Book excerpt: This report considers the meaning and interpretation of the phrase “an unreasonable or unnecessary exercise by the Service of any of its powers” as it appears in Sections 33 and 40 of the ‘Canadian Security Intelligence Service Act’ (CSIS Act). Section 33 deals with the requirements for security certificates submitted by the Inspector General, CSIS to the Solicitor General of Canada, and Section 40 vests the Security Intelligence Review Committee with authority to compel reviews of CSIS operational activities. The report examines the language of the statute, its legislative history, case law, and Parliament’s intent to “provide adequate external review machinery to ensure that the Service does not abuse it powers ... and that the Government does not misuse the Service”. The report recommends that “unreasonable” should be interpreted as related to the wisdom or, appropriateness of ends chosen to be pursued by the Service, while “unnecessary relates to the means chose to pursue those ends.
