Available in PDF, EPUB and Kindle. Book excerpt: Under the direction of the Communist Party of China (CPC), key legal challenges have been identified which will shape the modernization of China’s legal and administrative institutions. An increasingly complex set of legal actors now seek to influence this development, including securities regulators, bankers, accountants, lawyers, local-level mediators and some of China’s newly rich. Whilst the rising middle class wants to voice its interests and concerns, the CPC strives to maintain its leading role. This book provides a critical appraisal of China’s deepening socialist rule of law and looks ahead to the implications of the domestic reforms for the international legal domain. With contributions from leading Chinese law specialists, it draws on specific illustrations from judicial reform, constitutional law, procedural law, anti-corruption, property law and urban development, socio-economic dispute resolution and Chinese macro-economics. The book questions how China’s domestic law reforms will impact international legal systems, and how international law can be used in managing key regional and bilateral relationships and in dispute resolution, such as in the South China Sea and international trade. Assessing the state and direction of domestic law reform and including debates around the legal implications of some of China’s most pressing foreign policy challenges today, this volume will be of huge interest to students, scholars and practitioners with an interest in Asia law, Chinese law, international law, comparative law and law reform.

Book excerpt: The polar ice caps are melting, hurricanes and droughts ravish the planet, and the earth's population is threatened by catastrophic climate change. Millions of American jobs have been sent overseas and aren't coming back. Young African-American men make up the majority of America's prison population. Half of the American population are poor or near poor, living precariously on the brink, while the top one percent own as much as the bottom eighty. Government police-state spying on its citizens is pervasive. Consequently, as former President Jimmy Carter has said, "we have no functioning democracy." Imagine: Living In a Socialist U.S.A., edited by Francis Goldin, Debby Smith, and Michael Steven Smith, is at once an indictment of American capitalism as the root cause of our spreading dystopia and a cri de coeur for what life could be like in the United States if we had economic as well as a real political democracy. This anthology features essays by revolutionary thinkers, activists, and artists—including Academy Award-winning filmmaker Michael Moore, civil rights activist Angela Davis, incarcerated journalist Mumia Abu Jamal, and economist Rick Wolff— addressing various aspects of a new society and, crucially, how to get from where we are now to where we want to be, living in a society that is truly fair and just.

Available in PDF, EPUB and Kindle. Book excerpt: The immense process of economic and social transformation currently underway in China and Vietnam is well known and extensively documented. However, less attention has been devoted to the process of Chinese and Vietnamese legal change which is nonetheless critical for the future politics, society and economy of these two countries. In a unique comparative approach that brings together indigenous and international experts, Asian Socialism and Legal Change analyzes recent developments in the legal sphere in China and Vietnam. This book presents the diversity and dynamism of this process in China and Vietnam-the impact of socialism, constitutionalism and Confucianism on legal development; responses to change among enterprises and educational and legal institutions; conflicts between change led centrally and locally; and international influences on domestic legal institutions. Core socialist ideas continue to shape society, but have been adapted to local contexts and needs, in some areas more radically than in others. This book is the first systematic analysis of legal change in transitional economies.

This question is one of the great enduring puzzles of American political development, and it lies at the heart of a fundamental debate about the nature of American society. Tackling this debate head-on, Robin Archer puts forward a new explanation for why there is no American labor party--an explanation that suggests that much of the conventional wisdom about "American exceptionalism" is untenable. Conventional explanations rely on comparison with Europe. Archer challenges these explanations by comparing the United States with its most similar New World counterpart--Australia. This comparison is particularly revealing, not only because the United States and Australia share many fundamental historical, political, and social characteristics, but also because Australian unions established a labor party in the late nineteenth century, just when American unions, against a common backdrop of industrial defeat and depression, came closest to doing something similar. Archer examines each of the factors that could help explain the American outcome, and his systematic comparison yields unexpected conclusions. He argues that prosperity, democracy, liberalism, and racial hostility often promoted the very changes they are said to have obstructed. And he shows that it was not these characteristics that left the United States without a labor party, but, rather, the powerful impact of repression, religion, and political sectarianism.

Available in PDF, EPUB and Kindle. Book excerpt: Socialism has been an influential force for social change for almost two centuries. Its philosophy and ideology have inspired millions while simultaneously arousing fear and revulsion in its enemies. Having emerged after the French Revolution in the effort to build upon and develop the egalitarian ideas of the Enlightenment, socialism has taken many forms. It has, furthermore, sometimes been manipulated and reformulated by opportunists who have built authoritarianism and totalitarian dictatorships in its name. Opponents seize on such examples to frighten away people who may otherwise have found socialism attractive. Socialism has survived such criticism and misrepresentation as its core principles have struck a chord with generations of people concerned with social justice. Historical Dictionary of Socialism, Fourth Edition contains a chronology, an introduction, a glossary, and an extensive bibliography. The dictionary section has over 500 cross-referenced entries on activists, politicians, political thinkers, political parties and organizations, and key topics, concepts, and aspects of socialist theory. This book is an excellent access point for students, researchers, and anyone wanting to know more about socialism.
