Esta complicación trasciende al plano jurídico en aquellos casos en los que, durante tal proceso, se haya incurrido en defectos que inevitablemente provocan un perjuicio en el patrimonio del propietario del inmueble construido. La ineludible intervención de un número elevado de profesionales a fin de que la actividad edificadora resulte exitosa, suele dificultar en exceso la determinación del sujeto responsable de las deficiencias constructivas cuando el perjudicado decide ejercitar su legítima pretensión indemnizatoria. Esta obra de corte práctico va dirigida principalmente a los operadores jurídicos que, de una u otra forma, hayan de enfrentarse a un procedimiento judicial de reclamación por vicios de la construcción, de larga duración y elevado coste en la práctica totalidad de los casos. En ella se analizan las numerosas cuestiones y dificultades, tanto procesales como de fondo, que plantea el régimen legal específico de este tipo de demandas, contenido en la Ley 38/1999, de 5 de noviembre, de Ordenación de la Edificación. Los veintitrés años transcurridos desde su entrada en vigor no restan interés ni actualidad al tema, pues persisten a día de hoy las discrepancias doctrinales sobre muchas de las cuestiones abiertas, que carecen aún de una respuesta consolidada por parte de nuestros tribunales. Sin descuidar el estudio de la doctrina científica, la autora se detiene en el análisis de la copiosa jurisprudencia del Tribunal Supremo recaída en la materia, dejando constancia incluso de su evolución en aquellos extremos en los que se han producido cambios de criterio.

Por otro lado, quince años después de su promulgación, la Ley de Ordenación de la Edificación se encuentra hoy en plena fase de interpretación jurisprudencial y estamos asistiendo a constantes intentos (más o menos acertados) de la doctrina y la jurisprudencia por alcanzar una posición pacífica y justa respecto a las responsabilidades legales y contractuales de los agentes de la edificación en general —y del arquitecto en particular—. Centrando el estudio en el arquitecto, con su preeminencia jurídica y técnica, esta obra analiza punto por punto la base legal, doctrinal y jurisprudencial de sus responsabilidades. Se analiza la doctrina científica más relevante y se exponen sus diferentes teorías y propuestas. Al mismo tiempo, se ilustra constantemente la exposición teórica, con la plasmación práctica en el ámbito judicial de las distintas teorías y doctrinas, mediante el análisis de más de cuatrocientas sentencias del Tribunal Supremo referidas específicamente al tema de estudio.
