Available in PDF, EPUB and Kindle. Book excerpt: Among restrictions on imports, safeguard measures are particularly controversial in that they are invoked in the absence of any unfair trade practice. Safeguards interfere substantially with the normal stream of trade, and their improper application undermines the objectives of the WTO. Recent WTO cases have brought the attention of trade lawyers to the absence of comprehensive materials on this complex subject, and highlighted the need for a reliable guide to the WTO rules on safeguards. Dr. Y.S. Lee, perhaps the world's foremost authority on safeguard measures, has provided such a guide, here updated in its second edition. Readers may expect from this book comprehensive coverage on safeguards to date with legal analysis of the important issues in the interpretation and application of the current rules on safeguards. The author also proposes modifications to enhance and clarify the discipline of safeguards. The crucial issues raised include the following: economic and political justifications of safeguards;applicability of GATT Article XIX;interpretation and application of the Agreement on Safeguards, including non-discriminatory application of safeguards and justification of safeguards-in-response;transitional product-specific safeguard measures against China; andemergency safeguards to trade in services. The focus of the book is on the WTO Agreement on Safeguards, as interpreted by WTO Panel and Appellate Body reports in key cases, including Korea Dairy Products, Argentina Footwear, United States Wheat Glutten, United States Lamb Meat, Chile Price Band System, United States Line Pipe and United States Steel Products. Dr. Lee summarizes the various key findings and provides lucid and well-balanced analysis of these reports. Other WTO rules considered include GATT Articles XIX, XII, and XVIII; the Understanding on Balance of Payments of the GATT 1994; the Agreement on Agriculture; the Agreement on Textile and Clothing; Article XII of the General Agreement on Trade in Services (GATS); and the Protocol on the Accession of the People's Republic of China. Safeguard Measures in World Trade comes at a time when safeguard measures continue to mount in various parts of the world and a possible domino effect can destabilize the international trading system. It will be of inestimable value to government officials, trade lawyers, international business people, and academics in trade law and related fields.

Book excerpt: This study analyses the risk assessment and socio-environmental safeguard procedures associated with the financing of pulp mill projects. The type and cost of the fibre source is clearly key to the economic competitiveness of any pulp mill. Nevertheless, investment institutions often carry out only limited assessment of the fibre source of the proposed mill. Although a growing number of financial institutions have adopted policies to employ social and environmental safeguard screening for investments in developing countries and transitioning economies, the scope of such screenings is in fact quite limited and they are often implemented ineffectively. Book excerpt: Copy the following link for free access to the first chapter of this title: http://www.springerlink.com/content/j23468h304310755/fulltext.pdf This book is a warning. It aims to warn policy-makers, industry, academia, civil society organisations, the media and the public about the threats and vulnerabilities facing our privacy, identity, trust, security and inclusion in the rapidly approaching world of ambient intelligence (AmI). In the near future, every manufactured product – our clothes, money, appliances, the paint on our walls, the carpets on our floors, our cars, everything – will be embedded with intelligence, networks of tiny sensors and actuators, which some have termed “smart dust”. The AmI world is not far off. We already have surveillance systems, biometrics, personal communicators, machine learning and more. AmI will provide personalised services – and know more about us – on a scale dwarfing anything hitherto available. In the AmI vision, ubiquitous computing, communications and interfaces converge and adapt to the user. AmI promises greater user-friendliness in an environment capable of recognising and responding to the presence of different individuals in a seamless, unobtrusive and often invisible way. While most stakeholders paint the promise of AmI in sunny colours, there is a dark side to AmI. This book aims to illustrate the threats and vulnerabilities by means of four “dark scenarios”. The authors set out a structured methodology for analysing the four scenarios, and then identify safeguards to counter the foreseen threats and vulnerabilities. They make recommendations to policy-makers and other stakeholders about what they can do to maximise the benefits from ambient intelligence and minimise the negative consequences.

Available in PDF, EPUB and Kindle. Book excerpt: Scripted and Staged: Behind the scenes of China's forced televised confessions is a groundbreaking study that gives the reader a backstage pass to China's production and broadcast of coerced confessions by human rights lawyers, journalists, activists and even foreigners. These forced confessions, more high-profile since Chinese President Xi Jinping came to power, are reminiscent of Mao-era public struggle sessions and represent such a transgression of human rights that they are only practiced today by regimes such as North Korea and Iran. Using in-depth interviews, first person testimonies, and analysis of hours of broadcast confessions, Scripted and Staged exposes how the Chinese state uses threats and torture to force victims into confessing, how China's media collaborates in their recording, production, and broadcast across the nation and around the globe. The testimonies in this report expose how the Chinese police carefully choreograph the whole process, from dressing the victim in "costume," to writing the "script," to directing how the confession is delivered, and demanding retake after retake until the propaganda message is ready for airing, all with the collaboration of the media-mostly China's state broadcaster CCTV. And for the many foreign victims, their confessions are often exploited as a tool of Chinese foreign policy.

Available in PDF, EPUB and Kindle. Book excerpt: The role of organizational culture in international efforts to stop the spread of nuclear weapons. In Transforming Nuclear Safeguards Culture, Trevor Findlay investigates the role that organizational culture may play in preventing the spread of nuclear weapons, examining particularly how it affects the nuclear safeguards system of the International Atomic Energy Agency (IAEA), the paramount global organization in the non-proliferation field. Findlay seeks to identify how organizational culture may have contributed to the IAEA’s failure to detect Iraq’s attempts to acquire illicit nuclear capabilities in the decade prior to the 1990 Gulf War and how the agency has sought to change safeguards culture since then. In doing so, he addresses an important piece of the nuclear nonproliferation puzzle: how to ensure that a robust international safeguards system, in perpetuity, might keep non-nuclear states from acquiring such weapons. Findlay, as one of the leading scholars on the IAEA, brings a valuable holistic perspective to his analysis of the agency’s culture. Transforming Nuclear Safeguards Culture will inspire debate about the role of organizational culture in a key international organization—a culture that its member states, leadership, and staff have often sought to ignore or downplay.
