The volume provides a detailed account of the structure and functioning of the Committee on Economic, Social and Cultural Rights in the light of its jurisprudence, through a study of the Committee’s procedures and practices (periodic reports and general comments), including taking into account the Optional Protocol for individual complaint procedure. The book considers the possible implications of the work of this Committee on other UN Committees, such as the Human Rights Committee and the UN Committee on the Rights of the Child, as well as considering the repercussions of its work on the international protection of fundamental rights, such as the right to education, to health and adequate food. Book Synopsis Keeping Hold of Justice by : Jennifer Balint
Download or read book Keeping Hold of Justice written by Jennifer Balint and published by University of Michigan Press. This book was released on 2020-02-19 with total page 219 pages. Available in PDF, EPUB and Kindle. Book excerpt: Keeping Hold of Justice focuses on a select range of encounters between law and colonialism from the early nineteenth century to the present. It emphasizes the nature of colonialism as a distinctively structural injustice, one which becomes entrenched in the social, political, legal, and discursive structures of societies and thereby continues to affect people’s lives in the present. It charts, in particular, the role of law in both enabling and sustaining colonial injustice and in recognizing and redressing it. In so doing, the book seeks to demonstrate the possibilities for structural justice that still exist despite the enduring legacies and harms of colonialism. It puts forward that these possibilities can be found through collaborative methodologies and practices, such as those informing this book, that actively bring together different disciplines, peoples, temporalities, laws and ways of knowing. They reveal law not only as a source of colonial harm but also as a potential means of keeping hold of justice.
Book Synopsis Peacebuilding in the United Nations by : Fernando Cavalcante
Download or read book Peacebuilding in the United Nations written by Fernando Cavalcante and published by Springer. This book was released on 2019-05-06 with total page 327 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book traces the trajectory and different meanings of the concept of peacebuilding in the United Nations since the early 1990s. It analyses how that concept gained life in a particular context and the implications of this process for the Organisation’s support to societies affected by armed conflict in general and for peace operations in particular. Departing from tenets about the influence of ideas in world politics and engaging with the critique of the liberal peace scholarship, the book provides a theoretically informed narrative of how peacebuilding acquired different meanings while remaining largely motivated, justified, legitimated and informed by a proactive and top-down agenda of promoting liberal democratic institutions, norms and values as a remedy to the challenges faced by societies affected by armed conflict. The book will appeal to scholars, policymakers and practitioners in peacebuilding and post-conflict development.
Book Synopsis A History of the 1957 Federation of Malaya Constitution by : Joseph M. Fernando
Download or read book A History of the 1957 Federation of Malaya Constitution written by Joseph M. Fernando and published by Taylor & Francis. This book was released on 2024-12-09 with total page 181 pages. Available in PDF, EPUB and Kindle. Book excerpt: Fernando examines important aspects of the drafting of 1957 Federation of Malaya constitution related to the system of governance, division of legislative and executive powers, the conceptualisation of citizenship and the roles of the judiciary and election commission. The book sheds new light on the balances that the Reid Commission sought to embed in the constitution and the historical constitutional debates and discussions which greatly shaped the framing of the new federal constitution between 1956 and 1957. Drawing on historical evidence mainly from declassified primary constitutional documents, it analyses the submissions, debates and discussions among the framers and various interest groups during the drafting of the constitution between 1956 and 1957 to discern more clearly the intentions of the framers on many aspects of governance and distribution of powers embedded in the constitutional provisions. This book reveals more deeply the nature and complexity of the constitutional issues faced by the framers and how they attempted to reach compromises between the various interest groups in Malaya. It is a valuable resource for scholars and academics of Malaysian, Asian and Commonwealth constitutional history as well as those interested in history, law, political science and important aspects of governance and distribution of powers in the system of parliamentary democracy.
Book Synopsis Genocide, Ethnonationalism, and the United Nations by : Hannibal Travis
Download or read book Genocide, Ethnonationalism, and the United Nations written by Hannibal Travis and published by Routledge. This book was released on 2013-01-17 with total page 372 pages. Available in PDF, EPUB and Kindle. Book excerpt: Genocide, Ethnonationalism, and the United Nations examines a series of related crises in human civilization growing out of conflicts between powerful states or empires and indigenous or stateless peoples. This is the first book to attempt to explore the causes of genocide and other mass killing by a detailed exploration of UN archives covering the period spanning from 1945 through 2011. Hannibal Travis argues that large states and empires disproportionately committed or facilitated genocide and other mass killings between 1945 and 2011. His research incorporates data concerning factors linked to the scale of mass killing, and recent findings in human rights, political science, and legal theory. Turning to potential solutions, he argues that the concept of genocide imagines a future system of global governance under which the nation-state itself is made subject to law. The United Nations, however, has deflected the possibility of such a cosmopolitical law. It selectively condemns genocide and has established an institutional structure that denies most peoples subjected to genocide of a realistic possibility of global justice, lacks a robust international criminal tribunal or UN army, and even encourages "security" cooperation among states that have proven to be destructive of peoples in the past. Questions raised include: What have been the causes of mass killing during the period since the United Nations Charter entered into force in 1945? How does mass killing spread across international borders, and what is the role of resource wealth, the arms trade, and external interference in this process? Have the United Nations or the International Criminal Court faced up to the problem of genocide and other forms of mass killing, as is their mandate?
