In The Most Dangerous Branch Robert Martin argues that the court has changed from acting on principles to acting on values, allowing it to impose its own personal preferences. As judges are not elected, Martin argues, they should not be permitted to set the social agenda, amend legislation, amend the constitution, or attack democracy and democratic institutions.The Most Dangerous Branch shows that the Supreme Court has done exactly this in dealing with abortion, assisted suicide, homosexuality, and Quebec secession through decisions that were guided not by reasoned understanding of the principles of law but by the values of judges - values they, as unelected representatives of the Canadian state, had no right to impose. Martin shows that Supreme Court judges have adopted an orthodoxy of moral relativism and identity politics that he likens to a secular state religion. This orthodoxy denies the possibility of objectivity about human endeavour and regards social reality as "constructed." While purporting to be concerned with the plight of the oppressed, it is actually based on profound condescension. Martin believes that the "theocracy" which dominates the Supreme Court of Canada is subverting democracy and the rule of law. In The Most Dangerous Branch he calls on Canadians to take back their country.

All chapters have been revised, and there are significant revisions in Directories, Yearbooks, and Collections; Miscellaneous Sources; Core Periodicals; Societies and Associations; and Research Centers and Archives. The second edition has 789 entries. The third edition contains almost 1,000 entries. James Carey of Columbia University, who provided the foreword for the first two editions, has updated his foreword for this edition.

Book excerpt: The tension between national security and freedom of expression and information is both acute and multifaceted. Without national security, basic human rights are always at risk. On the other hand, the tendency of governing elites to confuse `the life of the nation' with their own survival has often resulted in excessive restrictions on expression and information, as well as other fundamental rights. A proper balance between secrecy and liberty requires a vigilant press and an independent judiciary. It also requires greater clarity than currently exists as to how competing rights and interests should be weighed. This book addresses that gap. Its centerpiece is a set of Principles drafted by a group of international and national law experts, many of whom contributed chapters, to guide governments, courts and international bodies in how to strike a proper balance. The Principles have been widely endorsed, among others by United Nations experts on freedom of expression and independence of judges and lawyers.
