Book Synopsis Environmental Regulation Through Financial Organisations:Comparative Perspectives on the Industrialised Nations by : Benjamin Richardson
Download or read book Environmental Regulation Through Financial Organisations:Comparative Perspectives on the Industrialised Nations written by Benjamin Richardson and published by Kluwer Law International B.V.. This book was released on 2002-02-13 with total page 418 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book takes a comparative perspective of practice in the European Union, North America, Japan and Australasia, arguing that existing legal reforms to promote sustainable development are unlikely to be successful unless environmental policy can be diffused and embedded in the financial services sector. This sector plays a crucial role in creating the financial conditions that allow much economic development to proceed. Financial markets are already highly regulated in pursuance of various public policy objectives, and there is scope to adapt existing regulation to incorporate environmental aspects into the financial services sector. In terms of specific reforms, the book focuses on the role of corporate environmental reporting, economic instruments and liability rules to provide a proper context for engaging financial organisations with the environment, as well as reforms to the system of prudential regulation that currently governs this sector. Beyond the focus on the financial services sector, the book raises complex questions regarding the relationship between the state and market institutions in environmental policy, and will appeal to scholars from a wide range of disciplines interested in problems of environmental governance.
Book Synopsis Law, Society, and Economy by : Richard Rawlings
Download or read book Law, Society, and Economy written by Richard Rawlings and published by Oxford University Press. This book was released on 1997 with total page 404 pages. Available in PDF, EPUB and Kindle. Book excerpt: This centenary volume of essays explores a number of related themes which differentiate and characterize the approach of the LSE. Central to this, is the assumption that law is one of the social sciences and that law should be studied "in context" as a social phenomenon. The contributors havebeen chosen both for their distinction and for their connection with the LSE, and include such eminent figures as Mrs Justice Arden, Judge Rosalyn Higgins, Sir Stephen Sedley, and Roberto Mangabeira Unger. The essays focus on three main subject areas: Law and Economy; Dimensions of Law; and Courts and Process which are discussed against the broader canvas of the School's approach to Law . Thus, Comaroff, Cohen, Unger and Teubner adopt an interdisciplinary approach to the subject, stressing both legaland social theory, while the contributions of Cranston, Cornish and others stress an internationalist approach. A characteristic LSE focus on the dynamic nature of law runs through the work of Collins, Higgins and Lord Wedderburn, while a reformist tradition (allied with concern for the practical)is explored alongside the introduction of new legal subjects into the curriculum.Fascinating and thought provoking, this volume is an accesible summary of current thought and debate presented by today's leading scholars and practioners. Law, Society and Economy will be of enduring interest to scholars and practioners worldwide, akin to Ginsberg's celebrated and widely citedvolume of essays which marked the School's fiftieth anniversary.
Book Synopsis Luhmann on Law and Politics by : Michael King
Download or read book Luhmann on Law and Politics written by Michael King and published by Bloomsbury Publishing. This book was released on 2006-02-27 with total page 262 pages. Available in PDF, EPUB and Kindle. Book excerpt: Perhaps more than any other social theorist in recent history, Niklas Luhmann's work has aroused extreme, and often antagonistic, responses. It has generated controversies about its political implications, its resolute anti-humanism and its ambitious critique of more established definitions of society, social theory and sociology. Now, however, a steadily growing number of scholars working in many different disciplines have begun to use aspects of Luhmann's sociology as an important methodological stimulus and as a theoretical framework for reorientating their studies. This collection of essays includes critical and reconstructive contributions by a number of distinguished social theorists, political theorists, legal scholars and empirical sociologists. Together, they provide evidence of Luhmann's extensive and diverse relevance to the issues facing contemporary society, and, at the same time, they enhance our understanding of the challenges posed by his theoretical paradigm to more traditional conceptions of social theory.
Book Synopsis Sociocybernetics by : Rudolf F. Geyer
Download or read book Sociocybernetics written by Rudolf F. Geyer and published by Bloomsbury Publishing USA. This book was released on 2001-01-30 with total page 261 pages. Available in PDF, EPUB and Kindle. Book excerpt: In an effort to shed light on recent developments in sociocybernetic research, this volume represents recent and advanced thinking in this rapidly developing field. The authors address the core problems in social science caused by increasing societal complexity and analyze the inadequacy of many of the methodological tools still used for grappling with nonlinear, self-organizing systems. Together, the 18 contributors propose elements of a new methodology based on sociocybernetic principles aimed at describing and explaining the growth of societal complexity, the contribution of autopoiesis of societal subunits to more societal complexity, and the new simulation-based methodology needed to observe complex social systems. This unique volume contributes to a greater understanding of sociocybernetics and its uses as a method for researching modern problems of increasing complexity and interdependence. The first part of the book deals with increasing societal complexity and contains chapters on its overall development, the complexity of brain-environment interaction loops, organizational change, the development of human values, and the increasing interpenetration of societal subsystems. The second part concentrates on a current issue in sociocybernetics: autopoiesis, or self-production. The chapters included in Part II concentrate on embodied cognition, on the applicability of autopoiesis to business firms, on its roots in Aristotelian philosophy, and on the possibility of societal control and steering in democratic societies. Part III, more focused on methodology, discusses the difficulties inherent in observing complex social systems. The chapters deal with the problems of cross-cultural comparative research, simulation of the evolution of social systems, longitudinal simulation of education systems, and the methodological difficulties associated with analyzing the unexpected complexities of mutually interacting nonlinear systems.
Book Synopsis Multinationals and the Constitutionalization of the World Power System by : Jean-Philippe Robé
Download or read book Multinationals and the Constitutionalization of the World Power System written by Jean-Philippe Robé and published by Routledge. This book was released on 2016-06-03 with total page 264 pages. Available in PDF, EPUB and Kindle. Book excerpt: This collection offers a powerful and coherent study of the transformation of the multinational enterprise as both an object and subject of law within and beyond States. The study develops an analysis of the large firm as being a system of organization exercising vast powers through various instruments of private law, such as property rights, contracts and corporations. The volume focuses on the firm as the operational unit of governance within emerging systems of globalization, whilst exploring in-depth the forms within which the firm might be regulated as against the inhibiting parameters of national law. It connects, through the ordering concept of the firm in globalization, the distinct regimes of constitutionalization, national and international law. The study will be of interest to students and academics in globalization and the regulation of multinational corporations, as well as law, economics and politics on a global scale. It will also interest government leaders and NGOs working in the areas of MNE regulations.

Book Synopsis Imaginary Boundaries of Justice by : Ronnie Lippens
Download or read book Imaginary Boundaries of Justice written by Ronnie Lippens and published by Bloomsbury Publishing. This book was released on 2005-01-14 with total page 210 pages. Available in PDF, EPUB and Kindle. Book excerpt: It has become increasingly difficult to speak or even think social or legal justice in an age when words have left their moorings. Perhaps images are more stable than words; maybe images and imagery possess a certain viscosity, even a sensory quality, which prevents them from evaporating. This 'maybe' is what this book is about. The contributors to this collection explore the issue of how the Imaginary (images, imagery, imagination) has a role in the production and reproduction of 'visions' of legal and social justice. It argues that 'visions' of justice are inevitably bounded. Boundaries of 'visions' of justice, however, are also 'imaginary'. They emerge within imaginary spaces, and, as they are 'imaginary', they are inherently unstable. The book captures an emerging interest (in the humanities and social sciences) in images and the visual, or the Imaginary more broadly. This collection will appeal to scholars and students of social and legal theory, visual culture, justice and governance studies, media studies, and criminology.

Book Synopsis Cooperation Networks and Economic Development by : Andrés Cárdenas O ́Farrill
Download or read book Cooperation Networks and Economic Development written by Andrés Cárdenas O ́Farrill and published by Routledge. This book was released on 2021-02-11 with total page 382 pages. Available in PDF, EPUB and Kindle. Book excerpt: For most Western audiences, Cuba is a touristic paradise stuck in time and virtually detached from world technology networks by the US embargo – anything but a hub of industrial innovation and high value-added biotechnology. However, a closer look reveals more subtle but equally powerful stories that challenge the homogenizing assumptions of conventional economics and open up scope for more sophisticated reflections on Cuban economy and industry. From this kind of enquiry emerges the case of the internationally respected Cuban biotech industry as the most successful case of science and technology policy in the country’s economic history. The book takes an interdisciplinary approach, exploring issues such as interdependency, purpose and history as natural constituencies of the innovation process. It also examines the dynamic and crucial role played by the state in the formation of innovative business enterprises. This book will be of interest to academic researchers in the fields of innovation and economic development.

Book Synopsis Law and Reflexive Politics by : E.A. Christodoulidis
Download or read book Law and Reflexive Politics written by E.A. Christodoulidis and published by Springer Science & Business Media. This book was released on 2013-12-01 with total page 403 pages. Available in PDF, EPUB and Kindle. Book excerpt: Law is the great concealer; and law is everywhere. Or so claimed Marxists once upon a time. [Law] was imbricated within the mode of production and productive relations themselves . . . it intruded brusquely within alien categories, re-appearing bewigged and gowned in the form of ideology; . . . it was an arm of politics and politics was one of its arms; it was an academic discipline, subjected to the rigour of its own autonomous logic, it contributed to the definition of the self-identity of both the rulers 1 and the ruled. Does the old critique of domination still hold any sway? Apparently not. Or so even scholars of the far Left keep reminding us in their eagerness to embrace law and proclaim their allegiance to the new constitutional politics of civil society. Old Marxists now describe popular sovereignty as 'co-original' with, and democracy 'internally linked' to 2 constitutional rights and find it hard to remember what it was they once disagreed with liberals about. No tension left between emancipatory politics and oppressive law; instead we have reciprocal constitution, simultaneous realisation. In the Left's embracing of the new constitutionalisms its old critique of law - the critique of the law's concealment of class inequality, class conflict and class action - is left behind.
Book Synopsis Power, Procedure, Participation and Legitimacy in Global Sustainability Norms by : Karin Buhmann
Download or read book Power, Procedure, Participation and Legitimacy in Global Sustainability Norms written by Karin Buhmann and published by Routledge. This book was released on 2017-08-02 with total page 200 pages. Available in PDF, EPUB and Kindle. Book excerpt: Globalisation of the market, law and politics contributes to a diversity of transnational sustainability problems whose solutions exceed the territorial jurisdictional limits of nation states in which their effects are generated or occur. The rise of the business sector as a powerful global actor with a claim to participation and potential contributions as well as adverse impacts sustainability complicates the regulatory challenge. Recent decades’ efforts to govern transitions towards sustainability through public or hybrid regulation display mixed records of support and results. In combination, these issues highlight the need for insights on what conditions multi-stakeholder regulation for a process that balances stakeholder power and delivers results perceived as legitimate by participants and broader society. This book responds to that need. Based on empirical experience on public-private regulation of global sustainability concerns and theoretical perspectives on transnational regulation, the book proposes a new theory on collaborative regulation. This theory sets out a procedural approach for multi-stakeholder regulation of global sustainability issues in a global legal and political order to provide for legitimacy of process and results. It takes account of the claims to participation of the private sector as well as civil society organisations and the need to balance power disparities.
Book Synopsis Company Law and Sustainability by : Beate Sjåfjell
Download or read book Company Law and Sustainability written by Beate Sjåfjell and published by Cambridge University Press. This book was released on 2015-05-21 with total page 373 pages. Available in PDF, EPUB and Kindle. Book excerpt: This investigation of the barriers to and opportunities for promoting environmental sustainability in company law provides an in-depth comparative analysis of company law regimes across the world. The social norm of shareholder primacy is the greatest barrier preventing progress, and it also helps explain why voluntary action by companies and investors is insufficient. By deconstructing the myth that shareholder primacy has a legal basis and challenging the economic postulates on which mainstream corporate governance debate is based, Company Law and Sustainability reveals a surprisingly large unexplored potential within current company law regimes for companies to reorient themselves towards sustainability. It also suggests possible methods of reforming the existing legal infrastructure for companies and provides an important contribution to the broader debate on how to achieve sustainability.
