This Volume 9 runs parallel to Volume 8, A History of the Philosophy of Law in the Common Law World, 1600–1900, by Michael Lobban, published in 2007. Dobruska was a businessman, scholar, and social philosopher, born into a Jewish family in Moravia, who converted to Catholicism, gained wide recognition at the Habsburg court in Vienna, and then emigrated to France to join the French Revolution. Dobruska, who took on the name Junius Frey during his Parisian sojourn, barely survived his book. Accused of conspiring on behalf of foreign powers, he was guillotined on April 5, 1794, at the height of The Terror, on the same day as Georges Jacques Danton. From Dobruska's ideas, which were widely used between the late eighteenth century and the first decades of the nineteenth century without attribution to their author, emerge some of the key concepts of the social sciences as we know them today. An enthusiastic and unfortunate revolutionary and sometimes a brilliant theorist, Moses Dobruska deserves a role of his own in the history of sociology. The project's underlying idea is that the Mediterranean is of decisive importance for any investigation into the political and commercial relations between states of different size and constitutional structure in the seventeenth and eighteenth centuries. It thus scrutinises the practices, institutions and cultural tendencies of the region's ruling classes, from those of the Italian small states to those of the great powers. Salerno, Edigati, Angiolini, Addobbati and Zamora examine the theme of the small state by focusing on the Grand Duchy of Tuscany and its foreign policy centred on the free port of Livorno and the principle of neutrality, while Herrero and Aglietti describe how diplomats from the Republic of Genoa, the Dutch Republic and the consuls of the Italian small states helped preserve the European balance of power. Since war was a catalyst for the internal reorganisation of states, the correlation of war, trade and neutrality as processes of emulation is investigated by Stapelbroek, Alimento and Calafat, while the reception and circulation of theoretical models is recounted by Trampus, Schnakenbourg and Spagnesi. This monograph considers the codification project in light of a series of broader analytical frameworks – comparative, historical and constitutional – which make modern codification phenomena intelligible. This new reading across fields renders the European codification project (currently being promoted through the Common Frame of Reference and the Optional Sales Law Code proposal) vulnerable to constitutionally-grounded criticism, traceable to normative considerations of private law authority and legitimacy. Arguing that modern codification phenomena are more complex than positivist, socio-legal and historical approaches have suggested over the past two centuries, the book stages a pathbreaking method of analysis of the law-discourse (nomos-centred) which questions at once the reduction of private law to legislation and of law to power and, on this basis, redefines the ways in which to counter law's disintegration and crisis in the context of Europeanisation. Professor Niglia reconstructs the European codification project as a complex structure of government-in-the-making that embodies a set of contingent world views, excludes alternatives, challenges the plurality of private laws and entrenches conflicts that pertain not only to form (codification, de-codification, recodification) but also to dilemmas implicated in determining the substantive orientation of European private law. The book investigates the position of the codifiers and their discontents in the shadow of the codification strategy pursued by the European Commission – noting a new turn in the struggle over the configuration of private law which has taken place since the Savigny-Thibaut dispute of 1814 which this book critically revisits exactly two centuries later. This monograph is particularly aimed at readers interested in exploring the complexities, and interconnections, of the supposedly separate realms of comparative law, European law, private law, legal history, constitutional law, sociology of law and, last but not least, legal theory and jurisprudence.

Book excerpt: This intellectual biography provides an organic framework for understanding Antonio Gramsci’s process of intellectual development, paying close attention to the historical and intellectual contexts out of which his views emerged. The Gramsci in Notebooks cannot fully account for the young director of L’Ordine Nuovo, or for the communist leader. Gramsci’s development did not occur under conditions of intellectual inflexibility, of absence of evolution. However, there is a strong thread connecting the “political Gramsci” with Gramsci as a “cultivated man.” The Sardinian intellectual’s life is marked by the drama of World War I, the first mass conflict in which the great scientific discoveries of the previous decades were applied on a large scale and in which millions of peasants and workers were slaughtered. In all of his theoretical formulations, this dual relation, which epitomizes the instrumental use of “simpletons” by ruling classes, goes beyond the military context of the trenches and becomes full-fledged in the fundamental relations of modern capitalist society. In contrast with this notion of social hierarchy, which is deemed natural and unchangeable, Gramsci constantly affirmed the need to overcome the historically determined rupture between intellectual and manual functions, due to which the existence of a priesthood or of a separate caste of specialists in politics and in knowledge is made necessary. It is not the specific professional activity (whether material or immaterial) that determines the essence of human nature: to Gramsci, “all men are philosophers.” In this passage from Notebooks, we find the condensed form of his idea of “human emancipation,” which is the historical need for an “intellectual and moral reform”: the subversion of traditional relations between rulers and ruled and the end of exploitation of man by man.
