Book excerpt: La disciplina in materia di sanzioni amministrative è stata a lungo caratterizzata da un quadro normativo estremamente frammentato e disorganico, in cui hanno convissuto tipi di sanzioni molto diverse tra loro, quanto ad “origine” e specifiche finalità. Per comprendere la complessità di tale sistema è sufficiente osservare come esso si componga di una molteplicità di fonti normative diverse, sia dal punto di vista della loro tipologia, sia con riferimento al loro oggetto. Sanzioni amministrative, infatti, sono state nel tempo disciplinate da leggi speciali o di settore, nell'ambito di iniziative di depenalizzazione, di portata più o meno ampia, e – in modo assai diffuso – da leggi regionali, sia di carattere generale, che settoriale. Anche nel momento in cui il legislatore ha ritenuto di dettare una disciplina di carattere generale in materia di sanzioni amministrative, con la l. 24 novembre 1981, n. 689, lo ha fatto nell'ambito di una operazione normativa dotata di una propria specifica e diversa finalità, ovvero l'introduzione di «Modifiche al sistema penale» mediante depenalizzazione di numerose fattispecie di reato e che si è tradotta, nei casi individuati dalla legge stessa, nella sostituzione della sanzione amministrativa pecuniaria alla multa o all'ammenda precedentemente previste.

Il seguito del libro si sviluppa con l’esame delle problematiche concernenti il quadro della tutela giurisdizionale, affrontando le questioni della individuazione del giudice competente, della determinazione dei soggetti legittimati all’opposizione con evidenziazione degli inerenti motivi deducibili, per passare, quindi, alla valorizzazione delle sequenze caratterizzanti il giudizio di opposizione, con particolare riguardo alla fase istruttoria (e alla correlata indicazione dei mezzi di prova ammissibili e della relativa efficacia) e a quella decisoria. L’ultimo capitolo non poteva che essere destinato alla illustrazione della disciplina dei mezzi di impugnazione e alle tematiche riguardanti il giudicato. Il volume è, infine, integrato, in appendice, con un’accurata selezione dei testi normativi concretamente incidenti sulla vasta materia delle sanzioni amministrative. Il testo, organicamente approntato, rappresenta uno strumento utile, se non propriamente indispensabile, nella complessa materia delle violazioni e delle sanzioni amministrative, che può essere adoperato sia dagli operatori di diritto del settore (avvocati e giudici di pace) che dai privati che possono trovarsi nella condizione di doversi cimentare con le relative questioni, spesso di non facile approccio e risoluzione. In that report, Defining Death: Medical, Legal and Ethical Issues in the Determination of Death, the President's Commission forwarded a uni form determination of death act, which laid heavy accent on the signifi cance of the brain stem in determining whether an individual is alive or dead: An individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions, or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead. A determination of death must be made in accordance with accepted medical standards ([1], p. 2). The plausibility of these criteria is undermined as soon as one confronts the question of the level of treatment that ought to be provided to human bodies that have permanently lost consciousness but whose brain stems are still functioning.
