Schon Polybios konstatierte dabei nicht allein den naturhaft erschei nenden Wandel, sondern er fragte nach Konstanten im Wandel. Machte er da bei das verlorene Bewu6tsein von den verderblichen Lebensverhaltnissen in schlechten Staaten als Voraussetzung fur den Niedergang, aber auch die Herauf kunft besserer Verfassungsordnungen aus, so war er doch in der Lage, Kriterien einer guten Verfassung zu nennen: Gleichheit und Redefreiheit. Die Alternative einer derart gebundenen und gerechtfertigten Ordnung erblickte er im Faust recht. Die sozialdemokratische Verfassungstheorie ist in diesem Spannungsverhalt nis von sozialen und biirgerlichen Freiheiten und Rechten, aber auch von politi scher Gewalt - die nicht von der sozialdemokratischen Partei und ihren Anhan gem ausging - entwickelt worden. Der Verfolgung unter Bismarcks Ausnahme gesetz in den Jahren 1878 und 1890 folgte die Unterdruckung unter Hitler 1933 bis 1945, die sozialdemokratische Handlungsmoglichkeiten nach der Be freiung vom Nationalsozialismus auf den westlichen Teil Deutschlands be schriinkte. Sozialdemokratische Verfassungstheorie konnte angesichts dieser Entwicklungen nur in der konkreten Auseinandersetzung mit den jeweiligen politischen Verhiiltnissen und der Reflexion iiber Geschichte entwickelt werden; sie wurde nicht nur aus theoretischen Grundanschauungen abgeleitet, sondern reflektierte Geschichte: Verfolgung, Unterdruckung, soziale Probleme Es ist deshalb nicht iiberraschend, daB die sozialdemokratische Verfassungs theorie nicht allein das Ordnungsproblem behandelte: Verfassung als Bauplan eines Regierungssystems, sondern das Grundproblem von Freiheit und Ordnung, von Schutz und Wandel, von Ziel und Zweck reflektierte.
