Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this book provides a practical analysis of criminal law in Russia. An introduction presents the necessary background information about the framework and sources of the criminal justice system, and then proceeds to a detailed examination of the grounds for criminal liability, the justification of criminal offences, the defences that diminish or excuse criminal liability, the classification of criminal offences, and the sanctions system. Coverage of criminal procedure focuses on the organization of investigations, pre-trial proceedings, trial stage, and legal remedies. A final part describes the execution of sentences and orders, the prison system, and the extinction of custodial sanctions or sentences. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable resource for criminal lawyers, prosecutors, law enforcement officers, and criminal court judges handling cases connected with Russia. Academics and researchers, as well as the various international organizations in the field, will welcome this very useful guide, and will appreciate its value in the study of comparative criminal law.

Book excerpt: Although criminal justice systems in developed Western countries are much alike in form, structure, and function, the American system is unique. While it is structurally similar to those of other Western countries, the punishments it imposes are often vastly harsher. No other Western country retains capital punishment or regularly employs life-without-parole, three-strikes, or lengthy mandatory minimum sentencing laws. As a result, the U.S. imprisonment rate of nearly 800 per 100,000 residents dwarfs rates elsewhere. The Oxford Handbook of Crime and Criminal Justice is an essential guide to the development and operation of the American criminal justice system. A leading scholar in the field and an experienced editor, Michael Tonry has brought together a team of first-rate scholars to provide an authoritative and comprehensive overview and introduction to this crucial institution. Expertly organized, the various sections of the Handbook explore the American criminal justice system from a variety of perspectives-including its purposes, functions, problems, and priorities-and present analyses of police and policing, juvenile justice, prosecution and sentencing, and community and institutional corrections, making it a complete and unrivaled portrait of how America approaches crime and criminal justice, and giving persuasive answers as to why and how it has developed to what it is today. Accessibly written for a wide audience, the Handbook serves as a definitive reference for scholars and a broad survey for students in criminology and criminal justice.

Available in PDF, EPUB and Kindle. Book excerpt: The Oxford Handbook of Criminal Law reflects the continued transformation of criminal law into a global discipline, providing scholars with a comprehensive international resource, a common point of entry into cutting edge contemporary research and a snapshot of the state and scope of the field. To this end, the Handbook takes a broad approach to its subject matter, disciplinarily, geographically, and systematically. Its contributors include current and future research leaders representing a variety of legal systems, methodologies, areas of expertise, and research agendas. The Handbook is divided into four parts: Approaches & Methods (I), Systems & Methods (II), Aspects & Issues (III), and Contexts & Comparisons (IV). Part I includes essays exploring various methodological approaches to criminal law (such as criminology, feminist studies, and history). Part II provides an overview of systems or models of criminal law, laying the foundation for further inquiry into specific conceptions of criminal law as well as for comparative analysis (such as Islamic, Marxist, and military law). Part III covers the three aspects of the penal process: the definition of norms and principles of liability (substantive criminal law), along with a less detailed treatment of the imposition of norms (criminal procedure) and the infliction of sanctions (prison or corrections law). Contributors consider the basic topics traditionally addressed in scholarship on the general and special parts of the substantive criminal law (such as jurisdiction, mens rea, justifications, and excuses). Part IV places criminal law in context, both domestically and transnationally, by exploring the contrasts between criminal law and other species of law and state power and by investigating criminal law's place in the projects of comparative law, transnational, and international law.

Book excerpt: The Oxford Handbook of Criminal Process surveys the topics and issues in the field of criminal process, including the laws, institutions, and practices of the criminal justice administration. The process begins with arrests or with crime investigation such as searches for evidence. It continues through trial or some alternative form of adjudication such as plea bargaining that may lead to conviction and punishment, and it includes post-conviction events such as appeals and various procedures for addressing miscarriages of justice. Across more than 40 chapters, this Handbook provides a descriptive overview of the subject sufficient to serve as a durable reference source, and more importantly to offer contemporary critical or analytical perspectives on those subjects by leading scholars in the field. Topics covered include history, procedure, investigation, prosecution, evidence, adjudication, and appeal.

Book excerpt: The focus of this report is the 25,431 U.S. citizen federal offenders released from prison or placed on probation in calendar year 2005. Recidivism refers to a person's relapse into criminal behavior, often after the person receives sanctions or undergoes interventions for a previous crime. Recidivism is typically measured by criminal acts that resulted in the re-arrest, re-conviction, and/or re-incarceration of the offender over a specified period of time. Recent developments, particularly public attention to the size of the federal prison population and the cost of incarceration have refocused the Commission's interest on the recidivism of federal offenders. This report takes into account chapters four and two of the Guidelines Manual (ISBN: 9780160934896) in establishing the Commission's methods for evaluation. Scoring points for evaluation of the study group, and criminal history category identification. The Appendix comprised of tables and figures section offers the Study group's offender race, median age, re-conviction rates, re-incarceration rates, offenses categories, and more. Book excerpt: Traditional separation of powers theories assumed that governmental despotism will be prevented by dividing the branches of government which will check one another. Modern governments function with unexpected complicity among these branches. Sometimes one of the branches becomes overwhelming. Other governmental structures, however, tend to mitigate these tendencies to domination. Among other structures courts have achieved considerable autonomy vis-à-vis the traditional political branches of power. They tend to maintain considerable distance from political parties in the name of professionalism and expertise. The conditions and criteria of independence are not clear, and even less clear are the conditions of institutional integrity. Independence (including depolitization) of public institutions is of particular practical relevance in the post-Communist countries where political partisanship penetrated institutions under the single party system. Institutional integrity, particularly in the context of administration of justice, became a precondition for accession to the European Union. Given this practical challenge the present volume is centered around three key areas of institutional integrity, primarily within the administration of justice: First, in a broader theoretical-interdisciplinary context the criteria of institutional independence are discussed. The second major issue is the relation of neutralized institutions to branches of government with reference to accountability. Thirdly, comparative experience regarding judicial independence is discussed to determine techniques to enhance integrity.
