Book excerpt: The federal Superfund program for cleaning up America's inactive toxic waste sites is noteworthy not only for its enormous cost - $15.2 billion has been authorized thus far - but also for its unique design. The legislation that created Superfund provided the Environmental Protection Agency with a diverse set of policy tools. Preeminent among them is a civil liability scheme that imposes responsibility for multimillion dollar cleanups on businesses and government units linked - even tangentially - to hazardous waste sites. Armed with this potent policy implement, the agency can order the parties who are legally responsible for the toxic substances at a site to clean it up, with large fines and damages for failure to comply. EPA can also offer conciliatory measures to bring about voluntary, privately financed cleanup; or it can launch a cleanup initially paid for by Superfund and later force the responsible parties to reimburse the government. In this book, Thomas W. Church and Robert T. Nakamura provide the first in-depth study of Superfund operations at hazardous waste sites. They examine six Superfund cleanups, including three regions and both 'hard' and 'easy' sites, to ask 'what works?' Based on detailed case studies, the book describes various strategies that have been applied by government regulators and lawyers and the responses to those different strategies by businesses and local government officials. The authors characterize the implementation strategies used by the EPA as prosecution, accommodation, and public works. They point out that the choice of strategy involves setting priorities among Superfund's competing objectives. They conclude that the best implementation strategy is one that considers the context of each site and the particular priorities in each case. Book excerpt: Under the Superfund program, EPA places some of the most seriously contaminated sites on the NPL. At the end of fiscal year 2013, nonfederal sites made up about 90 percent of these sites. At these sites, EPA undertakes remedial action projects to permanently and significantly reduce contamination. Remedial action projects can take a considerable amount of time and money, depending on the nature of the contamination and other site-specific factors. In GAO's 2010 report on cleanup at nonfederal NPL sites, GAO found that EPA's Superfund program appropriations were generally declining, and limited funding had delayed remedial cleanup activities at some of these sites. GAO was asked to review the status of the cleanup of nonfederal NPL sites. This report examines, for fiscal years 1999 through 2013, the trends in (1) the annual federal appropriations to the Superfund program and EPA expenditures for remedial cleanup activities at nonfederal sites on the NPL; and (2) the number of nonfederal sites on the NPL, the number of remedial action project completions, and the number of construction completions at nonfederal NPL sites. GAO analyzed Superfund program and expenditure data from fiscal years 1999 through 2013 (most recent year with complete data available), reviewed EPA documents, and interviewed EPA officials.

Book excerpt: Pursuant to a congressional request, GAO reviewed the Environmental Protection Agency's (EPA) Superfund cleanup efforts, focusing on comparing EPA's estimate of future cleanup times compared with the program's historical performance. GAO noted that: (1) as of July 1, 1997, remedial action had been completed at 13 percent (95) of the 752 sites placed on the National Priorities List in fiscal years 1986 through 1994; (2) these remedial actions were completed in an average of 6.3 years after the sites were listed; (3) as of the same date, remedial action had not been completed at 87 percent (657) of the sites listed in fiscal years 1986 through 1994; (4) these uncompleted sites had been in the cleanup process an average of 8.1 years, that is, they had been listed on the National Priorities List an average of 8.1 years earlier; (5) assuming that all remedial actions at these "in process" sites had been completed on July 1, 1997, the average cleanup duration for all sites listed on the National Priorities List during the 9-year period would have been 7.9 years, almost as long as EPA's 8-year estimate of the cleanup time for recently listed sites; (6) because such a larger proportion of the sites listed in the 9-year period are still in process, the average cleanup time for these sites will exceed 8 years, possibly by a substantial margin; and (7) furthermore, for EPA to meet its 8-year estimate for cleaning up recently listed sites will require much faster cleanup times than the program has produced in the past.
