Book excerpt: This document is concerned with human rights violations of refugees forcibly repatriated from the US to El Salvador. Deportation is justified by the Immigration and Naturalization Service on the grounds that no special danger exists for returnees as a result of their stay in the US. The American Civil Liberties Union (ACLU) argues that such a cause and effect relationship would be impossible to determine. It contests the deportations on the basis of information gathered concerning the lot of returned Salvadorians (lists of victims and their fates are included). In addition, the ACLU argues that irrespective of proven cases of rights violations, the US has the obligation of granting temporary asylum to Salvadorians fleeing hostilities in their country. The authors criticize a US embassy survey of returned persons used in support of repatriation policy. They analyse the methods employed and characterize the results obtained as unreliable and impressionistic. They point out that, while extremely difficult to procure, documentation concerning returned Salvadorians who disappeared or were killed does exist and has in seven cases been confirmed by the US State Department. The authors conclude that deportations should be temporarily stopped for four reasons: 1) hard information concerning returned persons is difficult to obtain or confirm; 2) evidence concerning human rights violations has nonetheless been established; 3) a State Department survey which has been used to defend repatriation is superficial and unreliable, and 4) the current situation within El Salvador is in itself sufficiently dangerous to justify the temporary suspension of deportations.
