Book Synopsis Witchcraft Accusations and Persecutions as a Mechanism for the Marginalisation of Women by : Samantha Spence
Download or read book Witchcraft Accusations and Persecutions as a Mechanism for the Marginalisation of Women written by Samantha Spence and published by Cambridge Scholars Publishing. This book was released on 2017-08-21 with total page 283 pages. Available in PDF, EPUB and Kindle. Book excerpt: This books draws on feminist commentary from the disciplines of anthropology, history, law, politics and sociology in order to deal with the phenomenon of modern-day witchcraft. It focuses on the re-emergence of witchcraft beliefs in contemporary society, suggesting that witchcraft accusations and persecution are being used as a marginalisation mechanism of women. The re-emergence of witchcraft beliefs in contemporary society and the prevalence of the violence associated with such beliefs has received little attention within academic literature, yet witchcraft-related violence against women is, progressively, becoming one of the most pervasive forms of violence facing women today. This book addresses this gap in the literature, discussing the return of witchcraft beliefs to contemporary society, whilst assessing the effectiveness of international human rights law in protecting women from witchcraft accusations and persecution.

Book Synopsis Honour Based Crimes and the Law by : Mukaddes Gorar
Download or read book Honour Based Crimes and the Law written by Mukaddes Gorar and published by Routledge. This book was released on 2021-05-10 with total page 196 pages. Available in PDF, EPUB and Kindle. Book excerpt: Honour based violence and abuse manifests itself in different forms, and this book offers a comprehensive understanding of this phenomenon. This book argues that the limits of honour crimes must be defined more widely so that they include conducts and behaviours that originate from the patriarchal notion of honour, such as honour based oppression and breast ironing. The book provides a critical analysis and synthesis of the law in England and Wales and in the international human rights sphere. The relevant domestic legislation and cases are examined to reflect on whether adequate protection is provided for the victims and potential victims of honour based violence and abuse. Since honour based violence is a violation of human rights, the relevant international human rights law is examined to illustrate the perception of such crimes in the international arena. The effectiveness of any remedy for victims of honour based violence and abuse depends on its capability to change deep rooted behaviours in communities with honour based patriarchal values. This book argues that the law does not provide the effective impact required, in part due to patriarchal structures, and that more efforts should be dedicated to changes in education. It is held that there is a need for an educational programme that is especially designed to tackle violence and promote gender equality. The book will be essential reading for academics, researchers and policy-makers working in the areas of Human Rights Law, Criminal Law and Gender Studies.

Available in PDF, EPUB and Kindle. Book excerpt: This book addresses women’s rights to work and motherhood in Libya from a legal and international human rights perspective. In an attempt to solve the problem posed by the perception that there is an unsolvable conflict between the right of women to work and their right to motherhood, the author considers how these two sets of rights, as protected under international human rights law, can and should be recognised and promoted within the Libyan legal system. Including first-hand accounts of experiences of Libyan women, the study voices their struggle for their rights as guaranteed by domestic law, international conventions and Islam. Providing a rare insight into a region striving to find its new identity, the author assesses the adequacy of existing Libyan laws and, where warranted, offers proposals for legislative amendments to Libyan policy makers and its new Parliament at such a crucial time in the nation’s history.
Book Synopsis The Public Law of Gender by : Kim Rubenstein
Download or read book The Public Law of Gender written by Kim Rubenstein and published by Cambridge University Press. This book was released on 2016-05-26 with total page 629 pages. Available in PDF, EPUB and Kindle. Book excerpt: With the worldwide sweep of gender-neutral, gender-equal or gender-sensitive public laws in international treaties, national constitutions and statutes, it is timely to document the raft of legal reform and to critically analyse its effectiveness. In demarcating the academic study of the public law of gender, this book brings together leading lawyers, political scientists, historians and philosophers to examine law's structuring of politics, governing and gender in a new global frame. Of interest to constitutional and statutory designers, advocates, adjudicators and scholars, the contributions explore how concepts such as equality, accountability, representation, participation and rights, depend on, challenge or enlist gendered roles and/or categories. These enquiries suggest that the new public law of gender must confront the lapses in enforcement, sincerity and coverage that are common in both national and international law and governance, and critically and pluralistically recast the public/private distinction in family, community, religion, customary and market domains.

Book Synopsis Social Institutions and International Human Rights Law Implementation by : Julie Fraser
Download or read book Social Institutions and International Human Rights Law Implementation written by Julie Fraser and published by Cambridge University Press. This book was released on 2020-08-06 with total page 339 pages. Available in PDF, EPUB and Kindle. Book excerpt: Having articulated numerous human rights norms and standards in international treaties, the pressing challenge today is their realisation in States' parties around the world. Domestic implementation has proven a difficult task for national authorities as well as international supervisory bodies. This book examines the traditional State-centric and legalistic approach to implementation, critiquing its limited efficacy in practice and failure to connect with local cultures. The book therefore explores the permissibility of other measures of implementation, and advocates more culturally sensitive approaches involving social institutions. Through an interdisciplinary case study of Islam in Indonesia, the book demonstrates the power of social institutions like religion to promote rights compliant positions and behaviours. Like the preamble of the 1948 Universal Declaration of Human Rights, the book reiterates the role not just of the State but indeed 'every organ of society' in realising rights.

Book Synopsis Gender, Sexuality, and the Law by : Debra L. DeLaet
Download or read book Gender, Sexuality, and the Law written by Debra L. DeLaet and published by Routledge. This book was released on 2020-06-29 with total page 269 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume examines the role of law as a tool for advancing women’s rights and gender equity in local, national, and global contexts. Many feminist scholars note a marked failure of law to achieve goals connected to women’s rights and gender equality. Despite its limitations, law provides aspirational norms that can be mobilized to hold institutions accountable and to provide material benefit to those excluded from systems of power. In conversation with each other, the chapters in this volume help to advance understanding of both the limitations and the potential of law as a tool for advancing democratic participation, rights, and justice around issues related to gender and sexuality. Contributors acknowledge, to varying degrees, that law has important symbolism and may be used as a lever to mobilize change. At the same time, some offer cautionary notes about the potential downside risks and unintended consequences of relying upon law in pursuit of women’s rights and gender equity. Collectively, the chapters in this volume explore the disjuncture between the promise and expectation of legal reform and the lived experience of those laws by people intended as the beneficiaries of legal change. This book was originally published as a special issue of Global Discourse.
Book Synopsis Women's Property Rights Under CEDAW by : José E. Alvarez
Download or read book Women's Property Rights Under CEDAW written by José E. Alvarez and published by Oxford University Press. This book was released on 2024 with total page 433 pages. Available in PDF, EPUB and Kindle. Book excerpt: For over 40 years, the leading international treaty body on women's rights, the Committee on the Elimination of All Forms of Discrimination Against Women (the CEDAW Committee), has been generating jurisprudence interpreting CEDAW's obligations that states protect the equal rights of women. This book concludes that CEDAW's re-engendering of property--although a flawed and evolving work in progress--has the potential to be transformative for the half of the planet who is more likely to be treated as property than to have any.
