Para tanto, faz-se inicialmente uma conceituação de sociedade civil, identificando suas múltiplas formas organizativas - ONGs, movimentos sociais e outros - e explicitando suas principais características no mundo moderno. Após, busca-se identificar qual o ambiente ideal no qual essa sociedade civil modernizada, situada estrategicamente numa esfera autônoma entre o mercado e o Estado, pode atuar para defender seus valores contra a expansão da razão instrumental, e chega-se à conclusão de que este é o da democracia participativa, que busca revitalizar a democracia moderna por meio da participação social nos processos políticos de tomada de decisão. Para justificar a participação social na gestão ambiental, analisa-se a multidimensionalidade da questão ambiental, desmistificando sua natureza técnica e demonstrando o seu caráter eminentemente político. Fixadas as bases teóricas para a participação, analisa-se como o direito brasileiro vem tratando desse tema, buscando-se princípios jurídicos na doutrina e no direito internacional, para então descer a uma análise mais detida da legislação nacional. Após breve análise de alguns dos principais instrumentos jurídicos de aplicação do direito à participação - conselhos de meio ambiente, comitês de bacia hidrográfica, ação civil pública e outros - anal.

Book excerpt: In recent decades there has been an exponential increase in large hydroelectric plants in Brazil, especially in the Amazon region. These large hydraulic structures impact the environment and the lives of people living in the places where they settle and require a special type of water governance. The dictatorial regime (1964-1985) created a "standard" for the construction of these great structures, through an institutional and legal framework, which benefited the Brazilian business elite but also, through the creation of a popular imagination, which shows itself lasting progress on the country's progress and development. The suspension of security, the fragility of institutional environmental structures, the disrespect for indigenous reserves, the lack of clarity about the concept of "affected population" and the non-payment of fair compensation were identified as one of the main challenges for a democratic water governance in the country. In the late 1970s, the Dam-Affected Movement (MAB) began its organization and is also studied in this research. The study is an important and insightful academic contribution to the understanding of the main bottlenecks of effective water governance in Brazil.

It documents how the history of frontier expansion and environmental struggle in the region is linked to Brazil’s position in an evolving capitalist world-economy. It is shown how Brazil’s effort to become a developed country has led successive Brazilian governments to devise development projects for Amazonia. The author analyses how globalization has led to the expansion of international commodity chains in the region, particularly for mineral ores, soybeans and beef. He shows how environmental organizations have politicized these commodity chains as weapons of conservation, through boycotting certain products, while other pro-development groups within Brazil claim that such organizations threaten Brazil's sovereignty over its own resources.
