Book excerpt: The multifaceted career of John Thelwall (1764-1834)—poet, novelist, playwright, journalist, politician, scientist—is the lens through which we are offered here a new look at the phenomenon of British Jacobinism, long distorted by the critical view of it as intellectually weak bequeathed to us by Coleridge and Wordsworth, once Jacobins themselves. This book, the first on Thelwall in almost one hundred years, combines literary analysis and historical description to show how this innovative political activist remained true to his radicalism while adapting his methods in the face of the anti-Jacobin reaction that Paine's The Rights of Man helped set off. The three parts of the book set Thelwall's achievements and challenges in the political and literary context of his times. Part One, "Jacobin(s) Writing," focuses on the most essential aspects, ideologically and formally, of the insurgent writing of the 1790s to which Thelwall contributed. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. Book excerpt: The liberal use of the sedition law in recent years, mainly by state governments intolerant of dissenting opinion, has provoked justified controversy. After some prominent individuals fell afoul of the law, activists, journalists, lawyers, and jurists took up cudgels on behalf of the victims, and demanded that the law be scrapped, as it belongs to the colonial era. The Supreme Court of India, in May 2022, admitted a host of petitions challenging the law as upheld in Kedar Nath Singh vs Union of India, 1961. The author believes that the fundamental right to free speech is a non-negotiable right in a democratic country, but the law is relevant for countering threats to national security and sovereignty. Examining the trajectory of the sedition law from its introduction by the British colonial power and its subsequent rejection by the Constituent Assembly of India, the author observes that the statute had to be hastily restored by the Provisional Parliament to cope with the challenges posed by communal rioting in many parts of the country, several years after independence. As such, it is pertinent in times of crisis. The current law undeniably needs safeguards against political misuse, but deserves a place on the statute. In May 1798, after Congress released the XYZ Affair dispatches to the public, a raucous crowd took to the streets of Philadelphia. Some gathered to pledge their support for the government of President John Adams, others to express their disdain for his policies. Violence, both physical and political, threatened the safety of the city and the Union itself. To combat the chaos and protect the nation from both external and internal threats, the Federalists swiftly enacted the Alien and Sedition Acts.
