Caley Horan’s remarkable book charts the social and economic power of private insurers since 1945, arguing that these institutions’ actuarial practices played a crucial and unexplored role in insinuating the social, political, and economic frameworks of neoliberalism into everyday life. In the area of privatization of security functions, attention by academics and policy makers tends to focus on the activities of private military and security companies, especially in the context of armed conflicts, and their impact on human rights and post-conflict stability and reconstruction. The first edited volume emerging from New York University School of Law's Institute for International Justice project on private military and security companies, From Mercenaries to Market: The Rise and Regulation of Private Military Companies broadened this debate to situate the private military phenomenon in the context of moves towards the regulation of activities through market and non-market mechanisms. Where that first volume looked at the emerging market for use of force, this second volume looks at the transformations in the nature of state authority. Drawing on insights from work on privatization, regulation, and accountability in the emerging field of global administrative law, the book examines private military and security companies through the wider lens of private actors performing public functions. In the past two decades, the responsibilities delegated to such actors - especially but not only in the United States - have grown exponentially. The central question of this volume is whether there should be any limits on government capacity to outsource traditionally "public" functions. Can and should a government put out to private tender the fulfilment of military, intelligence, and prison services? Can and should it transfer control of utilities essential to life, such as the supply of water? While privatization is not a new concept for the US military, the public debate on military privatization is limited to legal, financial, and pragmatic concerns. A critical assessment of the ethical dimensions of military privatization in general is missing. More specifically, in light of the increased reliance upon armed contractors, it must be asked whether it is morally permissible for governments to employ them at all. To this end, this book explores four areas that highlight the ethical implications of using armed contractors: how armed contractors are distinct from soldiers and mercenaries; the commodification of force; the belligerent equality of combatants; and the impact of armed contractors on the professional military. While some take an absolutist position, wanting to bar the use of private military altogether, this book reveals how these absolutist arguments are problematic and highlights that there are circumstances where turning to private force may be the only option. Recognising that outsourcing force will continue, this book thus proposes some changes to account for the problems of commodification, belligerent equality, and the challenge to the military profession. The outbreak of Somali piracy that started in 2008 has prompted a similar revolution in maritime security. Private security companies began operating armed escort vessels to protect merchant shipping against pirates off the Horn of Africa. Private Anti-Piracy Navies is intended to provide a contextualized understanding of the historical origins, current state, and future prospects of this fast-changing sector. Centuries ago, the British East India Company used a private navy against piracy in the same waters with much success. Yet since then, international law has evolved to more tightly regulate the use of force by civilians, and to afford greater protections to suspected pirates. Thus, the development of what are in effect private warships has presented numerous legal and regulatory problems. How can the companies that operate these vessels be effectively licensed? Under what circumstances should they be allowed to use lethal force? This book explains how regulators in industry and government have attempted to answer such questions, and highlights the remaining areas of uncertainty. It also addresses the economic factors that drive the struggle between pirates and anti-piracy forces. Of equal concern are operational considerations such as defensive tactics, logistics, and rules of engagement. Security companies must carefully balance rights concerns against the need to defend ships effectively. Partly due to the contribution of private security, piracy in the Indian Ocean has dropped significantly over the past two years, leading to widespread overconfidence. Governments under severe budget pressure may withdraw their naval task forces from the region prematurely, leading to a resurgence of Somali piracy. At the same time, pirates are wreaking havoc in the Gulf of Guinea off West Africa. The book concludes with an assessment of private naval forces’ prospects in these conflicts over the short term, as well as the implications for wider naval privatization in the long run.
