In una visione dicotomica, in cui ai conflitti internazionali si contrappongono quelli interni, non è facile, in mancanza di un regime ad hoc per le guerre internazionalizzate o regionalizzate, desumere dal diritto preesistente di cui alle quattro Convenzioni di Ginevra del 1949 e ai loro due Protocolli addizionali del 1977, regole in grado di disciplinare questi nuovi conflitti senza cedere rispetto all’obiettivo centrale della tutela dei diritti umani.Ida Caracciolo, è professore ordinario di diritto internazionale nel Dipartimento di Scienze Politiche “Jean Monnet” della Seconda Università di Napoli. Professore visitatore nell’Università di Parigi 8. È membro della Corte permanente di arbitrato e conciliatore nella Corte di arbitrato e conciliazione dell’OSCE.
