Book excerpt: The Government presented its Post-legislative Scrutiny of the Serious Crime Act 2007 Memorandum to the Home Affairs Committee and Justice Committee in November 2012. The parts of the Memorandum falling within the Justice Committee's remit were a) Serious Crime Prevention Orders and b) Part 2, in particular, offences of encouraging or assisting crime in terms of prosecution and interpretation of the sections by courts and the CPS. There is concern about the trenchant criticism that Part 2 of the Serious Crime Act 2007 received. In addition, Part 2 was the subject of appeals to the Court of Appeal. The report concurs with the academics who wrote that the sections are complex and difficult to understand for lawyers, let alone for defendants, jurors and other lay-people working in the criminal justice system. It raises some key concerns and questions about the purpose of post-legislative scrutiny. It is considered that where the substance of an Act or part of an Act is to create or revise criminal offences it is appropriate for questions of a purely legal or technical nature to be considered. The latest judgment in the case of Sadique may allow the legislation to settle into accepted use and interpretation. However, the Ministry should conduct a further and full post-legislative assessment of Part 2 in 2016. If, in the meantime, the number of appeals on Part 2 increases, the Ministry should consider bringing forward legislative proposals for revising, or even replacing, Part 2 to meet the purpose of the legislation in a less tortuous fashion

Book excerpt: Mary Vipond's approach is based on the idea that the development of radio broadcasting was a process that involved equipment manufacturers, broadcasters, and "audiences/customers." She charts the expansion of these three groups, surveys the development of advertising and networking as methods of financing, and analyses the evolution of programming. From 1922 to 1932, radio administration was the responsibility of the Radio Branch of the federal Department of Marine and Fisheries. Vipond discusses the regulatory policies of the branch. She completes her study with an analysis of the period from the formation of the Aird Royal Commission on Radio Broadcasting in 1928 to the passage of the Radio Broadcasting Act of 1932. Between 1922 and 1932, virtually all Canadian broadcasting was in the private sector. The campaign in the early 1930s to institute a broadcasting system oriented more toward public service and the promotion of a national identity was partially successful. Vipond reveals, however, that the act that in 1932 set up the Canadian Radio Broadcasting Commission, now the CBC, was much weaker than has generally been recognized. She argues that this weakness was a consequence of the fact that, over the course of the 1920s, broadcasters, listeners, and politicians alike had built up certain expectations of radio which could not easily be disregarded.

Book excerpt: This is the Final Report of Canada's Truth and Reconciliation Commission and its six-year investigation of the residential school system for Aboriginal youth and the legacy of these schools. This report, the summary volume, includes the history of residential schools, the legacy of that school system, and the full text of the Commission's 94 recommendations for action to address that legacy. This report lays bare a part of Canada's history that until recently was little-known to most non-Aboriginal Canadians. The Commission discusses the logic of the colonization of Canada's territories, and why and how policy and practice developed to end the existence of distinct societies of Aboriginal peoples. Using brief excerpts from the powerful testimony heard from Survivors, this report documents the residential school system which forced children into institutions where they were forbidden to speak their language, required to discard their clothing in favour of institutional wear, given inadequate food, housed in inferior and fire-prone buildings, required to work when they should have been studying, and subjected to emotional, psychological and often physical abuse. In this setting, cruel punishments were all too common, as was sexual abuse. More than 30,000 Survivors have been compensated financially by the Government of Canada for their experiences in residential schools, but the legacy of this experience is ongoing today. This report explains the links to high rates of Aboriginal children being taken from their families, abuse of drugs and alcohol, and high rates of suicide. The report documents the drastic decline in the presence of Aboriginal languages, even as Survivors and others work to maintain their distinctive cultures, traditions, and governance. The report offers 94 calls to action on the part of governments, churches, public institutions and non-Aboriginal Canadians as a path to meaningful reconciliation of Canada today with Aboriginal citizens. Even though the historical experience of residential schools constituted an act of cultural genocide by Canadian government authorities, the United Nation's declaration of the rights of aboriginal peoples and the specific recommendations of the Commission offer a path to move from apology for these events to true reconciliation that can be embraced by all Canadians.

Book excerpt: Known as Lemberg in German and Lwów in Polish, the city of L'viv in modern Ukraine was in the crosshairs of imperial and national aspirations for much of the twentieth century. This book tells the compelling story of how its inhabitants (Roman Catholic Poles, Greek Catholic Ukrainians, and Jews) reacted to the sweeping political changes during and after World Wars I and II. The Eastern Front shifted back and forth, and the city changed hands seven times. At the end of each war, L'viv found itself in the hands of a different state.While serious tensions had existed among Poles, Ukrainians/Ruthenians, and Jews in the city, before 1914 eruptions of violence were still infrequent. The changes of political control over the city during World War I led to increased intergroup frictions, new power relations, and episodes of shocking violence, particularly against Jews. The city's incorporation into the independent Polish Republic in November 1918 after a brief period of Ukrainian rule sparked intensified conflict. Ukrainians faced discrimination and political repression under the new government, and Ukrainian nationalists attacked the Polish state. In the 1930s, anti-Semitism increased sharply. During World War II, the city experienced first Soviet rule, then Nazi occupation, and finally Soviet conquest. The Nazis deported and murdered nearly all of the city's large Jewish population, and at the end of the war the Soviet forces expelled the city's Polish inhabitants.Based on archival research conducted in L'viv, Kiev, Warsaw, Vienna, Berlin, and Moscow, as well as an array of contemporary printed sources and scholarly studies, this book examines how the inhabitants of the city reacted to the changes in political control, and how ethnic and national ideologies shaped their dealings with each other. At its heart, Divided Allies examines why strategic cooperation among these closely allied Western powers in the Asia-Pacific region was limited during the early Cold War. Thomas K. Robb and David James Gill probe the difficulties of security cooperation as the leadership of these four states balanced intramural competition with the need to develop a common strategy against the Soviet Union and the new communist power, the People's Republic of China. Robb and Gill expose contention and disorganization among non-communist allies in the early phase of containment strategy in Asia-Pacific. In particular, the authors note the significance of economic, racial, and cultural elements to planning for regional security and they highlight how these domestic matters resulted in international disorganization. Barezhev formulate planetary ethics—the most important part of the philosophy of the Planetary Project. Planetary ethics represent the moral basis and value code for building a biocompatible, harmonious, and manageable civilization.
