Book excerpt: In this paper we discuss the global negotiations now underway and aimed at achieving new climate change mitigation and other arrangements after 2012 (the end of the Kyoto commitment period). These were initiated in Bali in December 2007 and are scheduled to conclude by the end of 2009 in Copenhagen. As such, this negotiation is effectively the second round in ongoing global negotiations on climate change and further rounds will almost certainly follow. We highlight both the vast scope and vagueness of the negotiating mandate, the many outstanding major issues to be accommodated between negotiating parties, the lack of a mechanism to force collective decision making in the negotiation, and their short time frame. The likely lack of compliance with prior Kyoto commitments by several OECD countries (some to a major degree), the effective absence in Kyoto of compliance/enforcement mechanisms, and growing linkage to non-climate change areas (principally trade) all further complicate the task of bringing the negotiation to conclusion. The major clearage we see that needs to be bridged in the negotiations is between OECD countries on the one hand, and lower wage, large population, rapidly growing countries (China, India, Russia, Brazil) on the other.

Agriculture is part of the climate change problem, contributing about 13.5 percent of annual greenhouse gas (GHG) emissions (with forestry contributing an additional 19 percent), compared with 13.1 percent from transportation. Agriculture is, however, also part of the solution, offering promising opportunities for mitigating GHG emissions through carbon sequestration, soil and land use management, and biomass production. Climate change threatens agricultural production through higher and more variable temperatures, changes in precipitation patterns, and increased occurrences of extreme events such as droughts and floods. And if agriculture is not included, or not well included, in the international climate change negotiations leading up to the 15th Conference of Parties (COP15) of the UN Framework Convention on Climate Change in Copenhagen in December 2009, resulting climate change policies could threaten poor farming communities and smallholders in many developing countries. The policies could also impede the ability of smallholders to partake in new economic opportunities that might arise from the negotiations.

Its role in the development of the climate change regime, as well as the adoption of novel policy instruments such as the EU Emissions Trading Scheme in 2005, are frequently put forward as indicative of a determination to push the international climate agenda forward. However, there are numerous instances where the EU has failed to achieve its climate change objectives (e.g. the 2009 Copenhagen Conference of the Parties). It is therefore important to examine the reasons behind these failures. This book explores in detail the involvement of the EU in international climate talks from the late 1980s to the present, focusing in particular on the negotiations leading up to Copenhagen. This conference witnessed the demise of the top-down approach in climate change policy and dealt a serious blow to the EU’s leadership ambitions. This book explores the extent to which negotiation theory could help with better comprehending the obstacles that prevented the EU from getting more out of the climate negotiation process. It is argued that looking at the role played by problematic strategic planning could prove highly instructive in light of the Paris Agreement. This broad historical perspective of the EU’s negotiations in international climate policy is an important resource to scholars of environmental and European politics, policy, law and governance.
