Available in PDF, EPUB and Kindle. Book excerpt: In any settler and/or postcolonial society, heritage is a complex and contested topic that involves indigenous, imperial and other migrant components. In Australia, this situation is compounded by the unique characteristics of the country's natural environment, the considerable diversity of its migrant intake and the demographic and technological imbalances between its indigenous and settler populations. This volume brings together internationally recognized academics and emerging scholars, whose expertise extends through the areas of tourism, planning, heritage management, environmental studies and state and local government. Through a representative set of case studies from across the country's states and capital cities, the contributors demonstrate the range and diversity of heritage issues currently confronting Australia, and consider possible ways of resolving these.

Book excerpt: " There have been times when Australian court judgments have held enormous weight in courts throughout the world, certainly throughout the Commonwealth. Owen Dixon's High Court in the 1950s and Anthony Mason's High Court in the 1980s are examples. If there were an Olympic record for teams of judges - and why not since they have Olympic medals for tae kwon do and beach volleyball - the Mason court would have won gold year after year. The quality of its jurisprudence was the best in the world" - Geoffrey Robertson QC, Sydney Morning Herald, 30th August 2007.This book comprises a selection of articles and speeches by Sir Anthony Mason written and delivered when he was a Justice and later Chief Justice of the High Court of Australia and after his retirement from that Court in 1995. It demonstrates his long standing interest in the judicial process and his desire to communicate to the legal world and the public a more enlightened understanding of the proper scope of judicial law-making and the responsibility of judges for adapting the law to the changing conditions in society. It also displays his acknowledged mastery of public and private law and his belief in the growing significance of international and comparative law in the development of Australian law. The book contains some important speeches and articles on constitutional and administrative law, international law, human rights, equity and contract, the High Court, judicial administration, advocacy, a significant media interview, a State of the Judicature report delivered as the Chief Justice of Australia and his swearing in speeches when appointed as a Justice and later Chief Justice of the High Court. Some of the selected speeches display Sir Anthony's characteristic wit. The book deals with highly topical subjects such as whether Australia should adopt a bill of rights, the health of Australia's democratic institutions, the establishment of an Australian republic, globalization and the decline of parliamentary and national sovereignty. The articles and speeches were chosen and edited by Professor Geoffrey Lindell in consultation with Sir Anthony.

Available in PDF, EPUB and Kindle. Book excerpt: This book explores the judiciary's role in achieving substantive equality utilising statutory discrimination law. The normative literature suggests that to eliminate discrimination, courts have to adopt a more substantive interpretation of discrimination laws, but the extent to which this has occurred is variable. The book tackles the problem by exploring the idea that there needs to be a 'creative' interpretation of discrimination law to achieve substantive results. The author asks: is a 'creative' interpretation of statutory discrimination law consistent with the institutional role of the judiciary? The author takes a comparative approach to the interpretation of non-discrimination rights by considering the interpretation of statutory discrimination law in the UK, Canada and Australia. The book explores the differences in doctrine that have developed by considering key controversies in discrimination law: Who does discrimination law protect? What is discrimination? When can discrimination be justified? The author argues that differences in the case law in each jurisdiction are explained by the way in which the appropriate role for the courts in rights review, norm elaboration and institutional competence is conceived in each studied jurisdiction. It provides valuable reading for academics, policy makers and those researching discrimination law and statutory human rights.

Available in PDF, EPUB and Kindle. Book excerpt: In the 1970s the Australian Commonwealth Government and three States, Victoria (1974), New South Wales (1977) and South Australia (1978), passed legislation to protect the built heritage within their jurisdictions. The legislation was primarily a response to two factors: a large number of public protests against the demolition of historic buildings in all Australian states by the 1970s and the influence of the UNESCO World Heritage Convention, which the Whitlam Government (1972-75) embraced enthusiastically. The other states, with governments that were more influenced by development interests, were slow to follow the federal lead. In this study, Sharon Mosler examines heritage issues and conflicts in Adelaide from enactment of the first South Australian Heritage Act in 1978 to its successor in 1993, and also analyses issues leading from that period into the twenty-first century. State legislation introduced by the Labor government of Premier Mike Rann (2002 - present) has affected the built environment significantly since this book began. The Rann government has given the built heritage a low priority in its strategic plan compared to population growth, while the Adelaide City Council has become more balanced in the past decade, although the council too has focussed on increasing Adelaides population. The result has been more high-rise buildings at the expense of heritage conservation and historic precincts.

Book excerpt: Government Accountability: Australian Administrative Law Sources and Materials is a companion text to the second edition of Government Accountability: Australian Administrative Law. The casebook follows the structure of the textbook and provides a sophisticated and in-depth introduction to the principal areas of administrative law taught in Australia. Extracts from primary materials – including cases, legislation and judicial review – provide readers with an understanding of the key principles of administrative law and demonstrate how these mechanisms operate in practice. Case extracts provide a clear account of the facts, issues and statutory provisions considered by the courts. Extracts from secondary sources, including from parliamentary reports and publications by leading commentators in this field, further elucidate key concepts and controversies. Written by experts with substantial teaching and research experience, this is an essential text that will equip students with the tools to think critically and successfully apply the law to practice.
