Cette règle générale étant à la base de tout système juridique est un élément caractéristique du système de la responsabilité civile française. Elle nourrit le principe français de non-option entre les responsabilités contractuelle et délictuelle, comme manifestations de la responsabilité civile. Le terme responsabilité vient du mot latin respondere, qui signifie répondre à une question. Le mot a d'abord été utilisé au Moyen-âge pour décrire ce qui était susceptible d'ètre répondu ou vérifié. L'utilisation religieuse lui a par la suite ajouté un nouveau sens: l'homme répond à Dieu par sa conduite sur terre. Avec la suppression de la morale religieuse par la pensée laïque, l'homme n'est plus responsable devant Dieu pour sa conduite, mail il l'est devant d'autres hommes s'il ne respecte pas les règles posées par le droit. Ainsi une fois, qu'un homme a commis une action illicite, ce qui suit, c'est une obligation pour lui à réparer les conséquences de son agissement. Cette obligation à réparer a été admis par des juristes comme Grotius ou Domat en 1798. (...) Considérant la possibilité d'une option qui a existé avant 1930 et qui existe dans presque tous les pays européens ainsi que le grand nombre des exceptions à ce principe, il se pose la question suivante: Quel avenir pour le principe de non-option entre responsabilités contractuelle et délictuelle? Afin de répondre à cette question, il est force à constater dans un premier temps la consécration constante du principe de non-option dans le droit positif (Partie I) puis d'examiner dans un second temps la relativisation du principe de non-option comme source d'un avenir incertain au principe de non-option (Partie II).

Such traditionalism leads to radical questions, however: Should cities have police and fire departments? Should tax preferences for home ownership be repealed? Should public schools charge for their services? O'Flaherty also gives serious consideration to such heterodox policies as pay-at-the-pump auto insurance, curb rights for buses, land taxes, marginal cost water pricing, and sidewalk zoning.
