Als Einstieg in die Thematik wird zunächst untersucht, was unter sexueller Belästigung am Arbeitsplatz zu verstehen ist und wie das Gesetz die Begrifflichkeit definiert. Dafür ist es im weiteren Verlauf unerlässlich, die differenzierten Belästigungskonstellationen und ihre rechtlichen Hintergründe zu beleuchten. Anschließend werden mögliche Auswirkungen und Rechtsfolgen von sexueller Belästigung näher erläutert. Unterschieden werden hier drei Blickwinkel: Zum einen, welche Ansprüche der Geschädigte gegenüber dem Arbeitgeber hat, darüber hinaus, welche Rechtsbeziehungen zwischen Arbeitgeber- und Täterseite entstehen könnten und als dritter Punkt, welche Auswirkungen sich für den Betrieb selbst ergeben können. Von besonderem Interesse sind auch die differenzierten Sanktionsformen und ihre Voraussetzungen. Im nächsten Abschnitt werden diverse Gerichtsurteile analysiert, die sexuelle Belästigung am Arbeitsplatz zum Kern haben. Dabei ist besonderes Augenmerk auf die verschiedenen Ausgangssituationen und die Reaktion des jeweiligen Arbeitgebers zu legen. Den Schwerpunkt der vorliegenden Thesis bildet schließlich ein allgemeiner Maßnahmenplan als Entscheidungshilfe für den Arbeitgeber, wenn sexuelle Belästigung am Arbeitsplatz tatsächlich aufgetreten ist. Denn nicht jede Benachteiligung stellt eine sexuelle Belästigung dar und nicht jede sexuelle Belästigung kann sofort mit Kündigung geahndet werden. Zuletzt sind die analysierten Ergebnisse im Licht der Frage zu betrachten, welchen Weg ein Arbeitgeber bei den zuvor herausgestellten Belästigungskonstellationen einschlagen sollte. Diese Bachelorarbeit zeigt zunächst die theoretische Umrahmung der Thematik, um dann einen Einstieg in die praktische Umsetzung der Reaktionsmöglichkeiten einzuleiten. Wie man mit diesem Lösungsansatz als Arbeitgeber einen klaren Weg einschlagen und sich für das Wohl seiner Arbeitnehmer einsetzen kann, bildet den Abschluss und auch das Ergebnis dieser rechtswissenschaftlichen Arbeit.

Dies gilt insbesondere bei sexueller Belästigung, da die bestehenden straf- und öffentlich-rechtlichen Bestimmungen sowie das speziell hierzu erlassene Beschäftigtenschutzgesetz allein einen hinreichenden Schutz der belästigten Arbeitnehmer nicht gewährleisten können.Als Anspruchsgrundlagen stehen dem belästigten Opfer § 823 Abs. 1 BGB wegen Verletzung des allgemeinen Persönlichkeitsrechts, § 823 Abs. 2 BGB in Verbindung mit dem Beschäftigtenschutzgesetz sowie das Rechtsinstitut der positiven Vertragsverletzung zur Verfügung. Hierbei haftet der Arbeitgeber nicht nur, wenn er selbst oder ein Vorgesetzter sexuell belästigt hat, sondern unter Umständen auch bei Belästigung durch Kollegen des Opfers.Neben dem Ersatz seines materiellen Schadens kann das Opfer in schweren Fällen auch eine Geldentschädigung wegen immaterieller Schäden verlangen. Hier wird der Gedanke der zivilrechtlichen Prävention besonders relevant. Unter diesem Gesichtspunkt sind bei der Bemessung der Höhe der Geldentschädigung folgende Faktoren zu berücksichtigen: die Intensität des Eingriffs in das Persönlichkeitsrecht des Opfers, der Grad des Verschuldens des Arbeitgebers sowie die finanzielle Situation des Arbeitgebers.

Die Anzahl der Betroffenen dürfte demnach in der Realität höher sein, da sexuelle Belästigung mit "so einem starken Tabu belegt" ist, wie kaum ein anderes Thema in Unternehmen.
