Book excerpt: Using more than a decade's worth of fieldwork in South Sudan, Clémence Pinaud here explores the relationship between predatory wealth accumulation, state formation, and a form of racism—extreme ethnic group entitlement—that has the potential to result in genocide. War and Genocide in South Sudan traces the rise of a predatory state during civil war in southern Sudan and its transformation into a violent Dinka ethnocracy after the region's formal independence. That new state, Pinaud argues, waged genocide against non-Dinka civilians in 2013-2017. During a civil war that wrecked the region between 1983 and 2005, the predominantly Dinka Sudan People's Liberation Army (SPLA) practiced ethnically exclusive and predatory wealth accumulation. Its actions fostered extreme group entitlement and profoundly shaped the rebel state. Ethnic group entitlement eventually grew into an ideology of ethnic supremacy. After that war ended, the semi-autonomous state turned into a violent and predatory ethnocracy—a process accelerated by independence in 2011. The rise of exclusionary nationalism, a new security landscape, and inter-ethnic political competition contributed to the start of a new round of civil war in 2013, in which the recently founded state unleashed violence against nearly all non-Dinka ethnic groups. Pinaud investigates three campaigns waged by the South Sudan government in 2013–2017 and concludes they were genocidal—they sought to destroy non-Dinka target groups. She demonstrates how the perpetrators' sense of group entitlement culminated in land-grabs that amounted to a genocidal conquest echoing the imperialist origins of modern genocides. The process leading to independence was driven by the Sudan Peoples' Liberation Movement, a primarily Southern rebel force and political movement intent on bringing about the reformed unity of the whole Sudan. Through the Comprehensive Peace Agreement of 2005, a six year peace process unfolded in the form of an interim period premised upon 'making unity attractive' for the Sudan. This is the case not only regarding treaty law and state responsibility, but also with respect to matters such as state succession, the international minimum standard, and state immunity, all of which feature regularly in investor-state arbitration. Yet, although general international law issues arise in almost every investment case and often require extensive research, no systematic exploration of the relationship between the two exists. This Commentary is the first to fill this gap, providing a comprehensive treatment of the role of general international law in international investment law. It engages in detail with central matters of general international law, including in the practice of investment arbitration tribunals, moving beyond existing works which focus solely on procedural and institutional provisions. The Commentary's forty-six chapters do not focus on a single source or subject. Instead, each concentrates on a specific, relevant article from a particular source of public law - such as the Vienna Convention on the Law of Treaties (1969) or the International Law Commission's Articles on the Responsibility of States for Internationally Wrongful Acts (2001), among others. In addition a WHO questions-and-answers guidance document on the evaluation of similar biotherapeutic product (SBPs) was also adopted with the Committee recommending that it be posted on the WHO website. Subsequent sections of the report provide information on the current status proposed development and establishment of international reference materials in the areas of: antibiotics; blood products and related substances; cellular and gene therapies; in vitro diagnostics; standards for use in public health emergencies; and vaccines and related substances. A series of annexes are then presented which include an updated list of all WHO Recommendations Guidelines and other documents on biological substances used in medicine (Annex 1). The above three WHO documents adopted for publication on the advice of the Committee are then presented as part of this report (Annexes 2-4). Finally all additions and discontinuations made during the 2018 meeting to the list of International Standards Reference Reagents and Reference Panels for biological substances maintained by WHO are summarized in Annex 5. Spanning South Sudan's nation-building struggle from its inception up until the current civil war, this book challenges the notion that the continued violence of this process can be reduced to either identity difference or the fault of individual leaders. Rather, it uses the leadership process to understand the complex progressions and relationships that have characterised South Sudan's nation-building trajectory. The book argues that the core driving force behind the current conflict in South Sudan can be found not in ethnicity, the “resource curse” or power struggle, but in a set of destructive relationships that have fueled violence and oppression in the country for the better part of a century.
