Book excerpt: This paper uses examples concerning hydropower projects and other issue-areas of actual or potential conflict to illustrate the potential for watercourse-related conflicts to arise in southern Africa; and examines the international legal framework for addressing such conflicts. The paper presents arguments generally on the nature of conflict over water, be such conflict international, national, regional or local. The argument is made that both the reluctance of countries in this region to ratify the United Nations Convention on the Law of the Non-Navigational Uses of International Watercourses and their lack of recourse to the Southern African Development Community (SADC) Revised Protocol on Shared Watercourses (which is modeled on the Convention) as a 'first resort' for resolving conflict represent a 'missed opportunity', one which will hopefully be resolved in the future when conflicts arise over shared watercourses.

Available in PDF, EPUB and Kindle. Book excerpt: At the UN General Assembly in 1997, an overwhelming majority of States voted for the adoption of the United Nations Convention on the Law of the Non-Navigational Uses of International Watercourses – a global overarching framework governing the rights and duties of States sharing freshwater systems. Globally, there are 263 internationally shared watersheds, which drain the territories of 145 countries and represent more than forty percent of the Earth's land surface. Hence, inter-State cooperation towards the sustainable management of transboundary water supplies, in accordance with applicable international legal instruments, is a topic of crucial importance, especially in the context of the current global water crisis. This volume provides an assessment of the role and relevance of the UN Watercourses Convention and describes and evaluates its entry into force as a key component of transboundary water governance. To date, the Convention still requires further contracting States before it can enter into force. The authors describe the drafting and negotiation of the Convention and its relationship to other multilateral environmental agreements. A series of case studies assess the role of the Convention at various levels: regional (European Union, East Africa, West Africa, Central Asia, Central America and South America), river basin (e.g. the Mekong and Congo) and national (e.g. Ethiopia and Mexico). The book concludes by proposing how future implementation might further strengthen international cooperation in the management of water resources, to promote biodiversity conservation as well as sustainable and equitable use.

Available in PDF, EPUB and Kindle. Book excerpt: Water resource management throughout the world is a very complicated issue, involving various aspects and dimensions and a well-coordinated set of policies. A well-designed water policy is a multi-faceted concerted intervention, which could be specific to just one set of political and physical socio-economic conditions. A framework to analyse the interaction between policy design and implementation can assist in improving both of these in various physical, economic and political situations. This book focuses on the interaction between policy making and strategic behaviour of policy makers, water users and other stakeholders, and how policy analysis and other analytical tools from the field of game theory and negotiation can improve policy design. The book presents analysis by high-level policy makers and policy analysts from various countries, to share experience regarding specific policy issues that are relevant to almost any country in the world, but may have been addressed differently in each country.

Book excerpt: What are the rules of international water law that govern the use of the transboundary aquifers shared by Palestine and Israel? This book addresses this issue through an interdisciplinary approach, identifying first the special problems tied to the management of shared groundwater, and next critically analysing the applicable rules of international law. The innovative contribution of this work is its attempt to devise and suggest the means to implement a "progressive framework" for cooperation in the development and management of these shared waters. A solid review of hydro-politics, supported by current up to date information and rigorous examination of the evolution of the relevant rules of international law makes this book an important contribution to this very problematic area. Dr Fadia Diabes-Murad was awarded the Edberg Award 2005, presented at a special awards ceremony in Stockholm. The award recognised her contribution to peace in the Middle East through her work on water law, including using water as a catalyst for peace in the Middle East.

Available in PDF, EPUB and Kindle. Book excerpt: Southern Africa is one of the world's most critical regions in terms of the management of shared water resources. This is due to a number of factors including: the large disparity in the availability of water between the relatively wet northern part of the region and the drier south; and the fact that the first transboundary transfer of water occurred in this region, between Lesotho and South Africa. This book examines both the risks and opportunities for water management in the new political environment in the region. Issues discussed include: the role of public participation, transboundary freshwater treaties; institutional aspects of international water system management; and hydropolitics.

Available in PDF, EPUB and Kindle. Book excerpt: Water plays a key role in addressing the most pressing global challenges of our time, including climate change adaptation, food and energy security, environmental sustainability and the promotion of peace and stability. This comprehensive handbook explores the pivotal place of law and policy in efforts to ensure that water enables positive responses to these challenges and provides a basis for sound governance. The book reveals that significant progress has been made in recent decades to strengthen the governance of water resource management at different scales, including helping to address international and sub-national conflicts over transboundary water resources. It demonstrates that ‘effective’ laws and policies are fundamental drivers for the safe, equitable and sustainable utilization of water. However, it is also shown that what might constitute an effective law or policy related to water resources management is still hotly debated. As such, the handbook provides an important and definitive reference text for all studying water governance and management.

Book excerpt: 'Conflict and Cooperation on South Asia's International Rivers' traces the development of international water law. This book focuses on the hydro-politics of four countries in the South Asia region: Bangladesh, India, Nepal, and Pakistan. It analyzes the problems that these countries have encountered as riparians of international rivers and how they have addressed these problems. In particular, this study reviews the treaty regimes governing the Indus River basin, the Ganges River basin, and the Kosi, Gandaki, and Mahakali river basins. Each of these regimes is described in-depth, with special attention devoted to the main problems each of these treaties sought to address. The authors also review the treaty experience and offer observations on bilateralism and multilateralism.
