Book excerpt: In this groundbreaking book, Scalia and Garner systematically explain all the most important principles of constitutional, statutory, and contractual interpretation in an engaging and informative style with hundreds of illustrations from actual cases. Is a burrito a sandwich? Is a corporation entitled to personal privacy? If you trade a gun for drugs, are you using a gun in a drug transaction? The authors grapple with these and dozens of equally curious questions while explaining the most principled, lucid, and reliable techniques for deriving meaning from authoritative texts. Meanwhile, the book takes up some of the most controversial issues in modern jurisprudence. What, exactly, is textualism? Why is strict construction a bad thing? What is the true doctrine of originalism? And which is more important: the spirit of the law, or the letter? The authors write with a well-argued point of view that is definitive yet nuanced, straightforward yet sophisticated.

Available in PDF, EPUB and Kindle. Book excerpt: Law for Non-Law Students is written in a clear and readable style and aims to make the law understandable for readers at undergraduate or comparable level. It explains the practical influences under which the law has been formed,so that the student will be better able to understand why the law has developed in the way that it has. It gives lots of straightforward examples as to how the law works in practice and aims to equip students with the ability to appraise the effectiveness of the law in a particular circumstance rather than simply providing a list of rules for the student to regurgitate at exam time. The facts of the more important cases are given in some detail to enable the student to appreciate the range of factors which the court may have taken into account in reaching its decision. The new edition has been updated to take account of all recent developments, both in relation to statute and to case law. Certain chapters, particularly in the area of sale of goods, have been substantially rewritten and expanded in an attempt to give more detail, while at the same time remaining student-friendly. New chapters on Agency and Negligence have been added. brThis new edition should be suitable for most courses which have a law element.

Available in PDF, EPUB and Kindle. Book excerpt: Why we do what we do is a matter of great interest to everyone, and everyone seems to have had their say about it – philosophers, sociologists, anthropologists, psychologists, economists, and historians perhaps the most, case by case. Occasionally the specialists have offered their ideas to a general readership, but mostly they prefer to speak to and with their fellows in their particular disciplines. To evaluate and compare their findings in a cross-disciplinary way is now for the first time attempted, by Ramsay MacMullen. Emeritus history professor from Yale University, he is the recipient of various academic awards, including a lifetime Award for Scholarly Distinction from the American Historical Association

Book excerpt: This book addresses an important and relatively neglected topic in the scientific literature: individuals with autism spectrum disorder (ASD) who have dealings with the legal system. It examines issues and implications for autistic people, who have a significant risk for engagement with the legal system in some capacity (e.g., witness/bystander, victim, or perpetrator). Key areas of coverage include: Autistic people as victims and perpetrators of criminal activities, including violence, stalking, sexual exploitation, and cybercrime. Risks for unlawful behavior in individuals with autism and Asperger's. Legal assessment issues, such as witness protection and postconviction diagnoses. Legal outcomes for autistic people, including case law, prevention, service provisions in correctional settings, and rights and support systems. The Handbook of Autism Spectrum Disorder and the Law is an essential, comprehensive resource that explores the risk for unlawful behaviors affecting autistitc people as victims and perpetrators, as well as related issues of assessment and treatment, and outcome. It is a must-have reference for researchers, clinicians/practitioners, and graduate students in psychology, psychiatry, social work, and law, as well as professionals in such related fields, as criminology/criminal justice and the legal system.

Available in PDF, EPUB and Kindle. Book excerpt: Between the Great War and Pearl Harbor, conservative labor leaders declared themselves America's "first line of defense" against Communism. In this surprising account, Jennifer Luff shows how the American Federation of Labor fanned popular anticommunism but defended Communists' civil liberties in the aftermath of the 1919 Red Scare. The AFL's "commonsense anticommunism," she argues, steered a middle course between the American Legion and the ACLU, helping to check campaigns for federal sedition laws. But in the 1930s, frustration with the New Deal order led labor conservatives to redbait the Roosevelt administration and liberal unionists and abandon their reluctant civil libertarianism for red scare politics. That frustration contributed to the legal architecture of federal anticommunism that culminated with the McCarthyist fervor of the 1950s. Relying on untapped archival sources, Luff reveals how labor conservatives and the emerging civil liberties movement debated the proper role of the state in policing radicals and grappled with the challenges to the existing political order posed by Communist organizers. Surprising conclusions about familiar figures, like J. Edgar Hoover, and unfamiliar episodes, like a German plot to disrupt American munitions manufacture, make Luff's story a fresh retelling of the interwar years.

Book excerpt: Présentation de l'éditeur : "The interactions between law and culture in addressing the legal problems at the end of a life are currently being discussed in many countries. The discourse on this issue should be multidisciplinary, taking into account its legal, medical, ethical, philosophical and anthropological aspects. The concepts designed to manage the legal problems that occur when a life comes to an end are closely linked to the culture of each country. For this reason, countries with different cultural backgrounds have been selected for this comparative end-of-life study. In France, Germany and Italy, which have a continental legal system, the United Kingdom, which has a common law system, and India, the various religions and cultures exert an important influence on the modernisation of the legislation in this respect. The book deals with recent legislative changes and developments in the countries surveyed."
