But this very insistence was a source of hardship and gave rise to constant grievances, because the King and his ministers were apt to brush away established customs and to exert arbitrary despotism on the pretext of enforcing discipline and serving the interests of the Community. A strong opposition to such high-handed acts was manifested on many occasions, and found an appropriate basis in the juridical conceptions and traditions of feudal society - a society which looked upon convention and custom as the ruling principles of the law. Dr. Ehrlich traces the influence of this peculiar legalism in the early history of Proceedings against the Crown, and shows that the contradictory statements of Bracton's treatise are connected with different ten dencies in the actual practice of the law. Book excerpt: This is the first book covering those who abused and misused the legal system in medieval England and the initial attempts of the Anglo-American legal system to deal with these forms of legal corruption. Maintenance, in the sense of intermeddling in another person's litigation, was a source of repeated complaint in medieval England. This book reveals for the first time what actually transpired in the resultant litigation. Extensive study of the primary sources shows that the statutes prohibiting maintenance did not achieve their objectives because legal proceedings were rarely brought against those targeted by the statutes: the great and the powerful. Illegal maintenance was less extensive than frequently asserted because medieval judges recognized a number of valid justifications for intermeddling in litigation. Further, the book casts doubt on the effectiveness of the statutory regulation of livery. This is a treasure trove for legal historians, literature scholars, lawyers, and academic libraries.

Using quantitative methods, the author analyzes murder as a social relationship that can tell us much about medieval life and its social organization, much that would otherwise remain unknown. Given investigates murder rates, violent conflicts between family members, masters, servants, and neighbors, and the collaboration between these same groups in assaulting others. He also explores the socio-economic status of killers and victims, the treatment of killers in court, including what attitudes toward violence can be gleaned from judicial verdicts, the effects of urbanization of patterns of homicide, and social factors that impeded or encouraged recourse to violence.

Book excerpt: The later twelfth and thirteenth centuries were a pivotal period for the development of European government and governance. A mentality emerged that trusted to procedures of accountability as a means of controlling officers' conduct. The mentality was not inherently new, but it became qualitatively more complex and quantitatively more widespread in this period, across European countries, and across different sorts of officer. The officers exposed to these methods were not just 'state' ones, but also seignorial, ecclasistical, and university-college officers, as well as urban-communal ones. This study surveys these officers and the practices used to regulate them in England. It places them not only within a British context but also a wide European one and explores how administration, law, politics, and norms tried to control the insolence of office. The devices for institutionalising accountability analysed here reflected an extraordinarily creative response in England, and beyond, to the problem of complex government: inquests, audits, accounts, scrutiny panels, sindication. Many of them have shaped the way in which we think about accountability today. Some remain with us. So too do their practical problems. How can one delegate control effectively? How does accountability relate to responsibility? What relationship does accountability have with justice? This study offers answers for these questions in the Middle Ages, and is the first of its kind dedicated to an examination of this important topic in this period.
