Book excerpt: The most comprehensive introduction in English to the historical background and contemporary state of Russian family law, with extensive reference to judicial practice in Russian courts and in the European Court of Human Rights involving Russian parties. A historical introduction to Russian family law is followed by an account of the general provisions on family relations, the sources of Russian family law, the regulation of marriage, divorce, invalidity, personal rights and duties of spouses, marital property (including the marriage contract), rights and duties of parents and children, alimony, adoption, and other variants of caring for children left without parents. The study closes with a discussion of private international legal aspects of family relations, including the recognition and dissolution of foreign marriages, personal rights and duties of spouses, alimony, adoption, the application of foreign law, and the 1980 Hague Abduction Convention. The full text of the Family Code is appended in the author's translation.

Book excerpt: This book is a detailed treatment of the Russian legal system written especially for English-speaking law students and lawyers. While it is designed primarily as a casebook, extended discussions of the law, numerous citations to original Russian sources, and detailed suggestions for finding these sources on the Internet also make it useful as a reference for scholars specializing in Russian studies and for lawyers who know Russian but not Russian law. The authors have decades of experience following the Russian legal system, with one concentrating on human rights, court procedure, and criminal law and procedure, the other on civil, commercial, and tax law. Chapters cover key aspects of the Russian legal system, including sources of law, the judicial system, the legal profession, constitutional law, individual rights, civil and commercial law, civil procedure, private international law, foreign investment law, criminal procedure, administrative law, and tax law. The book covers major changes in Russian law since the previous edition was published, including more reliance on judicial precedent, increasing the independence of criminal investigators from prosecutors, dealing with abuse of the legal system by corrupt officials to steal businesses from their rightful owners, and closing loopholes in the tax system. The new edition also chronicles the continuing struggle of the European Court of Human Rights and activist Russian lawyers to push Russian law toward international standards.

Available in PDF, EPUB and Kindle. Book excerpt: The Changing Concept of ‘Family’ and Challenges for Domestic Family Law explores the changing concept of ‘family’, with the current social, political, medical and scientific challenges for domestic family law discussed in over 20 European jurisdictions. National reports describe the current law and legal development for ‘horizontal’ (the law of relationships between adults such as marriage, divorce, cohabitation, same-sex relationships), ‘vertical’ (the law governing the relationships between adults and children, such as parentage including artificial reproductive techniques and surrogacy, parental responsibility and adoption) and ‘individual’ (the law of names and recognition of gender identity) family law. They show that, while considerable legal and societal diversity still exists within Europe, family law, in many areas, is developing along similar lines, with a convergence towards a European family law. This book, and the others in the set, will serve as an invaluable resource for anyone interested in family law. It will be of particular use to students and scholars of comparative and international family law, as well as family law practitioners.

Available in PDF, EPUB and Kindle. Book excerpt: This is the first systematic study of civil law in late Imperial Russia. It shows that efforts to adjust family, property, and inheritance law to changing social and economic conditions often became intertwined with attempts to shape society in accordance with competing ideological ideals. Through a restructuring of the family's legal basis, members of the growing educated and professional strata of society in particular endeavoured to promote conflicting conceptions of authority, individuality, gender, and law. Legal reform also served for members of the emerging legal and medical professions as a way to establish their authority, often at the expense of the state administration and the Orthodox Church. Civil law in late Imperial Russia therefore constituted both an important medium for ideological redefinition and a field of battle for those seeking to reform, to overthrow, or to defend the ancien regime. Because this battle extended into the state bureaucracy, legislative change proved extremely difficult. Newly empowered by the 1864 judicial reform, the judiciary responded to legislative inaction by not merely adapting the law, but also by promoting an ideal of the family whose values and principles challenged those underlying the autocracy. Professor Wagner's detailed and scholarly analysis of these issues offers many important insights into cultural attitudes, political structures, and the role of law in late Imperial Russia.

Available in PDF, EPUB and Kindle. Book excerpt: The "International Survey of Family Law," published on behalf of the International Society of Family Law, is the successor to the Annual Survey of Family Law'. It provides information, analysis and comment on recent developments in Family Law across the world on a country-by- country basis. The "Survey" is published annually and its subtitle reflects the calendar year surveyed. Where a country has been regularly surveyed each year, the developments discussed correspond to the year in question. If certain countries have not been surveyed for some years the contributions will usually attempt to cover the intervening period. This applies, for example, in the present volume to the contributions relating to China and Turkey. If countries are being covered for the first time, then more background information will be provided about the state of family law in the country in question. The "Survey" also contains an article dealing with the more significant developments in international law affecting the family.

Book excerpt: Since 2018, Russian law has provided for the concept of a "Hereditary Foundation", a private foundation which can be established after the death of the testator and which can act in a way similar to a common-law trust. It is an option for complex estate planning under Russian law. It has attracted both interest and controversy, with many concerned that the gray area, lacunae, and inconsistencies in the legislation may prevent its effective implementation. The authors analyse the practical challenges in this area and consider whether and how this vehicle fares in competition with the non-Russian structures traditionally used by Russian private clients for estate and succession planning.
