The taxpayer was a privately held parent company to various international insurance and financial businesses. It was based in Bermuda but was controlled by US citizens. In 2004, Starr relocated to Ireland where it paid a reduced rate of withholding tax on dividends under the Ireland-US double taxation convention. In 2006, Starr moved again to Switzerland and sought to reduce its dividend tax rate under the Swiss-US treaty. Starr did not automatically qualify for benefits under the tests under art 22 of the treaty and requested discretionary relief under art 22(6). Such relief could only be granted following consultation between the two Competent Authorities. The US Competent Authority denied the request saying that at least one of the principle purposes of moving to Switzerland had been to obtain benefits under the Swiss-US treaty. Starr then claimed a tax refund of some $38 million and filed a tax refund suit and applied for judicial review of the decision to deny benefits under the treaty. The US District Court dismissed the taxpayer's claim that the US government violated the treaty by failing to consult with the Swiss Competent Authority and considered that the tax refund application raised non-justiciable political questions. The taxpayer appealed to the Court of Appeals. The Court of Appeals has now reversed the decision of the District Court.
