Book Synopsis Environmental Jurisdiction in the Law of the Sea by : Victor Alencar Mayer Feitosa Ventura
Download or read book Environmental Jurisdiction in the Law of the Sea written by Victor Alencar Mayer Feitosa Ventura and published by Springer Nature. This book was released on 2020-07-28 with total page 381 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book assesses the environmental jurisdiction of coastal states over the seabed within and beyond 200 nautical miles from the baselines, thus mapping out coastal states’ competencies to regulate activities impacting the marine environment of the sea floor. In addition, it offers revealing insights into the domestic legal and policy framework of a particular State in this regard. As Brazil intends to exploit mineral resources farther away offshore, technologically backed by the recognised expertise of its state-owned oil company, Petrobras, questions arise as to the adequacy of the country’s domestic legal framework to sustainably manage the immenseness of the “Brazilian Blue Amazon”. This book critically evaluates the compatibility of Brazil’s national policies and legislation with the Law of the Sea, as well as the country’s legal and institutional preparedness to face the challenges of managing approximately 4,5 million km2 of maritime spaces under national jurisdiction.
Book Synopsis The CISG and its Impact on National Legal Systems by : Franco Ferrari
Download or read book The CISG and its Impact on National Legal Systems written by Franco Ferrari and published by Walter de Gruyter. This book was released on 2009-04-27 with total page 500 pages. Available in PDF, EPUB and Kindle. Book excerpt: In force in 70 countries around the world and covering more than two thirds of world trade, the 1980 United Nations Convention on Contracts for the International Sale of Goods (CISG) is considered to be the most successful convention promoting international trade. According to many commentators, this success is due, among others, to the fact that the Convention does not directly impact on the domestic law of the various legal systems, as it applies only to international - as opposed to purely domestic - contracts. The Convention, in other words, does not impose changes in the domestic law, which makes it easier for States to adopt the Convention. This does not mean, however, that the Convention does not have any impact on the domestic law at all. This book analyzes - through 24 country reports as well as a general report submitted to the 1st Intermediate Congress of the International Academy of Comparative Law held in November 2008 in Mexico City - to what extent the Convention de facto influences domestic legal systems. In particular, the book examines the Convention's impact on the practice of law, the style of court decisions as well as the domestic legislation in the area of contract law.
Book Synopsis The Brazilian Arbitration Act by : André Abbud
Download or read book The Brazilian Arbitration Act written by André Abbud and published by Kluwer Law International B.V.. This book was released on 2019-11-13 with total page 188 pages. Available in PDF, EPUB and Kindle. Book excerpt: Brazil has risen to extraordinary prominence as an arbitration seat, and Brazilian law in matters of domestic and international arbitration has been watched all over the world due to its arbitration-friendly legislation and cutting-edge case law. This is the first book to fully recognize and elucidate this phenomenon with a detailed article-by-article examination, in English, of decisions of the Brazilian Supreme Court (STF) and the Brazilian Superior Court of Justice (STJ) on each of the Brazilian Arbitration Act’s (BAA) provisions. More than two hundred judicial decisions are directly quoted. In-depth annotation of the text of each article includes the following: a short descriptive summary of how the article is interpreted by case law and doctrine; a thorough report of decisions of the Brazilian superior courts since the 1996 enactment of the BAA referring to that article, presenting not only the majority view but also dissenting opinions; and a list of authorities interpreting each article and its relevant case law. All decisions that could represent current case law on arbitration are considered. Nearly half of the quoted decisions have direct impact on international arbitration, and many deal with enforcement of arbitral awards. Therefore, the book will attract not only Brazilian practitioners but will be particularly useful to international counsel and arbitrators dealing with Brazilian parties or cases with a Brazilian element. The only book of its kind, it will prove indispensable for arbitration scholars and law libraries. “By providing a careful and comprehensive compilation of Brazilian case law on arbitration, with a particular focus on the Superior Court of Justice’s leading precedents, this volume makes a valuable contribution to the continued development of arbitration in Brazil and elsewhere. While it will no doubt be of great use to the Brazilian bar, it is a particularly useful reference for the non-Brazilian practitioner and scholar, who do not have ready access to Brazilian court decisions or, in many cases, even knowledge of the Portuguese language”. From the foreword by Donald Francis Donovan
Book Synopsis Sustainability in Practice by : Walter Leal Filho
Download or read book Sustainability in Practice written by Walter Leal Filho and published by Springer Nature. This book was released on 2023-10-17 with total page 600 pages. Available in PDF, EPUB and Kindle. Book excerpt: Sustainability is now a widely spread concept, and much progress has been achieved since the 1970s, when it started to be widely discussed. At present, many international organizations and scientists are active in implementing sustainable development as a whole and the UN Sustainable Development Goals (SDGs) in particular. Nevertheless, the main research agenda is being led by some countries, providing a good opportunity for other nations and regions which have not yet been so active, to bring their viewpoints to the global discussion. One of these regions is Latin America. Consistent with the need for more cross-sectorial and cross-cultural interactions among the various stakeholders working in the field of sustainability in Latin America and beyond, this book pursues two main aims: a) to provide research institutions, universities, NGOs, government agencies, and enterprises from the region with an opportunity to present their works in the field of sustainability and b) to document and promote ideas and experiences acquired in the execution of sustainability projects, especially successful initiatives and good practice across the Latin America region. Last but not least, a further aim of the book is to present methodological approaches and experiences deriving from case studies and projects, which aim to show how sustainability may be enhanced in practice.
Book Synopsis Technopolitcs by : Constantino Pereira Martins (Ed.)
Download or read book Technopolitcs written by Constantino Pereira Martins (Ed.) and published by Editora Dialética. This book was released on 2024-09-24 with total page 425 pages. Available in PDF, EPUB and Kindle. Book excerpt: Technopolitics is a follow-up book that intends to depart and expand the concept of Cyberpolitics to all the dimensions and effects of technology in our lives but placing politics at the center of debate and thought. Most investigations in the fields of Humanities have highlighted the impact of digitization and social virtualization and mapped the transition from the Industrial Revolution, and mass disciplinary society, to the digital revolution, telework and social atomism. The fusion of disruptive technologies is changing the fundamentals of our world almost roaming on its own towards a near future with unprecedented and unpredictable outcomes. This new technological reason implies a rupture and a paradigm shift in the radical transition from an instrumental reason (auxiliary) to an autonomous reason (essential). This means the impossibility of further sustaining the illusion of technological neutrality. Science, culture and technology appear to be merging and in combat simultaneously. And all fields of knowledge are alert to a main idea: how deep is technology shaping our societies and politics? Regardless of the outcome, an age of instability is also an age of challenges. In our era of uncertainty, and while our civilization moves forward toward a hyper-technological future, we should not forget to discuss and reflect on the values and ethics we would like to survive the ruin of time and to pass on to the next generations.

Book Synopsis Contract Law in Brazil by : Lisiane Feiten Wingert Ody
Download or read book Contract Law in Brazil written by Lisiane Feiten Wingert Ody and published by Kluwer Law International B.V.. This book was released on 2021-05-20 with total page 230 pages. Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this practical analysis of the law of contracts in Brazil covers every aspect of the subject-definition and classification of contracts, contractual liability, relation to the law of property, good faith, burden of proof, defects, penalty clauses, arbitration clauses, remedies in case of non-performance, damages, power of attorney, and much more. Lawyers who handle transnational contracts will appreciate the explanation of fundamental differences in terminology, application, and procedure from one legal system to another, as well as the international aspects of contract law. Throughout the book, the treatment emphasizes drafting considerations. An introduction in which contracts are defined and contrasted to torts, quasi-contracts, and property is followed by a discussion of the concepts of ‘consideration’ or ‘cause’ and other underlying principles of the formation of contract. Subsequent chapters cover the doctrines of ‘relative effect’, termination of contract, and remedies for non-performance. The second part of the book, recognizing the need to categorize an agreement as a specific contract in order to determine the rules which apply to it, describes the nature of agency, sale, lease, building contracts, and other types of contract. Facts are presented in such a way that readers who are unfamiliar with specific terms and concepts in varying contexts will fully grasp their meaning and significance. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable time-saving tool for business and legal professionals alike. Lawyers representing parties with interests in Brazil will welcome this very useful guide, and academics and researchers will appreciate its value in the study of comparative contract law

Book Synopsis Religious Pluralism and Law in Contemporary Brazil by : Paula Montero
Download or read book Religious Pluralism and Law in Contemporary Brazil written by Paula Montero and published by Springer Nature. This book was released on 2024-01-29 with total page 234 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book represents a unique contribution to understanding the interactions between law and religion in contemporary Brazil. It analyzes how the regulation of religions according to the classical notion of secularism has become a source of tensions since the 1990s. Against this background, the respective chapters demonstrate, on the basis of various case studies, how the constitutional principle of pluralism, introduced by the 1988 federal constitution after a military dictatorship, has been addressed by new political actors, such as religious leaders, parliamentarians, influencers, state representatives, and activists. In particular, the chapters demonstrate how the mobilization of legal language, notably the language of human rights, has become fundamental to developing and consolidating new political agendas concerning secularism, tolerance, freedom of expression, gender and sexuality, family, and cultural heritage. In the authors’ approach, human rights assume a central role in social disputes as a language in which actors constitute themselves as rights subjects, form activist networks, and pursue their goals by expressing themselves in public. Given its focus and scope, the book will be of interest to all scholars seeking to understand the relationships between diversity and the regulation of religious practices in plural societies, where the classical notion of secularism continues to show its limitations.

Book Synopsis The Principles of BRICS Contract Law by : Salvatore Mancuso
Download or read book The Principles of BRICS Contract Law written by Salvatore Mancuso and published by Springer Nature. This book was released on 2022-08-09 with total page 444 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines national reports on contract law in each of the BRICS countries (Brazil, Russia, India, China and South Africa) in order to provide a comparative analysis. It then establishes common principles, where possible, as well as a set of general “soft law” principles governing international commercial contracts in these countries. The importance of commercial transactions in the BRICS countries is rapidly growing, yet differences in contract law among these countries can lead to misunderstandings and disputes. The rapid development of the BRICS instruments (and the legal implications of their use) suggests the need to address common legal issues that could harm the continued development of the BRICS economies. Contract law represents one of the core areas in which this process can take place. Addressing the salient legal issues within the BRICS discourse requires a comprehensive, comparative approach that explores the different solutions provided by each member country, in order to identify similarities and convergences. This process may ultimately help to reduce the legal obstacles to, and indirect costs of, cross-border transactions by offering a transparent and predictable legal environment for any future attempt at adopting common legal instruments.
