Book Synopsis In the House of the Law by : Judith E. Tucker
Download or read book In the House of the Law written by Judith E. Tucker and published by Univ of California Press. This book was released on 2023-04-28 with total page 235 pages. Available in PDF, EPUB and Kindle. Book excerpt: In an rewarding new study, Tucker explores the way in which Islamic legal thinkers understood Islam as it related to women and gender roles. In seventeenth and eighteenth century Syria and Palestine, Muslim legal thinkers gave considerable attention to women's roles in society, and Tucker shows how fatwas, or legal opinions, greatly influenced these roles. She challenges prevailing views on Islam and gender, revealing Islamic law to have been more fluid and flexible than previously thought. Although the legal system had a consistent patriarchal orientation, it was modulated by sensitivities to the practical needs of women, men, and children. In her comprehensive overview of a field long neglected by scholars, Tucker deepens our understanding of how societies, including our own, construct gender roles.

Book Synopsis Sharia and the Making of the Modern Egyptian by : Reem A. Meshal
Download or read book Sharia and the Making of the Modern Egyptian written by Reem A. Meshal and published by Oxford University Press. This book was released on 2014 with total page 303 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this book, the author examines sijills, the official documents of the Ottoman Islamic courts, to understand how sharia law, society and the early-modern economy of sixteenth- and seventeenth-century Ottoman Cairo related to the practice of custom in determining rulings. In the sixteenth century, a new legal and cultural orthodoxy fostered the development of an early-modern Islam that broke new ground, giving rise to a new concept of the citizen and his role. Contrary to the prevailing scholarly view, this work adopts the position that local custom began to diminish and decline as a source of authority. These issues resonate today, several centuries later, in the continuing discussions of individual rights in relation to Islamic law.

Book Synopsis Breaching the Bronze Wall: Franks at Mamluk and Ottoman Courts and Markets by : Francisco Apellániz
Download or read book Breaching the Bronze Wall: Franks at Mamluk and Ottoman Courts and Markets written by Francisco Apellániz and published by BRILL. This book was released on 2020-08-03 with total page 342 pages. Available in PDF, EPUB and Kindle. Book excerpt: Breaching the Bronze Wall deals with the idea that the words of honorable Muslims constitutes proof and that written documents and the words of non-Muslims are of inferior value. Thus, foreign merchants in cities such as Istanbul, Damascus or Alexandria could barely prove any claim, as neither their contracts nor their words were of any value if countered by Muslims. Francisco Apellániz explores how both groups labored to overcome the ‘biases against non-Muslims’ in Mamlūk Egypt’s and Syria’s courts and markets (14th-15th c.) and how the Ottoman conquest (1517) imposed a new, orthodox view on the problem. The book slips into the Middle Eastern archive and the Ottoman Dīvān, and scrutinizes sharīʿa’s intricacies and their handling by consuls, dragomans, qaḍīs and other legal actors.
Book Synopsis Ottoman Sunnism by : Erginbas Vefa Erginbas
Download or read book Ottoman Sunnism written by Erginbas Vefa Erginbas and published by Edinburgh University Press. This book was released on 2019-10-08 with total page 240 pages. Available in PDF, EPUB and Kindle. Book excerpt: Addressing the contested nature of Ottoman Sunnism from the 14th to the early 20th century, this book draws on diverse perspectives across the empire. Closely reading intellectual, social and mystical traditions within the empire, it clarifies the possibilities that existed within Ottoman Sunnism, presenting it as a complex, nuanced and evolving concept. The authors in this volume rescue Ottoman Sunnism from an increasingly bipolar definition that seeks to present the Ottomans as enshrining a clearly defined orthodoxy, suppressing its contrasting heterodoxy. Challenging established notions that have marked the existing literature, the chapters contribute significantly not only to the ongoing debate on the Ottoman age of confessionalisation but also to the study of religion in the Ottoman context.
Book Synopsis The Ashgate Research Companion to Islamic Law by : Peri Bearman
Download or read book The Ashgate Research Companion to Islamic Law written by Peri Bearman and published by Routledge. This book was released on 2016-03-16 with total page 502 pages. Available in PDF, EPUB and Kindle. Book excerpt: This unparalleled Companion provides a comprehensive and authoritative guide to Islamic law to all with an interest in this increasingly relevant and developing field. The volume presents classical Islamic law through a historiographical introduction to and analysis of Western scholarship, while key debates about hot-button issues in modern-day circumstances are also addressed. In twenty-one chapters, distinguished authors offer an overview of their particular specialty, reflect on past and current thinking, and point to directions for future research. The Companion is divided into four parts. The first offers an introduction to the history of Islamic law as well as a discussion of how Western scholarship and historiography have evolved over time. The second part delves into the substance of Islamic law. Legal rules for the areas of legal status, family law, socio-economic justice, penal law, constitutional authority, and the law of war are all discussed in this section. Part three examines the adaptation of Islamic law in light of colonialism and the modern nation state as well as the subsequent re-Islamization of national legal systems. The final section presents contemporary debates on the role of Islamic law in areas such as finance, the diaspora, modern governance, and medical ethics, and the volume concludes by questioning the role of Sharia law as a legal authority in the modern context. By outlining the history of Islamic law through a linear study of research, this collection is unique in its examination of past and present scholarship and the lessons we can draw from this for the future. It introduces scholars and students to the challenges posed in the past, to the magnitude of milestones that were achieved in the reinterpretation and revision of established ideas, and ultimately to a thorough conceptual understanding of Islamic law.

Book Synopsis Land and Legal Texts in the Early Modern Ottoman Empire by : Malissa Taylor
Download or read book Land and Legal Texts in the Early Modern Ottoman Empire written by Malissa Taylor and published by Bloomsbury Publishing. This book was released on 2023-09-21 with total page 215 pages. Available in PDF, EPUB and Kindle. Book excerpt: Using Arabic and Ottoman Turkish sources drawn from three genres of legal text, this book is the first full-length study in decades to investigate the evolution of Ottoman land law from its “classical” articulation in the sixteenth century to its reformulation in the 1858 Land Code. The book demonstrates that well before the nineteenth century the tradition of Ottoman land tenure law had developed an indigenous form of property right that would remain intact in the Land Code. In addition, the rising consensus of the jurists that the sultan was the source of the land law paved the way for the wider legislative authority that the Ottoman state would increasingly assert in the Tanzimat period of reform. Demonstrating the profound and ongoing adaptation of a legal tradition that was at once both Ottoman and Islamic, it revises our understanding of the relationship between the modern Islamic world and its early modern past, and what kind of intervention was represented by reform in the 19th century.
Book Synopsis Crime and Punishment in Istanbul by : Fariba Zarinebaf
Download or read book Crime and Punishment in Istanbul written by Fariba Zarinebaf and published by Univ of California Press. This book was released on 2011-01-10 with total page 305 pages. Available in PDF, EPUB and Kindle. Book excerpt: This vividly detailed revisionist history exposes the underworld of the largest metropolis of the early modern Mediterranean and through it the entire fabric of a complex, multicultural society. Fariba Zarinebaf maps the history of crime and punishment in Istanbul over more than one hundred years, considering transgressions such as riots, prostitution, theft, and murder and at the same time tracing how the state controlled and punished its unruly population. Taking us through the city's streets, workshops, and houses, she gives voice to ordinary people—the man accused of stealing, the woman accused of prostitution, and the vagabond expelled from the city. She finds that Istanbul in this period remains mischaracterized—in part by the sensational and exotic accounts of European travelers who portrayed it as the embodiment of Ottoman decline, rife with decadence, sin, and disease. Linking the history of crime and punishment to the dramatic political, economic, and social transformations that occurred in the eighteenth century, Zarinebaf finds in fact that Istanbul had much more in common with other emerging modern cities in Europe, and even in America.

Book Synopsis The Laws of Yesterday’s Wars 3 by : Samuel C. Duckett White

The Laws of Yesterday's Wars 3: From Highland New Guinea to the Island of Malta, together with its companion volumes, The Laws of Yesterday’s Wars: From Indigenous Australians to the American Civil War (Brill-Nijhoff, 2021) and The Laws of Yesterday's Wars 2: From Ancient India to East Africa (Brill-Nijhoff, 2022), attempts to answer that question. It offers a culture-by-culture account of various unique restrictions placed on warfare over time. Containing essays by a range of laws of war academics and practitioners, it approaches the laws of yesterday’s wars from a wide cross-section of history and culture, seeking to find any common ground and to demonstrate a history of international law outside the usual confines of its ‘development’ by Europeans and its later ‘contributions.’ This volume includes studies on Mongol, Iban and Ottoman rules of war.
