"El análisis económico del derecho supone que las personas poseen creencias correctas y que escogen racionalmente. ¿Pero qué pasa si no es así? ¿Cómo debería cambiar el análisis económico del derecho?". (Richard Thaler, 2016). Estas tres citas ilustran diferentes etapas en los debates sobre la definición, función y evolución del análisis económico del derecho (AED) durante las últimas cuatro décadas. También evidencian que no existe una única forma de "hacer" AED. Así, este libro se inscribe en este contexto, y en la primera parte intenta responder críticamente a preguntas como: ¿cuál es la definición y los fundamentos del AED? ¿Cuáles son las diferencias con el derecho económico? ¿Cómo puede la economía justificar e imponer límites a la intervención estatal cuando se materializa en normas jurídicas? ¿Qué es la economía en el derecho de propiedad y cuáles son sus diferencias con el "derecho" del derecho de propiedad?
