Statements and comments are based upon actual analysis and in large enacted in the various states. These tables present so many typographical difficulties that it was not thought expedient to publish them. Chapter IV of the Introduction originally appeared in the Annals of the American Academy of Political and Social Science, for January, 1902; and chapters II, III, and IV of Part III appeared in the Political Science Quarterly for September, 1902. The author desires to acknowledge his indebtedness to the editors of these publications for their courtesy and kindness in permitting the use of this material in the present volume. Book excerpt: Excerpt from Railway Corporations as Public Servants This work contains the substance of a course of lectures delivered in May, 1907, at the Boston University School of Law. It is, to some extent, supplementary to a previous work on "Restrictive Railway Legislation," as it describes the development of such legislation since the passage of the Act to Regulate Interstate Commerce. The treatment of the subject is, however, more particularly directed to an amelioration of the existing relations between railway corporations and the public whom they serve. Book excerpt: Excerpt from Railway Regulation: State and Interstate To meet and wisely discharge the responsibility of regulating commerce, state and interstate, to bring railways back and hold them to their legitimate business as common carriers, is the most important work in the government of this republic for this generation of man. If the great railway corporations of the country are using their unlimited power without abusing it, if they are transporting the commerce of the country at reasonable rates, with fairness to the general public, with a just regard to the rights of individuals, and without favoritism to places and persons, then they might justly regard government control and regulation as "unnecessary and meddlesome interference." If, however, the public is suffering serious wrong, if there are far-reaching abuses in the transportation of its commerce, if the railway companies are not only carrying the commerce of the country but controlling the commerce of the country, determining where it shall be massed, where the markets shall be located, and their control; if they are discriminating in favor of the large shipper, creating and fostering industrial and commercial monopoly, then there rests upon the several state legislatures and upon congress an obligation to act, and to act at once, with all the determination and patriotism commensurate with the duty to preserve government itself. Capital and labor, wherever employed in the creation of wealth, - whether in mining, or in manufacturing, or in agriculture, - in short, material production, in every field of human activity, is absolutely dependent upon transportation. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Proposed Radical Railway Legislation: An Address Delivered Before the Faculty and Students of the University of Missouri, October 20, 1905 That there should be favoritism in the charges for rail way service is intolerable; it is, also, as contrary to the law of the land as that there shall be murder or theft. But social order is still interrupted by occasional larcenies and malicious homicides, and there is no evidence that the law against rebates is more frequently violated than those which forbid other offenses. Yet if any one can suggest a modification of the present law that will more effectually protect the public against the direct or indirect preferment of one shipper over another, through rebates or other con cessions from the published schedules of charges, the sug gestion will become, promptly and without opposition from any railway officer, a part of the Federal statute law. Public antipathy to rebates ought not, however, to be used to further the enactment of legislation having no bear ing upon that subject. To confer rate-making power upon the Interstate Commerce Commission could in no way hinder the payment of rebates; it would, on the contrary, make illegal concessions from the published schedules the only means of approximating that elasticity in railway charges which is essential to the upbuilding of industry. Book excerpt: Excerpt from Railroad Legislation as Developed Up to Date: December 10, 1919 The Senate did not consider either Bill during the first session but has taken up the subject in the session which has just convened. If the usual course is followed, it will substitute its own Bill for the House Bill, and after extended debate and probably amendments, it will pass its Bill, and the differences between the two measures will be worked out in conference. The Esch Bill in the House. The Esch Bill as amended and passed by the House contains the following discouraging features: 1. The first and fundamental objection is that it bases its whole scheme of relief upon the Interstate Commerce Commission. It imposes upon the already overburdened Commission the performance of many new duties and the administration of many new regulations. Book excerpt: Excerpt from The Law of Transport by Railway The author apprehends that such a division of the Law of Railways coincides with a true distinction in subject - matter, and calls for no elaborate justification here, notwithstanding that here and there the line of demarcation is hard to trace, and that occasionally in the interests of lucidity and completeness it is necessary to ignore it. Nor is it necessary to justify the treatment in this work of the common law of carriage in as great detail as the statutory law peculiar to railways. For the former is still at least of equal importance, and its existence is pre - supposed in every provision of the latter. Book excerpt: Excerpt from Report of the Joint Special Committee on Railroad and Street Railway Laws To the Honorable Senate and House of Representatives: - I. Introduction. The committee was appointed under the following joint order of the General Court of the year 1905: - Ordered That a joint special committee, to consist of four members of the Senate and eleven members of the House, be appointed to sit during the recess of the General Court, to revise, consolidate and arrange the general laws of the Commonwealth pertaining to railroad and street railway corporations, and to consider the expediency of such legislation in amendment thereof and in addition thereto as will better protect the interests of the public and of the investors in said corporations. This order is in terms very broad. It empowers the committee "to revise, consolidate and arrange the general laws of the Commonwealth pertaining to railroad and street railway corporations," and also "to consider the expediency of such legislation in amendment thereof and in addition thereto as will better protect the interests of the public and of the investors in said corporations." Were the committee to comply literally with the terms of this order, it would be obliged to deal with the whole subject of the railroad and street railway legislation of the Commonwealth, and all the intricate and difficult problems that that legislation presents. It became apparent at once to the committee that it would be impossible for it to undertake any such comprehensive task. It has therefore limited the scope of its inquiry, and also of its action.
