards legislation and the "right to receive" under human rights legislation and the culture needs to change. The Committee recommends legislation and a role for the Commission for Equality and Human Rights. It also recommends measures to strengthen human rights obligations and duties, including better guidance and standards, and bringing private and voluntary care homes into the scope of the Human Rights Act.

Book excerpt: In its annual examination of the Department for Children, Schools and Families' (DCSF) spending, the Children, Schools and Families Committee predicts that future funding will be much tighter than at present and the rate of spending growth will be minimal come the next Spending Review. The Committee is pleased that the Government has reaffirmed its commitment to capital investment in education, but there is concern that the review of Building Schools for the Future will lead to the programme being curtailed. To avoid doubt, the Department should make a clear statement about the programme's future. The Committee identifies key problems with the presentation of expenditure figures in the report, including confusion about which expenditure streams or grants deliver which objectives, and calls on the Department to rectify these problems in its next Annual Report. To ensure real accountability, staging points must be included for long term Public Service Agreement (PSA) targets. In order to assess whether these targets have been met, it is imperative that DCSF does not revise them at every three-yearly spending review. The Committee is disappointed that details on how DCSF achieved its efficiency savings are vague and it expects much more of the promised detail in the 2009 Departmental Annual Report.

This book was released on 2010-02-24 with total page 172 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Committee's inquiry addresses concerns that the operation of libel laws and the impact of costs were stifling press freedom. It also considers the balance between personal privacy and press freedom, and the increasing use of injunctions and super-injunctions. It also examines press standards in the UK, particularly considering Madeleine McCann's disappearance, the suicides in and around Bridgend in 2008 and phone hacking and blagging. The Committee does not consider that it would be right to legislate on privacy. The Press Complaints Commission (PCC) should amend its Code to include a requirement that journalists notify the subject of their articles prior to publication, subject to a "public interest" test. The report also assesses the damage so called 'libel tourism' has caused to the UK's reputation as a country which protects free speech and freedom of expression. In cases where the UK is not the primary domicile or place of business of the claimant or defendant, the claimant should face additional hurdles before being allowed to bring a case. There is an urgent need to control defamation litigation costs more effectively. Competitive and commercial factors led to an inexcusable lowering of press standards in the gathering and publishing of 'news' about the McCann case, and self-regulation signally failed. The PCC should be renamed the Press Complaints and Standards Commission, reflecting its role as a regulator, not just a complaints handling service. The regulator should have the power to fine its members where it believes that the departure from the Code of Practice is serious enough to warrant a financial penalty.

Available in PDF, EPUB and Kindle. Book excerpt: Terrorist violence is no novelty in human history and, while government reactions to it have varied over time, some lessons can be learnt from the past. Indeed, the debate on when and how a state should use emergency powers that limit individual freedoms is nearly as old as the history of political thought. After reviewing some history of state responses to terrorist violence and their efficacy, this book sets out to assess the effects of contemporary counterterrorism law and policies on democratic states. In particular, it considers the interaction between national and international law in shaping and implementing anti-terror measures, and the difficult role of the judiciary in striking a balance between security concerns and fundamental rights. It also examines the strains this has caused on some democracies, especially a blurring in the separation of powers between the legislative, executive and judicial branches of government, giving reason to enquire afresh whether new paradigms are needed. Finally, the issue of whether the doctrine of constitutionalism can provide an appropriate frame of analysis to encapsulate current developments in international law in response to terrorism is broached. By drawing on the expertise of historians, political scientists and lawyers, this book promotes transdisciplinary dialogue, recognising that counterterrorism is an issue at the intersection of law and politics that has profound implications for democratic institutions and practices.
