O livro traz uma reflexão acerca dos atuais dispositivos processuais penais e de onde eles surgiram no tempo e espaço, já que muitos paradigmas permanecem em vigor, ainda que a sociedade tenha uma visão de mundo totalmente diferente. O Direito não é uma ciência exata e se transforma ao longo do tempo, na medida em que a comunidade evolui. Diante disso, a finalidade principal é a de demonstrar ao leitor que é possível que a comunidade jurídica atual sofra julgamentos futuros perante a evolução do direito da época e talvez entendam que, na qualidade de operadores do direito, percebam que as atuais práticas jurídicas possam ser consideradas obscuras ou obsoletas. O que o futuro reserva não há como saber. O que cabe ao estudioso é analisar o passado para que eventuais erros não se repitam em detrimento da sociedade, das garantias individuais e coletivas, bem como de direitos já adquiridos com a evolução legislativa, em especial penal e processual penal, erguendo-se nesse ponto a importância do estudo da história do direito.
