Book excerpt: In Queensland, retirement villages are regulated under the Retirement Villages Act 1999. This Act is being reviewed. Four critical issues are discussed in this Regulatory Impact Statement (RIS). The first issue involves the associated legal, financial and practical considerations when an existing retirement village closes down, including whether compensation should be paid to the remaining residents and how village units are valued. The second issue concerns managing behavioural issues such as harassment, intimidation and infringement of privacy between residents and other people at a retirement village. The third issue concerns whether operators should be able to offer prospective residents alternative payment models to the model prescribed in the Act, such as charging rent instead of asking for payment of an exit fee, and how such models should be developed. The final issue concerns whether a resident who has left the village should be entitled to their exit entitlement before resale of their unit, particularly in circumstances where there is a significant delay in reselling the unit.
